Endowment Effects In Contests, Curtis R. Price, Roman M. Sheremeta
Endowment Effects In Contests, Curtis R. Price, Roman M. Sheremeta
ESI Working Papers
We design an experiment to test if the manner in which subjects receive the endowment has any bearing on the amount of overbidding in contests. We find that overbidding is significantly higher when subjects are given a large per-experiment endowment rather than when the endowment is given per-period. Risk-aversion and non-monetary utility of winning play important roles in explaining our findings.

Go West Young Man: Self-Selection And Endogenous Property Rights, Taylor Jaworski, Bart J. Wilson
ESI Working Papers
If, as Hume argues, property is a self-referring custom of a group of people, then property rights depend on how that group forms and orders itself. In this paper we investigate how people construct a convention for property in an experiment in which groups of self-selected individuals can migrate between three geographically separate regions. We find that the absence of property rights clearly decreases wealth in our environment and that interest in establishing property rights is a key determinant of the decision to migrate to a new region. Theft is nearly eliminated among migrants, resulting in strong growth, and non-migrants …

The Success Of Chapter 11: A Challenge To The Critics, Elizabeth Warren, Jay Lawrence Westbrook
The Success Of Chapter 11: A Challenge To The Critics, Elizabeth Warren, Jay Lawrence Westbrook
Michigan Law Review
Although Chapter 11 has served as a model for bankruptcy reform around the world, the conventional wisdom has been that it is characterized by a relatively low success rate and endless delay. The data from large samples of Chapter 11 cases filed in 1994 and 2002 demonstrate that this characterization is wrong. Nearly all troubled companies choose Chapter 11 over Chapter 7 liquidation, which means that the system serves a critical screening function to eliminate hopeless cases relatively quickly. Almost half the unsuccessful cases were jettisoned within six months and almost eighty percent were gone within a year The cases …
The Validity Of Deal Protection Devices Under Anglo-American Law, Wai Yee Wan
The Validity Of Deal Protection Devices Under Anglo-American Law, Wai Yee Wan
Research Collection Yong Pung How School Of Law
This paper analyzes deal protection devices, specifically termination fees and lockup agreements, that are entered into by publicly listed target companies in favor of the bidders, under Anglo-American law. U.S. (specifically Delaware) and U.K. law and regulation differ markedly in the regulation of these devices. Delaware law generally gives more leeway for the target board to enter into deal protection devices. The U.K. regime is much more shareholder-centric and severely restricts most types of deal protections. This paper examines the differences and argues that the U.K. regime is the result of the strong influence of institutional share ownership. In contrast, …
The Taiwan Question And The One-China Policy: Legal Challenges With Renewed Momentum, Pasha L. Hsieh
The Taiwan Question And The One-China Policy: Legal Challenges With Renewed Momentum, Pasha L. Hsieh
Research Collection Yong Pung How School Of Law
The question of Taiwan’s status has faced legal challenges from the one- China policy under both domestic law and international law. The article argues that the state status of the Republic of China (ROC) on Taiwan has never ceased to exist as a result of either the loss of diplomatic recognition or the United Nations Resolution 2758, which transferred the UN seat from the ROC to the People’s Republic of China (PRC). In the past decades, the ROC and the PRC possess separate statehoods and have co-existed under the “de jure roof of China.” The evolvement of state practice of …

Counting Offenses, Jeffrey M. Chemerinsky
Counting Offenses, Jeffrey M. Chemerinsky
Duke Law Journal
Is a criminal defendant who discharges a weapon five times in rapid succession guilty of one crime or several crimes? This question of how to divide charges has vexed legal philosophers and Supreme Court Justices. It is a question of profound importance, but one that legal scholarship has seldom addressed. The answer has an impact on each stage of a criminal justice prosecution. The difference between one charge and multiple charges can affect the likelihood of a plea bargain, the strategy for trial, and, if the defendant is convicted, the length of a prison sentence. This Note, citing numerous examples …
Money, Politics, And Impartial Justice, Joanna M. Shepherd
Money, Politics, And Impartial Justice, Joanna M. Shepherd
Duke Law Journal
A centuries-old controversy asks whether judicial elections are inconsistent with impartial justice. The debate is especially important because more than 90 percent of the United States' judicial business is handled by state courts, and approximately nine in ten of all state court judges face the voters in some type of election. Using a stunning new data set of virtually all state supreme court decisions from 1995 to 1998, this paper provides empirical evidence that elected state supreme court judges routinely adjust their rulings to attract votes and campaign money. I find that judges who must be reelected by Republican voters, …
Chevron’S Mistake, Lisa Schultz Bressman
Chevron’S Mistake, Lisa Schultz Bressman
Duke Law Journal
Chevron U.S.A. Inc. v. Natural Resources Defense Council, Inc. asks courts to determine whether Congress has delegated to administrative agencies the authority to resolve questions about the meaning of statutes that those agencies implement, but the decision does not give courts the tools for providing a proper answer. Chevron directs courts to construe statutory text by applying the traditional theories of statutory interpretation-whether intentionalism, purposivism, or textualism-and to infer a delegation of agency interpretive authority only if they fail to find a relatively specific meaning. But the traditional theories, despite their differences, all invite courts to construe statutory text as …
Avoiding Mere Incantations: Evaluating Success On Nonfee Claims When Determining Prevailing-Party Status Under 42 U.S.C. § 1988, Jessica L. Brumley
Avoiding Mere Incantations: Evaluating Success On Nonfee Claims When Determining Prevailing-Party Status Under 42 U.S.C. § 1988, Jessica L. Brumley
Duke Law Journal
The American rule dictates that regardless of the outcome, parties pay for their own attorneys' fees unless Congress has specifically enacted a fee-shifting statute authorizing courts to award fees to prevailing parties. One of the most recognized fee-shifting statutes is 42 U.S.C. § 1988. Courts and scholars have extensively discussed whether a plaintiff is a prevailing party under § 1988. Yet both have largely ignored one scenario in which a plaintiff files a suit containing both constitutional claims for which fees are authorized under § 1988 (fee claims) and state law claims for which fees are not authorized (nonfee claims). …
Death Of The Role-Play, Nadja Alexander, Michelle Lebaron
Death Of The Role-Play, Nadja Alexander, Michelle Lebaron
Research Collection Yong Pung How School Of Law
Setting someone up to fail does indeed sound unfair. In fact it could be described as an ambush – outlaw facilitators lying in wait for unsuspecting students. Not only is this unsettling in a training environment, we can ask whether this lack of transparency runs counter to the behavior expected of negotiators and mediators. Far from being a figment of our fertile imaginations, this short vignette is drawn from a real life learning situation at which both authors were present. Participants were asked at the beginning of the postgraduate workshop about their learning preferences. While most replied enthusiastically about learning …
Law School And The Making Of The Student Into A Lawyer: Transformation Of First Year Law Students In The National University Of Singapore, Seow Hon Tan
Research Collection Yong Pung How School Of Law
This paper examines the impact of legal education and law school on the student's moral development and conception of professional identity, through an empirical study of first year law students of the Class of 2010 at the National University of Singapore. The project aims to increase consciousness of how law school remakes students and develops the moral and professional identity of future lawyers, and to facilitate a dialogue that reshapes legal education to achieve its aims. Given that legal education in Singapore is similar to that in other law schools in common law jurisdictions, the analysis is, with allowances for …
The Nature Of Torrens Indefeasibility: Understanding The Limits Of Personal Equities, Kelvin F. K. Low
The Nature Of Torrens Indefeasibility: Understanding The Limits Of Personal Equities, Kelvin F. K. Low
Research Collection Yong Pung How School Of Law
Torrens registration has revolutionised land law, in particular the law of conveyancing. However, the precise scope of Torrens indefeasibility — which lies at the heart of the system — remains poorly understood, especially in respect of its relationship to the so-called ‘personal equities’ exception. The key to disentangling this web of confusion lies in accepting that personal equities, properly understood, do not actually form an exception to indefeasibility at all. The two concepts operate on completely different planes. In practical terms, this means that three crucial points must be understood. First, the Torrens system is intended to prevent adverse claims …

Mediating Commitments, Ian Macduff
Mediating Commitments, Ian Macduff
Research Collection Yong Pung How School Of Law
This paper explores the implications of one aspect of intercultural theory –the dimension of power distance– in order to comment on the nature of commitments in the mediation process. The familiar model of Western ediation assumes that parties can identify core interests and negotiate around those, through prioritising, trading and balancing. At the heart of our thinking about commitments are our ideas about agency, autonomy, and accountability. However, a core implication of empirical work on power distance suggests that expectations of deference may lead some participants to avoid direct decision-making responsibility and, rather than work towards commitments, to act on …

Two mechanical lysis devices have been developed as compact, robust components to provide rapid sample preparation for nucleic acid diagnostic systems. One such component, known as the Micro Bead-Beater™ (μBB™, BBTM, Claremont BioSolutions, Upland, CA), is a compact device that is capable of ultrarapid lysis (>90% lysis in 30 s) of micro volumes (< 80 μL) of Bacillus spores in a continuous-flow format or in a disposable single-tube format. The μBB is also capable of processing much larger volumes of solutions containing spores or vegetative cells using a continuous-flow mode. A second mechanical lysis device designed as a disposable component is the microfluidic bead blender, which uses a small electric motor to spin vanes within the bead-laden solution. DNA quantification results using dsDNA-binding fluorescence dyes and real-time PCR are presented, comparing the lysis of Bacillus subtilis spores using the μBB™ with other well-known lysis techniques. Nanoscale imaging results obtained using scanning electron microscopy and transmission electron microscopy on B. subtilis spores lyzed using the μBB™ are also presented. © 2009, Society for Laboratory Automation and Screening. Mechanistic-Empirical Modeling In Network-Level Pavement Management, Scott Schram, Magdy Abdelrahman
Mechanistic-Empirical Modeling In Network-Level Pavement Management, Scott Schram, Magdy Abdelrahman
Civil, Architectural and Environmental Engineering Faculty Research & Creative Works
Researchers and practitioners have long recognized the advantages of mechanistic modeling. As agencies implement the Guide for Mechanistic-Empirical Design of New and Rehabilitated Pavement Structures [referred to as the Mechanistic-Empirical Pavement Design Guide (MEPDG)] in the local project-level pavement management system (PMS), its potential as a planning tool in network-level analyses remains unrecognized. A unique, large-scale application of MEPDG is presented. The Nebraska Department of Roads uses a decision tree that systematically screens and identifies candidates for entry into a multiyear optimization program. The process uses linear deterioration rates that have been shown to provide an R2 value as …

Ontology-Based Business Process Customization For Composite Web Services, Qianhui (Althea) Liang, Xindong Wu, E. K. Park, T. Khoshgoftaar, C. Chi
Research Collection School Of Computing and Information Systems
A key goal of the Semantic Web is to shift social interaction patterns from a producer-centric paradigm to a consumer-centric one. Treating customers as the most valuable assets and making the business models work better for them are at the core of building successful consumer-centric business models. It follows that customizing business processes constitutes a major concern in the realm of a knowledge-pull-based human semantic Web. This paper conceptualizes the customization of service-based business processes leveraging the existing knowledge of Web services and business processes. We represent this conceptualization as a new Extensible Markup Language (XML) markup language Web Ontology …

This paper considers rate adaptation for streaming multimedia data in a wireless sensor network (WSN) consisting of multiple missions, where each mission subscribes to data streams from multiple sensors, and each sensor's data is utilized by multiple heterogenous missions. We specifically consider the application of the distributed network utility maximization (NUM) framework to a previously unconsidered scenario where the different missions have different priorities, as well as minimum utility demands. When all the utility demands are feasible, we first show that the addition of a penalty for failing to reach the minimum utility demand to the base NUM protocol leads …
Localized Monitoring Of Knn Queries In Wireless Sensor Networks, Yuxia Yao, Xueyan Tang, Ee Peng Lim
Localized Monitoring Of Knn Queries In Wireless Sensor Networks, Yuxia Yao, Xueyan Tang, Ee Peng Lim
Research Collection School Of Computing and Information Systems
Wireless sensor networks have been widely used in civilian and military applications. Primarily designed for monitoring purposes, many sensor applications require continuous collection and processing of sensed data. Due to the limited power supply for sensor nodes, energy efficiency is a major performance concern in query processing. In this paper, we focus on continuous kNN query processing in object tracking sensor networks. We propose a localized scheme to monitor nearest neighbors to a query point. The key idea is to establish a monitoring area for each query so that only the updates relevant to the query are collected. The monitoring …

Partially Materialized Digest Scheme: An Efficient Verification Method For Outsourced Databases, Kyriakos Mouratidis, Dimitris Sacharidis, Hwee Hwa Pang
Research Collection School Of Computing and Information Systems
In the outsourced database model, a data owner publishes her database through a third-party server; i.e., the server hosts the data and answers user queries on behalf of the owner. Since the server may not be trusted, or may be compromised, users need a means to verify that answers received are both authentic and complete, i.e., that the returned data have not been tampered with, and that no qualifying results have been omitted. We propose a result verification approach for one-dimensional queries, called Partially Materialized Digest scheme (PMD), that applies to both static and dynamic databases. PMD uses separate indexes …

Multiuser Private Queries Over Encrypted Databases, Yanjiang Yang, Feng Bao, Xuhua Ding, Robert H. Deng
Research Collection School Of Computing and Information Systems
Searchable encryption schemes allow users to perform keyword-based searches on an encrypted database. Almost all existing such schemes only consider the scenario where a single user acts as both the data owner and the querier. However, most databases in practice do not just serve one user; instead, they support search and write operations by multiple users. In this paper, we systematically study searchable encryption in a practical multiuser setting. Our results include a set of security notions for multiuser searchable encryption as well as a construction which is provably secure under the newly introduced security notions. We also discuss how …

The Price Of Stability In Selfish Scheduling Games, Lucas Agussurja, Hoong Chuin Lau
Research Collection School Of Computing and Information Systems
Game theory has gained popularity as an approach to analysing and understanding distributed systems with self-interested agents. Central to game theory is the concept of Nash equilibrium as a stable state (solution) of the system, which comes with a price − the loss in efficiency. The quantification of the efficiency loss is one of the main research concerns. In this paper, we study the quality and computational characteristics of the best Nash equilibrium in two selfish scheduling models: the congestion model and the sequencing model. In particular, we present the following results: (1) In the congestion model: first, the best …
