Of Atkins And Men: Deviations From Clinical Definitions Of Mental Retardation In Death Penalty Cases, John H. Blume, Sheri Lynn Johnson, Christopher Seeds
Cornell Journal of Law and Public Policy
Under Atkins v. Virginia, the Eighth Amendment exempts from execution individuals who meet the clinical definitions of mental retardation set forth by the American Association on Intellectual and Developmental Disabilities and the American Psychiatric Association. Both define mental retardation as significantly subaverage intellectual functioning accompanied by significant limitations in adaptive functioning, originating before the age of 18. Since Atkins, most jurisdictions have adopted definitions of mental retardation that conform to those definitions. But some states, looking often to stereotypes of persons with mental retardation, apply exclusion criteria that deviate from and are more restrictive than the accepted scientific and clinical …
Prevalence Of Rural Intimate Partner Violence In 16 Us States, 2005, Matthew J. Breiding, Jessica S. Ziembroski, Michele C. Black
Prevalence Of Rural Intimate Partner Violence In 16 Us States, 2005, Matthew J. Breiding, Jessica S. Ziembroski, Michele C. Black
United States Public Health Resources
Context: Intimate partner violence (IPV) is a public health problem that affects people across the entire social spectrum. However, no previous population-based public health studies have examined the prevalence of IPV in rural areas of the United States. Research on IPV in rural areas is especially important given that there are relatively fewer resources available in rural areas for the prevention of IPV.
Methods: In 2005, over 25,000 rural residents in 16 states completed the first-ever IPV module within the Behavioral Risk Factor Surveillance System (BRFSS). The BRFSS is a Centers for Disease Control and Prevention-sponsored annual random-digit-dialed …

The Organization And Administration Of A Deficit Curriculum: The Dominant Operating Core Curriculum Of A Hispanic Serving Educational System, James Satterfield, Lesli Gonzales, Stephanie Zelanek
Academic Leadership: The Online Journal (2003-2012)
The demographic face of the United States is quickly changing as the Hispanic population approaches majority minority status. The changing demography brings with it many implications as far as the general condition and functionality of society is concerned. Especially important are educational practices and the construction of public education policies as the public schools are traditionally relied upon as an institution of socialization, as a common denominator to Americanize the young, the poor, the marginal, and the immigrant populations (Tyack and Cuban, 1995). These categorical descriptions, one could say, largely characterize the Hispanic population, which in fact represents the youngest …

Long-Term Effects Of Parents' Education On Children's Educational And Occupational Success Mediation By Family Interactions, Child Aggression, And Teenage Aspirations, Eric F. Dubow, Paul Boxer, L. Rowell Husemann
Psychology Faculty Publications
We examine the prediction of individuals' educational and occupational success at age 48 from contextual and personal variables assessed during their middle childhood and late adolescence. We focus particularly on the predictive role of the parents' educational level during middle childhood, controlling for other indices of socioeconomic status and children's IQ, and the mediating roles of negative family interactions, childhood behavior, and late adolescent aspirations. Data come from the Columbia County Longitudinal Study, which began in 1960 when all 856 third graders in a semirural county in New York State were interviewed along with their parents; participants were reinterviewed at …

The Future For Collected Prosecutorial Evidence At The International Criminal Tribunal For Rwanda, Gerda Visser
The Future For Collected Prosecutorial Evidence At The International Criminal Tribunal For Rwanda, Gerda Visser
Cardozo Public Law, Policy & Ethics Journal
The article focuses on the International Criminal Tribunal for Rwanda (ICTR) and its Office of the Prosecutor (OTP), emphasizing the need to balance the preservation of sensitive information with the public's right to access historical records. It highlights the ICTR's role in developing international criminal law standards and the challenges of managing its vast archive, particularly regarding witness protection, privacy, and future prosecutions. The article proposes establishing an international judicial archive with a legal reviewing body to oversee access to the OTP database, ensuring transparency while safeguarding sensitive data.
The Modernizing Mission Of Judicial Review, David A. Strauss
The Modernizing Mission Of Judicial Review, David A. Strauss
Public Law and Legal Theory Working Papers
Constitutional interpretation, as it is usually conceived, looks to the past—to an old text, to history, to precedent, to tradition—in an effort to limit political majorities. But over the last generation or so, a different approach to the Constitution has emerged. That approach, which might be called modernization, tries to anticipate trends in public opinion instead of taking lessons from the past; and a modernizing court, instead of facing down popular majorities, yields when it finds out that it has misgauged public opinion. This modernizing approach has characterized the Supreme Court’s recent work in many disparate areas, including, among others, …

Civil Rights In International Law: Compliance With Aspects Of The "International Bill Of Rights", Beth Simmons
Civil Rights In International Law: Compliance With Aspects Of The "International Bill Of Rights", Beth Simmons
Indiana Journal of Global Legal Studies
International law has developed what many might consider a constitutional understanding of individual civil rights that individuals can claim vis-à-vis their own governments. This article discusses the development of aspects of international law relating to civil rights and argues that if this body of law is meaningful, we should see evidence of links between acceptance of international legal obligation and domestic practices. Recognizing that external forms of enforcement of civil rights is unlikely (because doing so is not generally in the interest of potential "enforcers"), I argue that international civil rights treaties will have their greatest effect where stakeholders-local citizens-have …

Needs Assessment Survey Result For Alaska State Victim Assistance Academy, André B. Rosay, N/A Victims For Justice
Reports
State Victim Assistance Academies (SVAA’s) offer coursework and training in victimology, victims’ rights, and victim services in order to meet the needs of victim service providers and allied professionals (Office for Victims of Crime). With state and federal funding, Victims for Justice began the development of a State Victim Assistance Academy for Alaska in 2008. An important first step in the development of a State Victim Assistance Academy is to conduct a needs assessment survey to identify the most important topics to include in coursework and training. This brief report highlights the results of the Alaska needs assessment survey conducted …
