The Use Of Force Against States That Might Have Weapons Of Mass Destruction, Matthew C. Waxman

Michigan Journal of International Law

This Article argues that the most difficult future crises for which this legal debate is most consequential will not resemble those described by Prime Minister Thatcher or Director ElBaradei. Rather, in confronting potentially hostile and aggressive states believed to pose a WMD threat, decisionmakers contemplating the use of force will face an intelligence picture that is open to reasonable debate (contra Thatcher) and irresolvable to high levels of certainty (contra ElBaradei). This paper examines how competing legal approaches deal with this epistemic problem.

Battered Women, Children And The End Of Abusive Relationships, Angela M. Moe

Much work has focused on the interpersonal dynamics of violent relationships, but less is known about the specific turning points that prompt women at least to try to end them. Using a feminist standpoint method and phenomenological-based analysis of in-depth interviews with mothers in a domestic violence shelter, this article focuses on the role of children in women’s decisions to leave abusive partners. It discusses arriving at the decision, the logistics involved in leaving and planning for the future, and it presents policy and advocacy-based recommendations that are aimed at addressing the social welfare of women and children.

Although there is no lack of efforts to read Foucault and Nietzsche together or indeed to align Foucault and Heidegger, Foucault scholarship overall tends to be split on these same terms. The author argues that the opposition is misleading for the complicated reason that Foucault’s Heidegger can only be understood on Nietzschean terms while and at the same time, Foucault’s Nietzsche only takes place by way of Heidegger albeit (and this point simply cannot be overemphasized) a very Frencophone reading of Heidegger.

Hydrological models are used to represent the rainfall-runoff and pollutant transport mechanisms within watersheds. Accurate representation of these dynamic and complex natural processes within a watershed is an important step in managing and protecting a watershed Artificial neural network (ANN) models are often used in hydrologic modeling. Typical ANN models are trained to use lumped data. However, watershed characteristics used as inputs in hydrological modeling are spatially and often temporally dynamic. Due to the retirement of the former earth science teacher I was given the opportunity to take over the earth science elective classes. Oskaloosa Senior High School is based on a trimester school year. The third trimester earth science course was formerly called Wilderness Adventures. I renamed the course as Field Research Experience. This added greater value due to emphasis on more science skills and possible career application. As an active outdoorsman and former Boy Scout leader I was excited to incorporate the skills needed to enjoy outdoor recreation into those required of persons involved in doing scientific field research.

The Effect Of Uncivil Behavior On Friendships: An Exploration Of Incivility As An Interpersonal Construct, Anna F. Carmon, Becky L. Degreeff, Ann Burnett, Julie L. Semlak, Kelly L. Wolf

Through the lens of politeness theory, this study examined the relationship between perceptions of homophily and individualized trust and uncivil behavior in friendships. Using an experimental survey design, research participants responded to one of four scenarios involving rude cell phone calls. Each represented a different combination of civility and the biological sex of the actor. Uncivil behavior was negatively related to perceptions of homophily and individualized trust. The biological sex of the actor did not significantly relate to perceptions of homophily or individualized trust.

Overcrowded prisons are a growing problem in the United States. Currently, California prisons are over capacity 85%. Substance abuse increases the likelihood of criminality, for half of state prisoners admitted to being under the influence of drugs or alcohol at the time of their offense(s). A large portion of these individuals, once incarcerated, is also diagnosed with a mental illness. By researching dually diagnosed inmates who were participating in a 90-day in-custody treatment program, this study focuses on how negative family and school experiences become major contributors to adult mental and substance abuse disorders and criminality.

This paper explores the concept and practice of interaction within a blended problem-based and eLearning module for academic professional development in higher education. A qualitative study spanning two years of the lived experiences of 17 academic staff in a module entitled ‘Designing eLearning’ was considered likely to provide a much-needed analysis of current thinking and practice on the potential of interaction. Relevant constructivist theories are applied to face-to-face problem-based learning (PBL) tutorials, online discussions, focus group interviews and reflective papers. Chicago in the 1890s was home to two remarkable institutions, started by two remarkable activist-philosophers, experimenting with ideas and with social change. The first was Hull House, a social settlement, founded by Jane Addams and Ellen Gates Starr in 1889. The second was the Laboratory School, an experimental school opened in 1896 by John Dewey, along with teachers Katherine Camp Mayhew and Anna Camp Edwards. Interaction was constant between the residents of Hull House and the teachers of the Laboratory School, as the participants learned from and taught each other. Despite their ecological significance, parasitic plants face more conservation challenges than do autotrophic plants. This is especially true for the groups that include weedy or invasive species such as Cuscuta. While approximately half of the Cuscuta (dodders) species may require conservation measures, the genus as a whole is sometimes posted on governmental lists of noxious or quarantine weeds. Our study challenges this stereotype and uses the case of C. jepsonii (Jepson’s dodder) to illustrate the precarious biodiversity and conservation status faced by many dodder species. Exposure to pesticides poses great risk to agricultural workers and their families. Of the approximately 174,000 agricultural workers in Oregon, studies estimate that up to 40% of the workers in Oregon are indigenous and may be particularly vulnerable to the health risks of working in pesticide treated areas. Surveys conducted with Oregon farmworkers suggest that Latino and indigenous farmworkers differ demographically and may have diverse occupational and health needs. All Latino workers reported Spanish as their native language, while indigenous workers spoke several different native languages. Latino workers were employed mostly in orchards (28%) and nurseries (24%), while indigenous workers …

Geometry Dependent Current-Voltage Characteristics Of Zno Nanostructures: A Combined Nonequilibrium Green’S Function And Density Functional Theory Study, Zhiwen Yang, Bin Wen, Roderick V.N. Melnik, Tingju Li

Current-voltage I-V characteristics of different ZnO nanostructures were studied using a combined nonequilibrium Green’s function and density functional theory techniques with the two-probe model. It was found that I-V characteristics of ZnO nanostructures depend strongly on their geometry. For wurtzite ZnO nanowires, currents decrease with increasing lengths under the same applied voltage conditions. The I-V characteristics are similar for single-walled ZnO nanotubes and triangular cross section ZnO nanowires but they are different from I-V characteristics of hexagonal cross section ZnO nanowires. Finally, our results are discussed in the context of calculated transmission spectra and densities of states.

It is unknown if the novel weapons or evolution of increased competitive ability hypotheses explain the invasiveness of L. maackii in eastern United States woodlands. I tested if L. maackii's allelopathic properties have a significant impact on the fitness of native Pilea pumila in addition to below ground competition as well as if L. maackii populations vary in allelopathic and/ or competitive ability within the invasive range and between native and invasive ranges. Addition of activate carbon to potting soil increased the ability of L. maackii to inhibit the fitness of P. pumila in addition to competition. L. maackii …

The notion of “Learning styles” seems to be very popular these days in education. The idea that we all learn differently is intuitively appealing with the varied personalities, successes, and struggles of our students. However, the notion that each person learns differently is likely a myth (Olson, 2006; Feldon, 2005; Willingham, 2005). Is Personality Related To The Music I Like? A Study Of Music Preferences And Sensation Seeking, Anna Coker Rhodes, Randy Carden

Modern Psychological Studies

Past research supports the idea that music preferences are significantly predicted by sensation seeking. The current study explored whether disinhibition, thrill and adventure seeking, and openness to experience predict preference for music genre? The data were analyzed using a multivariate linear regression approach. Participants were 103 (27 men, 76 women) undergraduate students at a small, private university in the southeast. The participants listened to fourteen genres of music for twenty seconds each and Zuckerman's Sensation Seeking Scale was administered. The results supported previous research in that high sensation seekers preferred rock or heavy metal music and those lower on the …

Public Health Law & (And) Military Medical Assets: Legal Issues In Federalizing National Guard Personnel, James Balcius, Bryan A. Liang

Annals of Health Law and Life Sciences

This article examines the role of the National Guard in enforcing public health mandates in emergency situations. The authors analyze the activation of the National Guard through Title 10 of the U.S. Code, which prohibits the National Guard from engaging in law enforcement activities under the Posse Comitatus Act (PCA). The authors then discuss the potential role of the National Guard in emergency and disaster response such as quarantine and compulsory vaccination as well as legal liability issues.
