The Law School, The Market, And The New Knowledge Economy, Margaret Thornton Jan 2009

The Law School, The Market, And The New Knowledge Economy, Margaret Thornton

Comparative Research in Law & Political Economy

This paper considers how recent changes in higher education are impacting on the discipline of law, causing the critical scholarly space to contract in favour of that which is market-based and applied. The charging of high fees has transformed the delicate relationship between student and teacher into one of ‘customer’ and ‘service provider’. Changes in pedagogy, modes of delivery and assessment have all contributed to the narrowing of the curriculum in a way that supports the market. The paper will briefly illustrate the way the transformation has occurred and consider its effect on legal education and the legal academy.

Brazilian Legal Education: Curricular Reform That Goes Further Without Going Beyond, Roberto Fragale Filho Jan 2009

Brazilian Legal Education: Curricular Reform That Goes Further Without Going Beyond, Roberto Fragale Filho

Comparative Research in Law & Political Economy

Brazilian legal education is engaged since 1994 in a long and inconclusive process of curriculum reform in which the Brazilian Bar Association (Ordem dos Advogados do Brasil) has been one of its greatest players. The transformations undertaken in legal education in the last two decades, were buoyed by three things: (a) the redemocratization of the country, completed in 1988 with the promulgation of the new Constitution, (b) the expansion of higher education, which resulted in a amount of more than half of a million law students, and (c) the protection of interests of the lawyers’ corporation, even though it has …

'Transnational Law' As Proto‐Concept: Three Conceptions, Craig Scott Jan 2009

'Transnational Law' As Proto‐Concept: Three Conceptions, Craig Scott

Comparative Research in Law & Political Economy

The purpose of this article is to identify three understandings of transnational law, all of which have a certain integrity depending on one’s premises about the nature and institutional operation of law. The approach adopted is not to make an argument for the single best reading of the concept of transnational law but instead to outline three candidate conceptions of that notion. For purposes of the article, these conceptions are not assumed necessarily to be competing conceptions. Rather, their potential compatibility is left open for future consideration. In this sense, 'transnational law' is presented in the article as a kind …

Born To Be Wild: The 'Trans‐Systemic' Programme At Mcgill And The De‐Nationalization Of Legal Education, Helge Dedek, Armand De Mestral Jan 2009

Born To Be Wild: The 'Trans‐Systemic' Programme At Mcgill And The De‐Nationalization Of Legal Education, Helge Dedek, Armand De Mestral

Comparative Research in Law & Political Economy

One of the major challenges legal education faces nowadays is that jurisdictional boundaries are losing significance in an internationalized, globalized and post-regulatory environment. This calls into question the very notion of “law” itself, at least as traditionally understood as a system of posited norms within a given jurisdiction, and the classic model of legal education based on such an understanding of law. While North American legal education has a longstanding tradition of self-reflection, the situation in Europe is different: there is little incentive for legal scholars to devote a considerable amount of time to a serious scholarly treatment of the …

Turning The Curriculum Upside Down: Comparative Law As An Educational Tool For Constructing Pluralistic Legal Mind, Jaakko Husa Jan 2009

Turning The Curriculum Upside Down: Comparative Law As An Educational Tool For Constructing Pluralistic Legal Mind, Jaakko Husa

Comparative Research in Law & Political Economy

The argument in this paper draws inspiration from the pedagogical theory of so-called constructivism. An effective law curriculum is one which can stimulate students to learn legal thinking. The constructivist approach suggests that the learner is more actively involved in a joint enterprise with the law teacher of constructing new legally relevant, and perhaps competing, meanings. Comparative law and/or foreign law and even approximate knowledge of different foreign approaches to similar types of questions may be regarded as a valuable tool for the construction of a primary pluralistic legal mind.

The Association Of Transnational Law Schools’ Agora: An Experiment In Graduate Legal Pedagogy, Phillip G. Bevans, John Mckay Jan 2009

The Association Of Transnational Law Schools’ Agora: An Experiment In Graduate Legal Pedagogy, Phillip G. Bevans, John Mckay

Comparative Research in Law & Political Economy

The Association of Transnational Law Schools [ATLAS] is a consortium of law schools from around the world that launched an annual academic summer program, called the Agora, for doctoral students in July of 2008. The authors outline the history of the creation of the program, describe it, and consider its significance as it relates to the changing landscape of legal practice and pedagogy. The Agora both reflects and furthers a trend in legal scholarship, and as a consequence legal education, toward a focus on a set of interrelated concerns, which include globalization, international governance, transnational law, comparative legal studies, legal …

Proportionality Analysis As An ‘Analytical Matrix’ Adopted By The Supreme Court Of Mexico, Amaya Alvez Marin Jan 2009

Proportionality Analysis As An ‘Analytical Matrix’ Adopted By The Supreme Court Of Mexico, Amaya Alvez Marin

Comparative Research in Law & Political Economy

This paper explores proportionality analysis as a constitutional standard that allows courts to engage in a public conversation, especially with the legislature. This conversation would consider the concept, structure and normative force of fundamental rights, the way in which two or more rights compete and collide, and as to how a particular disagreement about rights can be addressed. What is particularly appealing is the way in which this approach to proportionality analysis does not prescribe any legitimate means ‘per se’. It is relational because it must apply the means to achieve a particular aim in a real situation and decide …

Multi-Institutional Healthcare Ethics Committees: The Procedurally Fair Internal Dispute Resolution Mechanism, Thaddeus Mason Pope Jan 2009

Multi-Institutional Healthcare Ethics Committees: The Procedurally Fair Internal Dispute Resolution Mechanism, Thaddeus Mason Pope

Faculty Scholarship

2.6 million Americans die each year. A majority of these deaths occur in a healthcare institution as the result of a deliberate decision to stop life sustaining medical treatment. Unfortunately, these end-of-life decisions are marked with significant conflict between patients' family members and healthcare providers. Healthcare ethics committees (HECs) have been the dispute resolution forum for many of these conflicts.

HECs generally have been considered to play a mere advisory, facilitative role. But, in fact, HECs often serve a decision making role. Both in law and practice HECs increasingly have been given significant authority and responsibility to make treatment decisions. …

Resisting Curriculum Integration: Do Good Fences Make Good Neighbors?, Ken Badley

Faculty Publications - College of Education

Curriculum integration has a long history. In this paper I catalog several arguments for resistance against integration and present the historical roots of support for those arguments offered by critics of curriculum integration. First, I review some linguistic and usage limitations of the term. Second, I examine several practical and institutional difficulties related to implementing integrated curriculum. Third, I explore some interconnected psychological and sociological dimensions of resistance to curriculum integration. Finally, I consider several epistemological dimensions of resistance to integration, some of which underlie the sociological and psychological aspects. While recognizing that some resistance to integration will never be …

Walkout: The Footsteps Of Latino Youth Activism, Marta Galvan Jan 2009

Walkout: The Footsteps Of Latino Youth Activism, Marta Galvan

Sociology & Anthropology Theses - Archive

This qualitative study analyzes contemporary social action through the lens of Latino youth activism. A total of 11 people including Latino student demonstrators and non-demonstrators and teachers/administrators all shared their experiences and perspectives concerning the 2006 Latino youth immigration reform walkout that took place at a local high school. It was found that Latino youth secretly coordinated a walkout and executed it. Escorted by police they marched in the streets, recruited other students along the way, attended a rally, and were bused back to campus afterward. Demonstrators were both criticized and praised for their actions by peers and teachers/administrators. While …

From In Lincoln’S Shadow: The 1908 Race Riot In Springfield, Illinois, Roberta Senechal Jan 2009

From In Lincoln’S Shadow: The 1908 Race Riot In Springfield, Illinois, Roberta Senechal

Trotter Review

“In Lincoln’s Shadow” refers to a powerful and enduring symbolic
connection between the riot and the city’s most famous former resident:
Abraham Lincoln. After the Civil War, northern whites generally assumed
that violence against African Americans was a southern problem—and part
of the South’s moral inferiority. The Springfield riot shattered this assumption.

Nepali Female Migrants And Informalization Of Domestic Care Work: Service Or Servitude?, Shobha Hamal Gurung Jan 2009

Nepali Female Migrants And Informalization Of Domestic Care Work: Service Or Servitude?, Shobha Hamal Gurung

Institute for Asian American Studies Publications

Nepali female migrants are among the fastest-growing immigrant workforces in the South Asian community, particularly in service and domestic work in big cities of the United States. However, there has not until now been a study investigating the work experiences of Nepali immigrants/migrants employed in the service and domestic sectors in these cities. This article investigates the work experiences of Nepali female migrants who work in service and domestic/child care work in Boston and New York, focusing on examining the type and nature of women's work, labor practices, work and living conditions, women's experiences and views about their work, and …

Forced Marriage: A "New" Crime Against Humanity?, Jennifer Gong-Gershowitz Jan 2009

Forced Marriage: A "New" Crime Against Humanity?, Jennifer Gong-Gershowitz

Northwestern Journal of Human Rights

This paper analyzes the recent decisions of the Special Court for Sierra Leone defining forced marriage as a "new" crime under international humanitarian law. It first describes the Sierra Leonean civil war and the events leading up to the creation of the Special Court. Then it discusses the findings of the Sierra Leone Truth and Reconciliation Commission and the AFRC Trial, comparing them to a few key decisions of the tribunals for the Former Yugoslavia and Rwanda in response to crimes of sexual violence. Next, the paper examines the rationale of the AFRC Trial Chamber, which declined to recognize forced …

Do Bcs National Championships Lead To Recruiting Violations? A Trend Analysis Of Ncaa Division I (Fbs) Infractions, Robert S. Clark, Paul J. Batista Jan 2009

Do Bcs National Championships Lead To Recruiting Violations? A Trend Analysis Of Ncaa Division I (Fbs) Infractions, Robert S. Clark, Paul J. Batista

Journal of Applied Sport Management

With the NCAA suggesting increased severity of sanctions for NCAA rules violators (Wieberg, 2008), an area of great concern to athletic directors is the institution’s violation of Article 13 of NCAA Division I legislation while recruiting prospective student-athletes. While researchers state that NCAA violations are on the rise (Mahony,1999; Jordan, Greenwell, Geist, Pastore, & Mahony, 2004), very little research has been conducted to ascertain the number of NCAA recruiting violations committed, and by whom. The purpose of this study was to describe the nature of recruiting violations, including major and secondary violations, conference affiliation of institutions committing major violations, then …

Social Problems In Major League Baseball: Revisiting And Expanding Talamini’S Analysis Twenty Years Later, Mark Vermillion, G. Clayton Stoldt, Jordan Bass Jan 2009

Social Problems In Major League Baseball: Revisiting And Expanding Talamini’S Analysis Twenty Years Later, Mark Vermillion, G. Clayton Stoldt, Jordan Bass

Journal of Applied Sport Management

The purpose of this research was to review, revisit, and expand Talamini’s social problems within Major League Baseball (MLB). Talamini’s categories, which include gambling, player/managerial violence, spectator violence, cheating, crime, and greed are reviewed and applied to social problems in MLB since the original publication in 1987. In order to better understand social problems and deviant behavior within MLB, the original categories are related to specific deviance theories to better understand causation of deviance. Theories are then organized by Shoemaker’s proposed integrated model, which organizes causes of deviance on the structural, social-psychological, and psychological levels. Relating Talamini’s social problems categories …

Formulating A Conceptual Base For Secondary Level Engineering: A Review And Synthesis, Rodney L. Custer, Jenny L. Daugherty, Joseph P. Meyer Jan 2009

Formulating A Conceptual Base For Secondary Level Engineering: A Review And Synthesis, Rodney L. Custer, Jenny L. Daugherty, Joseph P. Meyer

Reports of Center Studies

In recent years, there has been a growing interest in science, technology, engineering, and mathematics (STEM) education across the K-16 spectrum. While much of this interest has concentrated on science and mathematics, technology and engineering are emerging as authentic educational problem solving contexts, as well as disciplines in their own right at the K-12 level. Over the past 20 years, the technology education field has concentrated on defining and implementing a set of content standards, the Standards for Technological Literacy (ITEA, 2000) (STL), with mixed results. On a national scale, the field continues to evolve from its historical industrial arts …

Water-Conserving Landscapes: An Evaluation Of Homeowner Preference, Tony A. Mccammon, Sandra T. Marquart-Pyatt, Kelly L. Kopp Jan 2009

Water-Conserving Landscapes: An Evaluation Of Homeowner Preference, Tony A. Mccammon, Sandra T. Marquart-Pyatt, Kelly L. Kopp

CWEL Publications

Landscape preferences were assessed for three identically designed Xeriscapes™, differing only in the plant material, under both well-watered and drought conditions. The classes of plant material included traditional (high water use), intermediate (moderate water use), and native/adapted plant species of the Intermountain West (low water use). Landscapes were subjected to a 5-week dry-down period. Under drought conditions, respondents preferred drought/adapted and intermediate landscapes to traditional landscapes. A focus on Xeriscape™ education, practices, and visual exposure may result in greater adoption of Xeriscape™ practices by homeowners and may also result in significant residential water savings.

Hydrologic Interdependencies And Human Cooperation: The Process Of Adapting To Droughts, Joanna Endter-Wada, Theresa Selfa, Lisa Welsh

Environment and Society Faculty Publications

The Bear River Basin, which includes portions of Idaho, Utah, and Wyoming in the United States, has a dynamic history of human hydrologic adaptations in relation to a highly variable water supply. These adaptations are embedded in a geographical setting highly influenced by the legal, policy, and institutional contexts that govern allocation of water in this generally arid region. In response to several years of drought and a historically low water year in 2004, water users in the Bear River Basin tested the efficacy of the “law of the river” and innovative agreements that they had negotiated in recent years …
