Conserving Marine Wildlife Through World Trade Law, Eric A. Bilsky

Michigan Journal of International Law

Part I of this Essay marshals the evidence that fisheries around the world are in peril from destructive fishing practices. Part II argues that most fisheries management regimes are ineffective at counteracting the political pressures and economic incentives that lead to unsustainable fishing. Part III makes the case that government subsidies are major enablers of overfishing. The fourth and final Part discusses the continuing efforts to use international trade regulation to eliminate overfishing subsidies and halt the collapse of the world's marine fish populations.

Assemblage-Oriented Ocean Resource Management: How The Marine Environment Washes Over Traditional Territorial Lines, John A. Duff

Michigan Journal of International Law

This Essay assesses challenges that arise when marine territorial boundaries do not encompass the appropriate assemblage of resources and relationships necessary for effective authority and management. It reviews the manner in which certain offshore resource uses have been "quasi-territorialized" by the application of other forms of jurisdiction. It also highlights regime-jurisdiction-private interest-oriented responses to territory-oriented challenges in the form of assemblages of authority, interests, space, and time. Given the scalar progression of the links in the discussion, the assessment moves from international principles to exercises of national sovereignty to domestic administration of space and resources to private legal interests.

The argument in this Article proceeds through several steps. As background, Part I outlines the current and projected future human uses of outer space, emphasizing the plethora of civilian and military applications that now rely on satellites. The United States, especially, but other countries, too, are coming to depend on multiple space assets for the performance of a wide array of vital functions; the investment is huge, diverse, and growing, despite the costs and natural perils of operating in the harsh exoatmospheric environment.

During the immune response, T lymphocytes activated by a particular antigen undergo a very important expansion phase. These lymphocytes must be rapidly depleted at the end of the response in order to maintain the critical homeostasis governing the immune system (Hildeman et al., 2002). This negative regulation is effected, partly, by the apoptotic receptor Fas and of its ligand, FasL, expressed at the surface of activated T lymphocytes. In MRL lpr/lpr mice, as in patients affected by the autoimmune lymphoproliferative syndrome (ALPS), the mutation of the fas gene is responsible for the development of systematic autoimmune pathologies such as systemic …

The Fifth Circuit Court of Appeals decided a considerable number of insurance-related controversies between June 2007 and May 2008. Arguably, the most important, comprehensive decisions are discussed-nineteen insurance cases that originate in just five federal district courts. Generally, the Fifth Circuit decided familiar questions of law and fact. More specifically, the following types of procedural and substantive conflicts appear in the nineteen insurance decisions: (1) one case involving the constitutionality of a Texas insurance statute; (2) two federal preemption and removal controversies involving the Employee Retirement Income Security Act (“ERISA”); (3) two disagreements requiring the court of appeals to make …

While semaphorins and their receptors appear to play a role in tumor carcinogenesis, little is known about the role of semaphorin 3F (S3F) in epithelial ovarian cancer (EOC) development. Therefore, we sought to determine the clinical relationship between S3F and its receptors, neuropilin-2 (NP-2) and neuropilin-1 (NP-1) with EOC progression. We analyzed the immunohistological expression of S3F, NP-2, and NP-1 in clinical specimens of normal ovaries (N), benign cystadenomas (Cy), well-differentiated adenocarcinomas (WD), poorly-differentiated adenocarcinomas (PD), inclusion cysts (IC), paraovarian cysts (PC), and fallopian tubes (FT). Effects Of Social Interactions On Empirical Responses To Selection For Average Daily Gain Of Boars, C. Y. Chen, Rodger K. Johnson, S. Newman, Stephen D. Kachman, L. Dale Van Vleck

Effects of social interactions on responses to selection for ADG were examined with records of 9,720 boars from dam lines (1 and 2) and sire lines (3 and 4) provided by Pig Improvement Company. Each line was analyzed separately. Pens contained 15 boars. Gains (ADG) were measured from about 71 to 161 d of age and weight from 31 to 120 kg. Models included fixed effects of contemporary groups and initial test age as a covariate, and random direct genetic (d), social genetic (c), social environmental (ce), and litter (lt) effects. The objectives of this study were to evaluate the dynamics of gas production of several corn (co)products, to develop equations to predict the rate of ruminal fiber digestion, to estimate total digestible nutrients (TDN) and net energy for lactation (NEL), and to assess the stochasticity of chemical composition and nutritive value variability. Four corn milling (co)products were evaluated in this study: high protein dried distillers grains (HP-DDG), corn bran (BRAN) and dehydrated germ (GERM), and a dried distillers grains plus soluble produced with a low-heat drying process (BPX). A feedlot (Exp. 1) experiment was conducted to evaluate the effects of an essential oil mixture (EOM), experimental essential oil mixture (EXP), tylosin, and monensin (MON) on performance, carcass characteristics, and liver abscesses. A metabolism experiment (Exp. 2) was conducted to evaluate the effects of EOM, EXP, and MON on ruminal fermentation and digestibility in finishing steers. In Exp. 1, 468 yearling steers (398 ± 34 kg initial BW) were used in 50 pens (10 pens/treatment) and received their respective dietary treatments for 115 d. The gastrointestinal tract (GIT) constitutes one of the largest immunological organs of the body. The GIT must permit absorption of nutrients while also maintaining the ability to respond appropriately to a diverse milieu of dietary and microbial antigenic components. Because of the diverse population of antigenic components within the GIT, a sophisticated mucosal immune system has evolved that relies on collaboration between the innate and adaptive arms of immunity. The collaborative, mucosal immune effort offers protection from harmful pathogens while also being tolerant of dietary antigens and normal microbial flora. A 2-yr study was conducted using 200 long yearling steers/yr (436 ± 30 kg) to determine the effect on performance and economics of sorting by BW at feedlot entry and feeding 200 mg/steer of Optaflexx (OPT) daily for the last 28 d. At feedlot entry, steers were allotted into 1 of 4 treatments in a 2 × 2 factorial arrangement: sorted or unsorted with or without OPT. Estimates of genetic parameters were obtained from two samples of weights and heights of mature cows provided by the American Angus Association. The first sample consisted of 23,658 records for mature weight (MWT) and 13,012 for mature height (MHT) and the second sample consisted of 23,698 records for MWT and 13,310 for MHT. The four-generation pedigree file included 43,105 animals for the first sample and 44,141 animals for the second sample. Range in ages when cows were weighed was 2 to 11 years at the time of measurement. Variance components were estimated using the MTDFREML programs. Univariate and bivariate analyses …

Thirty-Seven Additional Microsatellite Loci In The Pacific Lion-Paw Scallop (Nodipecten Subnodosus) And Cross-Amplification In Other Pectinids, Jessica Lynn Petersen, Ana M. Ibarra, Bernie May

We characterized 37 new microsatellite markers in the Pacific lion-paw scallop (Nodipecten subnodosus) and tested for cross-amplification in four other species. Genetic diversity was estimated using 24 individuals from the Lagoon Ojo de Liebre, B.C.S., Mexico. Allelic richness varied from 5 to 27 alleles per locus and the average expected heterozygosity was 0.76. Ten loci exhibited significant departure from Hardy–Weinberg equilibrium likely due to the presence of null alleles. Sixteen of these markers cross-amplified in closely related N. nodosus, while little or no amplification was observed in three Argopecten species.

A sensor array consisting of two laser sensors was utilized to determine the guidance directrix (offset distance-d, heading angle-ø) that are required as reference inputs for an automated guidance system. The sensor array was evaluated in both laboratory and field conditions. Under laboratory conditions the sensor array replicated the physical profile of the target surface with a 4% error in determining the heading angle. Field tests were conducted in two types of crops; corn and alfalfa. The sensor array identified the cut-crop edge profile ahead of the tractor and replicated distinct shapes of the cut-crop edge.
