For several years now, the question of “trademark use” has taken center stage in the debate over trademark liability of online intermediaries. Doctrinally, the debate addresses whether the Lanham Act places any limit on the types of “use” of trademarks that can subject one to a claim of infringement. The real conflict, however, has occurred at the normative level: whatever the Lanham Act says or does not say about trademark use, should trademark law limit the definition of infringement to situations in which the defendant has used the mark to brand its own products?

Economic and Business Review

The paper follows the idea of heterodox economists that a cost-plus price is above all a reproductive price and growth price. The authors apply a firm-level model of markup determination which, in line with theory and empirical evidence, contains proposed firm-specific determinants of the markup, including the firm’s planned growth. The positive firm-level relationship between growth and markup that is found in data for Slovenian manufacturing firms implies that retained profits gathered via the markup are an important source of growth financing and that the investment decisions of Slovenian manufacturing firms affect their pricing policy and decisions on the markup …

The objective of the study is threefold. Firstly, the study explores the learning approaches adopted by students in completing their Business Finance. Secondly, it examines the impact that learning approaches has on the student’s academic performance. Finally, the study considers gender differences in the learning approaches adopted by students and in the relationship between learning approaches and academic performance. This study investigates: a) the influence o f firm size and book-to-market ratio on bankruptcy risk, and b) the effect o f bankruptcy risk, firm size, and book-to-market ratio on subsequent return. The study employs Altman Z-Score and Ohlson 0-Score as proxies for bankruptcy risk. The results show that size has positive impact on Bankruptcy Risk measured by Altman Z-Score while book-to-market has positive impact on bankruptcy risk measured Ohlson 0-Score. Furthermore, the results show that none o f the variables has significant impact on subsequent return. Overall, this study asserts Dichev’s (1998) findings that bankruptcy risk is not rewarded …

Trust And The Successful Coordination Of Sme Co-Operation – An Empirical Study In Slovenia, Matthias Fink, Alexander Kessler, Mojca Duh, Jernej Belak, Richard Lang

This paper aims to investigate the role of trust and test the impact of trust on performance in the context of co-operation between small- and medium-sized enterprises (‘SMEs’) in a transition country. Based on a sample of 122 Slovenian SMEs, an analysis based on OLS regression reveals that trust does have a strong impact on performance. We thereby identify trust as a powerful co-ordinating mechanism for SME relationships involving co-operation in transition economies.

Sustaining The Challenge From The Outskirts: City Centre Retail Viability In Ljubljana, Slovenia, Andreja Cirman, Marko Pahor

Economic and Business Review

Like many other cities, Ljubljana is no exception to changes in its retail landscape. With retail suburbanisation, the city centre's monopoly as a shopping district has been lost. Our paper studies customer-perceived shopping area attributes and their impacts on patronage. The conceptual framework is set up to investigate factors that draw consumers to different shopping areas. The model was tested on a sample of consumers to evaluate the importance of various shopping area attributes and their performance in two decentralised shopping areas and the downtown shopping area in Ljubljana, Slovenia.

Visual perception is the ability to manipulate and integrate the visual information received by brain. Early damage involving the structures of visual perception in the brain will give rise to visual perceptual impairment. The periventricular area is one of those structures related to visual perception. Nearly all preterm infants with spastic diplegia exhibit cystic periventricular leukomalacia. Therefore, it has been wondered if children with diplegic cerebral palsy were at risk of visual perceptual impairment. This article reports on the results of an assessment of an introductory rural sociology course offered at two land-grant universities, which are very different in size. These institutions are North Carolina A&T State University and The Ohio State University. The authors use similar assessment tools, including an embedded pre and post test of knowledge gained, students’ written comments to open-ended questions administered at the end of term about the quality of the class and the instructors, and the traditional, standardized Student Evaluation of Instruction, an instrument used across many universities. A collaborative research project was developed for a multidisciplinary class of advanced undergraduate and graduate students enrolled in Sociology of Natural Resources and the Environment. The goals of the project were to determine the feasibility of offering an experiential learning opportunity and to explore its usefulness in enhancing students’ thinking about the social constructedness of natural resource and environmental (NRE) problems. Background and Objective: Several evidence-based treatment programs for improving upper extremity functions such as constraint-induced therapy (CIT)/modified CIT (mCIT) and bilateral movement training (BMT) have been developed recently. The mCIT program combines restraint of the unaffected hand with intensive training of the affected hand, and BMT involves intensive bilateral training with symmetrical functional training. In this study, the relative efficacy of mCIT vs. BMT was compared by a kinematic analysis that quantitatively assessed motor control in high functioning stroke patients when performing unilateral and bilateral functional tasks.Methods: In a pretest-posttest, randomized controlled trial, twenty-three stroke patients were randomly allocated to …

Segmental zoster paresis is a rare complication of cutaneous herpes zoster. Clinical diagnosis of segmental zoster paresis depends upon a history of painful vesicular eruptions in a dermatomal distribution, followed by muscle weakness in the related myotomes. We report the case of a 45-year-old woman with opticospinal type multiple sclerosis with recent cutaneous herpes zoster and right shoulder girdle weakness. Differential diagnosis included multiple sclerosis relapse, zoster myelitis, segmental zoster shoulder paresis, cervical radiculopathy, and shoulder joint or soft-tissue disorders. Intravenous pyelography (IVP) is a common tool for evaluating the upper urinary tract in spinal cord injury patients. To obtain a proper image, bowel preparation is required. Among the regimens for bowel preparation, polyethylene glycol (PEG) electrolyte lavage solution has a good cleansing quality and fewer side effects. Nonetheless, adverse effects of the regimen, though rare, have been reported. We describe a spinal cord injury patient who suffered from acute renal failure as a result of PEG-related toxicity, after taking oral PEG electrolyte lavage solution for bowel preparation.
