A Case Study Of Institutional Visioning, Public Good, And The Renewal Of Democracy: The Theory And Practice Of Public Good Work At The University Of Denver, Eric Fretz, Nicholas J. Cutforth, Nicole Nicotera, Sheila Summers Thompson

Research Methods and Statistics: Faculty Scholarship

In 2001, the University of Denver included language in its vision statement that committed the institution to becoming “a great private university dedicated to the public good.” This essay (1) explains how the development of an institutional visioning statement led to the implementation of a series of campus dialogues
and action steps designed to forward public good work at the university; (2) presents campus conversations and current literature to offer a theory of public good work within private research universities; and (3) documents challenges and lessons learned through institutional efforts to embrace a culture of engagement.

The 2009 Unlv Campus Sustainability Survey Report, Mark J. Salvaggio

Reports (USI)

In an effort to understand environmental awareness, concerns, practices, and values at the University of Nevada, Las Vegas (UNLV), the Urban Sustainability Initiative (USI) conducted its first campus environmental sustainability survey during the months of March, April, and May 2009. This pilot study was developed to collect baseline data from students, faculty, and staff members at the UNLV campus to be used in a longitudinal study that assesses attitudes and preferences towards environmental sustainability issues. This research project is guided by one of the major goals of USI, which involves reaching out to the academic community to help find workable …

Do Adoption Subsidies Help At-Risk Children?, Kasey Buckles Jan 2009

Do Adoption Subsidies Help At-Risk Children?, Kasey Buckles

University of Kentucky Center for Poverty Research Discussion Paper Series

Over half a million children in the United States are currently in foster care, many of whom are at risk for long-lasting emotional and health problems. Research suggests that adoption may be one of the more promising options for the placement of these children. The Adoption Assistance and Child Welfare Act of 1980, which provided federal funds for monthly adoption subsidies, was designed to promote adoptions of special-needs children and children in foster care.

Using data from the Adoption and Foster Care Analysis and Reporting Systems for 2000- 2006, I consider the effects of these adoption subsidies on children’s likelihood …

Volume 1: The Challenge Of Pluralism : Paradigms From Muslim Contexts, Abdou Filali-Ansary, Sikeena Karmali Ahmed Jan 2009

Volume 1: The Challenge Of Pluralism : Paradigms From Muslim Contexts, Abdou Filali-Ansary, Sikeena Karmali Ahmed

Exploring Muslim Contexts

The volume discusses notions of pluralism and its specific relevance to Muslim societies. Current popular and academic discussions tend to make certain assumptions regarding Islam and its lack of compatibility with notions of pluralism. Some notable liberal thinkers have even argued that pluralism itself is inherently antithetical to Islam.

These assumptions are challenged by discussing the broad spectrum of relevance and application of the notion of pluralism to modern day societies, examining securalism, multiculturalism, democracy, globalisation and the pivotal role of civil society.

Islam : Between Message And History, Abdelmadjid Charfi, Abdou Filali-Ansary, Sikeena Karmali Ahmed, David Bond Jan 2009

Islam : Between Message And History, Abdelmadjid Charfi, Abdou Filali-Ansary, Sikeena Karmali Ahmed, David Bond

In Translation: Modern Muslim Thinkers

This book could easily be called ‘A Guide for the Modern Muslim’, someone for whom the sentiments of his or her ancestors resonate but who cannot accept the canonised formulas of a prescriptive education.

Charfi spells out what for him is the essential message of Islam, followed by a history of its unfolding through the person of the Prophet Muhammad, whom he perceives as a visionary seeking to change the ideals, attitudes and behaviours of the society in which he lived. Charfi delineates the message and its history as two separate elements, conflated by tradition.

Charfi confronts with great lucidity …

Buddhist Roles In Peacemaking : How Buddhism Can Contribute To Sustainable Peace, Ronald S. Green, Chanju Mun Jan 2009

Buddhist Roles In Peacemaking : How Buddhism Can Contribute To Sustainable Peace, Ronald S. Green, Chanju Mun

Philosophy and Religious Studies

This volume is the fifth in a series about socially engaged Buddhism published by Blue Pine Books. The publisher adheres to high academic standards, requiring strict documentation of sources and coherence of ideas. Readers will find in these articles some of the best resources available for understanding socially engaged Buddhism and peacemaking. We live in a world of conflict. Even though theorists had believed scientific and technological advancement would end suffering, the applications of these developments had just as often perpetuated the problem. In contrast, Buddhism is widely thought of as a way of peace and tranquilly for individual practitioners. …

The General Counsel Of A Nonprofit Enterprise: Some Questions, Edward B. Rock Jan 2009

The General Counsel Of A Nonprofit Enterprise: Some Questions, Edward B. Rock

Faculty Articles

No one has thought about the role of the general counsel more deeply than Geoff Hazard. The role of a lawyer in an organization raises fundamental questions about both the role of the lawyer as well as the key and contested question of “Who is the client?” In his article Legal and Managerial “Cultures” in Corporate Representation, Geoff pushes the analysis forward by introducing “culture” into the analysis and by urging us to look to the sociological literature to better understand the role of a general counsel in a corporation. The most important move in Geoff’s turn to the sociological …

Reversal, Dissent, And Variability In State Supreme Couts: The Centrality Of Jurisdictional Source, Theodore Eisenberg, Geoffrey P. Miller Jan 2009

Reversal, Dissent, And Variability In State Supreme Couts: The Centrality Of Jurisdictional Source, Theodore Eisenberg, Geoffrey P. Miller

Faculty Articles

State Supreme Courts (“SSCs”) exercise two major sources of authority: mandatory and discretionary jurisdiction. This Article assesses 7055 SSC cases decided with written opinions in 2003 to provide the first comprehensive study of the relation between jurisdictional source and SSC performance. Approximately half of the cases were discretionary and half were mandatory. Jurisdictional source is associated with several important aspects of SSC behavior. Aggregated across states, courts reversed 51.6% of discretionary jurisdiction cases, compared to 28.1% of mandatory cases. The jurisdictional source also affected dissent rates: 26.7% of discretionary cases generated at least one dissenting opinion, compared to 18.8% of …

Internet Daters’ Body Types Preferences: Race-Ethnic And Gender Differences, Carol L. Glasser, Belinda Robnett, Cynthia Feliciano Jan 2009

Internet Daters’ Body Types Preferences: Race-Ethnic And Gender Differences, Carol L. Glasser, Belinda Robnett, Cynthia Feliciano

Sociology Department Publications

Employing a United States sample of 5,810 Yahoo heterosexual internet dating profiles, this study finds race–ethnicity and gender influence body type preferences for dates, with men and whites significantly more likely than women and non-whites to have such preferences. White males are more likely than non-white men to prefer to date thin and toned women, while African-American and Latino men are significantly more likely than white men to prefer female dates with thick or large bodies. Compatible with previous research showing non-whites have greater body satisfaction and are less influenced by mainstream media than whites, our findings suggest Latinos and …

Identifying The Postmodern/Cold War Interlock— Soliciting A Security Studies Pedagogy Au Courant, Michael R. Mcrill Jan 2009

Identifying The Postmodern/Cold War Interlock— Soliciting A Security Studies Pedagogy Au Courant, Michael R. Mcrill

Global Tides

One scholarly faction contends that the arenas of security studies and international politics have remained essentially the same post-World War II. The other sees the 1960s as illuminating a fundamental paradigm shift concerning security studies. The latter group asserts that the majority of security concerns has either been dropped or sharply shifted post-Cold War. Since then, studies have expanded to encompass a scholarly plea for broader definitions of national security. The advent and increase of nonmilitary threats has led many to argue that these threats must be considered within the arena of national security concerns, and other scholars assert that …

Polygamy's Inscrutable Secular Mischief, Susan G. Drummond Jan 2009

Polygamy's Inscrutable Secular Mischief, Susan G. Drummond

Comparative Research in Law & Political Economy

This paper attempts to decipher the specific mischief in the offense of polygamy in-and-of-itself. It examines whether the offense coincides any longer with the contemporary substratum of values about the family and sexuality that have emerged over the last forty years in Canadian law and society. The relevance of formal conjugality - triggered by marriage, extinguished by divorce, and shielded in-between by privacy - has been turned inside/out by the sociological and legal significance of functional conjugality. For the latter construct the content of intimate and familial relationships has become a substitute focus of legal scrutiny. Meanwhile, the contemporary range …

"Risk Society" And The Precautionary Approach In Recent Australian, Canadian And Uk Judicial Decision Making, Filip Gelev Jan 2009

"Risk Society" And The Precautionary Approach In Recent Australian, Canadian And Uk Judicial Decision Making, Filip Gelev

Comparative Research in Law & Political Economy

After the terrorist attacks of 11 September 2001 terrorism was added to the list of potentially catastrophic global events, such as global warming or nuclear explosions, which characterise Ulrich Beck's risk society. Operating in an atmosphere of fear, executive governments and parliaments around the world take precautionary measures to prevent future terrorist acts - governments accumulate information, detain terrorism suspects, freeze funds and so on. International Relations scholars see the judiciary as a guardian of human rights that can stop or at least curb the excesses of the other two branches of government. The article argues that this view is …

The Next 'Great Transformation' Of Markets And States In The Transnational Space: Global Assemblages Of Corporate Governance And Financial Market Regulation, Peer Zumbansen Jan 2009

The Next 'Great Transformation' Of Markets And States In The Transnational Space: Global Assemblages Of Corporate Governance And Financial Market Regulation, Peer Zumbansen

Comparative Research in Law & Political Economy

It is a well-known and much explored fact that capital market regulation has had a larger share of activity and visible success within the process of European integration than the long-standing efforts towards the establishment of harmonized rules in the area of corporate governance. While a unified, harmonized or effective market-wide corporate governance regime was identified early on as one of the building blocks of the European project, the historically grown, path-dependent varieties in national corporate law systems proved - for the longest time - resistant to ambitious Europeanization efforts. This paper argues that precisely at the time when companies' …

Law's Knowledge And Law's Effectiveness: Reflections From Legal Sociology And Legal Theory, Peer Zumbansen Jan 2009

Law's Knowledge And Law's Effectiveness: Reflections From Legal Sociology And Legal Theory, Peer Zumbansen

Comparative Research in Law & Political Economy

Legal sociology is in a crisis - or so it is said. The field is not widely represented at Law Faculties today and, the claim goes, is in dire need of a new spirit. Meanwhile, scholars who are working in the area cover a wide array of research questions, ranging from criminology to family law, from urban governance to transitional justice, illustrating thus a fine sensitivity for important and fast evolving areas. This paper argues that indeed our times offer a great host of promising opportunities for legal sociological research. In midst of a truly dramatic economic crisis where anchoring …

Shareholder Engagement In The Embedded Business Corporation: Investment Activism, Human Rights And Twail Discourse, Aaron A. Dhir Jan 2009

Shareholder Engagement In The Embedded Business Corporation: Investment Activism, Human Rights And Twail Discourse, Aaron A. Dhir

Comparative Research in Law & Political Economy

The expansion of Canadian extractive corporations' overseas business operations has led to serious concerns regarding human rights-related impacts. As these apprehensions grow, we see a countervailing rise in calls for government intervention and in levels of socially conscious shareholder advocacy. I focus on the latter as manifested in recent use of the shareholder proposal mechanism found in Canadian corporate law. Shareholder proposals, while under-theorized, provide a valuable lens through which to consider the argument that economic behaviour is embedded within social relations. In doing so, I situate my analysis within Third World Approaches to International Law (TWAIL) scholarship. Elsewhere, I …

The Governance And Disclosure Of The Firm As An Enterprise Entity, Yuri Biondi Jan 2009

The Governance And Disclosure Of The Firm As An Enterprise Entity, Yuri Biondi

Comparative Research in Law & Political Economy

Recent financial crises and scandals have focused attention on the system of governance and disclosure in a way many may never have imagined and few welcomed. Not only do reforms appear to be necessary to protect shareholders as well as other stakeholders, but also to develop a different understanding of the relationship between the financial markets and the business firm. This paper criticises two daydreams concerning the firm - as a 'black-box' or an 'owner-entrepreneur' - and contrasts them to the idea of the firm as an enterprise entity. The latter implies a comprehensive approach that integrates economics, accounting, and …

Law And Learning In An Era Of Globalization, Harry W. Arthurs Jan 2009

Law And Learning In An Era Of Globalization, Harry W. Arthurs

Comparative Research in Law & Political Economy

This paper explores the ways in which globalization, as a dominant influence on political economy, makes its presence felt on legal education and research. In particular, it questions whether law schools have maintained agency in the choice to embrace globalization in their curricula, scholarship and general orientation or whether law schools have been forced to bend to the realities of the global economy. While neo-liberal “globalization of the mind” has shifted assumptions about the project of law and entrenched a “new normal” in legal education and scholarship, the McGill curriculum – based on so-called transsystemic legal education – offers the …
