Characteristics Of Contemporary Gag Order Requests In Media Law Reporter Volumes 19 Through 33, Brad Leavitt Clark

Theses and Dissertations

The conflict between the First Amendment and the Sixth Amendment is not new nor is it easily decipherable. Both amendments appear to have absolute priority, yet they appear to conflict (Erickson, 1977). The First Amendment declares unequivocally, "Congress shall make no law...abridging the freedom of speech, or of the press[,]" while the Sixth Amendment states with equal force, "In all criminal prosecutions, the accused shall enjoy the right to a speedy public trial, by an impartial jury of the state and district wherein the crime shall have been committed..." (U.S. Constitution, Amendment I, Amendment VI). Free speech and an unrestricted …

Securing An Effective Voice For Citizens In Intergovernmental Administrative Decision Making, Maria J. D'Agostino Jul 2009

Securing An Effective Voice For Citizens In Intergovernmental Administrative Decision Making, Maria J. D'Agostino

Publications and Research

Intergovernmental administrative arrangements, often obscured from public view, are responsible for public decisions and their consequences. After European Union citizens expressed dissatisfaction with the disconnected administrative decision-making process by rejecting the European Constitution, the European Commission called for a period of reflection to develop tools and processes in order to involve citizens in the decision-making process.

This article examines collaborative efforts by the European Union to involve citizens in the shaping of national priorities. In-depth interviews were conducted with the heads of nonprofit organizations and staffers at nonprofits involved with organizing the European Citizens’ Consultations (ECC). All the organizations are …

Receiver Operating Characteristic (Roc) Curve Analysis Of Affinity Profiles, Benjamin C. Caswell Jul 2009

Receiver Operating Characteristic (Roc) Curve Analysis Of Affinity Profiles, Benjamin C. Caswell

Theses and Dissertations

This thesis tests the relative efficiency of Fischer's approach of Chi-square on Affinity viewing time profiles to the more commonly used deviance differential approach. Through his use of a Chi-square approach, Fischer has attempted to make a norm-referenced, comparison of ipsative scores generated using Affinity. His goal has been to create an ethically acceptable approach to identifying sexual interest without losing the efficiency generated through the use of the commonly used deviance differential. A Receiver Operating Characteristic (ROC) curve is used to generate the efficiency of each approach and provide results for comparison. These results lead to a discussion of …

Of Atkins And Men: Deviations From Clinical Definitions Of Mental Retardation In Death Penalty Cases, John H. Blume, Sheri Johnson, Christopher W. Seeds Jul 2009

Of Atkins And Men: Deviations From Clinical Definitions Of Mental Retardation In Death Penalty Cases, John H. Blume, Sheri Johnson, Christopher W. Seeds

Cornell Law Faculty Publications

Under Atkins v. Virginia, the Eighth Amendment exempts from execution individuals who meet the clinical definitions of mental retardation set forth by the American Association on Intellectual and Developmental Disabilities and the American Psychiatric Association. Both define mental retardation as significantly subaverage intellectual functioning accompanied by significant limitations in adaptive functioning, originating before the age of 18. Since Atkins, most jurisdictions have adopted definitions of mental retardation that conform to those definitions. But some states, looking often to stereotypes of persons with mental retardation, apply exclusion criteria that deviate from and are more restrictive than the accepted scientific and clinical …

Financial Market Failure As A Crisis In The Rule Of Law: From Market Fundamentalism To A New Keynesian Regulatory Model, Timothy A. Canova Jul 2009

Financial Market Failure As A Crisis In The Rule Of Law: From Market Fundamentalism To A New Keynesian Regulatory Model, Timothy A. Canova

Faculty Scholarship

This article considers the financial panic of 2008 in historical context by analyzing the institutional and regulatory factors that contributed to the financial and economic crisis. The move away from a Keynesian regulatory model was a function of larger institutional flaws. The Keynesian regime of command-and-control regulation focused on macroeconomic policy objectives designed to achieve full employment, more equitable distributions of wealth and income, greater transparency in the regulatory process, and reduction in monopoly exploitation of consumers. Central to this regime was a model of central banking that required greater accountability to elected branches of government and the use of …

Bullies, Gangs, And Books For Young Adults, Stan Steiner, Ben Steiner Jul 2009

Bullies, Gangs, And Books For Young Adults, Stan Steiner, Ben Steiner

Literacy, Language and Culture Faculty Publications and Presentations

This action research project describes the impact a love for reading and access to books had on incarcerated youth and the adults directly working with them. Through adults working inside a juvenile detention center a library was established, young adult books were made available, and literature discussion groups were conducted. The positive results dispels the myth of high illiteracy rates associated with people serving time for criminal offenses. The act of establishing a library in one detention center evolved into academic course work that brought educators, social workers and criminal justice students and professionals together for the first time. This …

Literacy-Rich Emotional Intelligence Curriculum Guide, Carol Louise Fitzgerald Jul 2009

Literacy-Rich Emotional Intelligence Curriculum Guide, Carol Louise Fitzgerald

Literacy, Language, and Culture Graduate Projects and Theses

This research originated from my experience teaching in a school designed as an alternative to expulsion for a large public school district. The premise was that students could return to their traditional school setting after the appropriate “time-out” had been completed. My research and experience speaks to the fact that the threat of expulsion and required compliance of strict behavior codes rarely changed student behavior and did not make at-risk adolescents better students. I found that students who met the criteria for an expulsion referral came from all walks of life, had a variety of learning styles, and covered the …

Probation In Maine: Setting The Baseline, Mark Rubin, Jennifer Dodge

Justice Policy

In 2005, the Maine Department of Corrections (MDOC), with support from the National Institute of Corrections, began implementing a series of evidence‐based principles in community corrections with the goal of improving the effectiveness of offender management in the community. This study was conducted to determine the types, extent, and frequencies of adult probation recidivism in Maine before and during the implementation period. The study finds that recidivism rates of offenders who entered probation in 2004, 2005, or 2006 did not change significantly across annual cohorts, but lower risk offenders appeared to have improved outcomes in 2006. Higher risk probationers performed …
