The Right Remedy For The Wrongly Convicted: Judicial Sanctions For Destruction Of Dna Evidence, Cynthia E. Jones

Many state innocence protection statutes give courts the power to impose appropriate sanctions when biological evidence needed for postconviction DNA testing is wrongly destroyed by the government. Constitutional claims based on wrongful evidence destruction are governed by the virtually insurmountable "bad faith" standard articulated in Arizona v. Youngblood. The wrongful destruction of DNA evidence in contravention of state innocence protection laws, however, should be governed by the standards used to adjudicate other "access to evidence" violations in criminal cases, including disclosures mandated by the rules of criminal procedure, the Jencks Act, and Brady v. Recent advances in the development of miniature vapor compression cycle components have created unique opportunities for heating and cooling applications, specifically to human physiological requirements that arise in extreme environments. Diving in very cold water between 1.7 and 5°C requires active heating because passive thermal insulation has proven inadequate for long durations. To maintain diver mobility and cognitive performance, it is desirable to provide 250 to 300 W of heat from an untethered power source. The use of a miniature vapor compression cycle reduces the amount of power (batteries or fuel cell) that the diver must carry by 2.5 times …

Effects of cadmium (Cd), a heavy metal contaminant, on hemoglobin were investigated in aquatic midge fly larvae of the Family, Chironomidae. In this study, chironomid populations from one polluted site, Kearny Marsh, New Jersey, two reference sites, North East Creek, and Bass Harbor, ME, and a laboratory population were taxonomically identified and tested for their sensitivity to Cd. Heavy metals in tissue, water and sediment were analyzed using Atomic Absorption Spectroscopy. Water quality at each site was assessed by measuring pH, dissolved oxygen (DO), oxidation-reduction potential ( eH), salinity and temperature. The tadpole of Hypsiboas atlanticus (Caramaschi & Velosa, 1996) is described from the municipality of Maceió, State of Alagoas, Brazil. At stage 36 the larvae have an overall elliptical body in lateral and dorsal views, oral disc anteroventral, spiracular tube sinistral, and labial tooth row formula 2(1,2)/3(1). The oral disc is surrounded, almost completely (anterior medial gap present) by a single row of marginal papillae. Described tadpoles of the H. punctatus species group can be differentiated by a combined disc oral features. Additional descriptions of H. punctatus (Schneider, 1799) tadpoles from populations throughout South America may be helpful in determining …

In the funded proposal to NSF, RdS and WRH included a project to create an electronic database for all publications containing mention of species names for Adenomera, Leptodactylus, and Vanzolinius (Vanzolinius has since been synonymized with Leptodactylus). At the beginning of the project, there were about 2,000 references on 3x5 cards. Miriam H. Heyer (MHH) was contracted to create the EndNote® file. MHH entered all citations into EndNote® and examined the literature citations in those publications to determine whether any of them contained information on the genera of interest. Author's abstract: Seeds of Passage is an exhibition of sculptural ensembles I have created with found-objects, musing the Nobel Prize winning play, Death and the Horsemen, by Wole Soyinka. The play is based on the incident that took place in 1946 in the western region of Nigeria, when the cosmological traditions of a colonizing power clashed with those of the indigenous culture. I use found (repurposed) objects to create many of my works. Anderson's Feed show their adolescent protagonists' struggles with identity formation, consumerism, and the adult world. In order to address power relationships, the two novels address the rise of a global electronic and print media system that collapses traditional notions of time and space and the excessive consumption associated with the culture such a system creates. Atmospheric CO₂ (C_a) concentration has increased significantly during the last 20 000 years, and is projected to double this century. Despite the importance of belowground processes in the global carbon cycle, community-level and single species root responses to rising C_a are not well understood. We measured net community root biomass over 3 years using ingrowth cores in a natural C₃–C₄ grassland exposed to a gradient of C_a from preglacial to future levels (230–550 µmol mol^-1).

Poultry litter (PL) is a traditionally inexpensive and effective fertilizer to improve soil quality and agricultural productivity. However, over application to soil has raised concern because excess nutrients in runoff could accelerate the eutrophication of fresh water. In this work, we determined the contents of total phosphorus (P), Mehlich 3 extracted P, total nitrogen (N), ammonium (NH4)-N, and nitrate (NO₃)-N, in pasture soils receiving annual poultry litter applications of 0, 2.27, 2.27, 3.63, and 1.36 Mg/ha/ yr, respectively, for 0, 5, 10, 15, and 20 years. Attention-deficit/hyperactivity disorder (ADHD) is typically characterized by impulsivity, inattention, and hyperactivity and often lasts into adulthood. Depression, anxiety, and bipolar disorder are often diagnosed as comorbid disorders with ADHD. Adults with ADHD may also display executive functioning deficits. The current study sought to identify whether symptoms of executive functioning were related to symptoms of ADHD in adults. It also identified comorbid disorders in the participants. Questionnaires assessing executive functioning, ADHD, depression, anxiety, and bipolar spectrum disorders were given to participants. Marginal croplands, such as those in the Conservation Reserve Program (CRP), have been suggested as a source of biomass for biofuel production. However, little is known about the composition of plant species on these conservation grasslands or their potential for ethanol production. Suicide gene therapy has been used for the treatment of a variety of cancers. We reported previously the in vitro efficacy of the Herpes Simplex Virus Thymidine kinase (HSV-tk)/ganciclovir (GCV) system to mediate cytotoxicity in oral squamous cancer cells, using transferrin (Tf)-lipoplexes, prepared from cationic liposomes composed of 1,2-dioleoyl-3-(trimethylammonium) propane (DOTAP) and cholesterol. Survivin, a member of the inhibitor of apoptosis (IAP) protein family, is associated with malignant transformation and is over-expressed in most human tumors. Using lipoplex-mediated transfection, we evaluated the activity of the reporter enzyme, luciferase, expressed from plasmids encoding the enzyme under the control of either the cytomegalovirus (CMV) or survivin promoters, in tumor- and non-tumor-derived human and murine cells. We also examined whether there is a correlation between the survivin promoter-driven expression of luciferase and the level of endogenous survivin. We describe the immature stages and oviposition behavior of Veladyris pardalis (Salvin, 1869) from northeastern Ecuador. An unidentified species of Solanum (Solanaceae) is the larval food plant. Eggs are laid singly on leaves, stems or epiphytes growing on the host. Veladyris pardalis has four larval stadia, and takes 64–70 days to mature from oviposition to adult.

Acupuncture is one of the most widely used and broadly researched of the complementary and alternative therapies, but high quality trials generally show no benefit over sham acupuncture. Many would view this result as evidence of ineffectiveness for this intervention.

This discussion paper focuses on the report of one large multi-centre randomised controlled trial of acupuncture for chronic low back pain in the lay and academic press, the ensuing discussion, and its impact on both clinical practice and service provision.

Laccase from white rot fungus Trametes versicolor was immobilized in sodium alginate beads using entrapment method. Kinetic parameters (Vmax and Km) of both free and immobilized laccase were determined using syringaldazine as substrate. 2- chlorophenol was degraded using free and immobilized laccase. An indirect rapid assay method was developed for the assay of degraded products of 2-chlorophenol, wherein the anionic phenoxy radicals, possibly generated during 2-chlorophenol degradation, couples with a cationic dye, Methylene Blue and renders it colorless. The extent of decolorization indicated the extent of product formation and hence the extent of 2-chlorophenol degradation assuming a 1:1 stoichiometric reaction …

There are many types edible oils with various brand found in the market. The types of oils involved in the analysis for the antioxidants content were palm oil, olive oil, canola oil, sunflower oil, soy bean oil, corn oil, gingerly oil, rice bran oil, mixed oil and ayurvedic oil. The method used to evaluate the amount antioxidants in this study was 2, 2-diphenyl-1-picrylhydrazyl (DPPH). In this test, the scavenging of the DPPH radicals was followed by monitoring the decrease in absorbance at 515 nm.
