Back To Basics: Determining A Child's Habitual Residence In International Child Abduction Cases Under The Hague Convention, Tai Vivatvaraphol

Fordham Law Review

Since 1980, the Hague Convention on the Civil Aspects of International Child Abduction (Child Abduction Convention) has been ratified by eighty-one countries, including the United States. The Child Abduction Convention addresses the growing problem of child abductions by estranged parents across international borders and the diverse methods that different countries have developed for dealing with this problem. It provides for a simple summary-return mechanism to be administered by the courts of member states: a wrongfully removed (or retained) child is to be returned to (or permitted to stay in) his or her country of “habitual residence.” However, the Child Abduction …

Examining Costs Of Diversity, Eboni S. Nelson Jan 2009

Examining Costs Of Diversity, Eboni S. Nelson

Although the Supreme Court struck down the voluntary race-based student-assignment plans employed in Parents Involved in Community Schools v. Seattle School District No. ] and Meredith v. Jefferson County Board of Education as violative of the Equal Protection Clause, many school officials will seek refuge in Justice Kennedy's concurrence and continue their pursuit of racially diverse student bodies. This Article questions the wisdom of such a pursuit and urges school officials to pursue measures other than racial diversity to provide equal educational opportunities to minority students.

The Article begins with a discussion of the social, democratic, and educational benefits commonly …

Violence Against Women Raises Risk Of Cervical Cancer, Ann L. Coker, Claudia Hopenhayn, Christopher P. Desimone, Heather M. Bush, Leslie Crofford Jan 2009

Violence Against Women Raises Risk Of Cervical Cancer, Ann L. Coker, Claudia Hopenhayn, Christopher P. Desimone, Heather M. Bush, Leslie Crofford

CRVAW Faculty Journal Articles

Background: An emerging literature suggests that violence against women (VAW), particularly sexual violence, may increase the risk of acquiring a sexually transmitted infection (STI) and, therefore, may be associated with cervical cancer development. The purpose of this cross-sectional analysis was to determine if women who had experienced violence had higher prevalence rates of invasive cervical cancer.

Methods: Women aged 18–88 who joined the Kentucky Women’s Health Registry (2006–2007) and completed a questionnaire were included in the sample. Multivariate logistic regression analyses were used to adjust odds ratio (OR) for confounders (e.g., age, education, current marital status, lifetime illegal drug use, …

CRVAW Faculty Journal Articles

Objective: We investigated whether Latina mothers who were and were not human papillomavirus (HPV) positive differed in their knowledge and acceptance of the HPV vaccine for their children.

Methods: We conducted a cross–sectional survey among women aged 18–64 years between April 2007 and April 2008. Data collectors conducted in-person interviews in community clinics with 215 HPV-negative women and 190 HPV-positive women (with respective response rates of 64% and 84%). Most (83%) HPV-positive women were recruited at dysplasia clinics. Although no HPV-negative women were recruited at dysplasia clinics, they were recruited at other low-income public and private clinics.

Results: After adjustment …

CRVAW Faculty Journal Articles

To determine predictors of cervical cancer survival by socioeconomic status (SES), urbanization, race/ethnicity, comorbid conditions, and treatment among elderly Medicare-eligible women whose conditions were diagnosed with cervical cancer in a multiethnic population.

Methods: A total of 538 women with cervical cancer aged 65 years or older were identified from 1999 to 2001 from the Texas Cancer Registry and were linked with the state Medicare data and Texas Vital Records to determine survival times. All women had similar access to care through Medicare fee-for-services insurance. A composite measure of SES was created using census tract-level data as was urbanization. Treatment and …

Forty Years Of Welfare Policy Experimentation: No Acres, No Mule, No Politics, No Rights, Julie A. Nice Jan 2009

Forty Years Of Welfare Policy Experimentation: No Acres, No Mule, No Politics, No Rights, Julie A. Nice

Northwestern Journal of Law & Social Policy

This introductory essay questions putting nearly all effort into social policywhich has failed to reduce povertyand calls instead for reinvigorating other tactics and re-imagining the unfinished dream of economic justice. Indeed, what Martin Luther King, Jr. envisioned was an actual war on poverty, not merely the abbreviated, under-funded, and ultimately unsuccessful effort of the 1960s, nor the imposter war on welfare that has dominated our social policy effort since. But our social policy has not only failed to reduce poverty, it failed to focus long-needed attention on poverty and inequality. Nor has social policy facilitated the political mobilization of poor …

Review Article: Bainbridge’S The New Corporate Governance (In Context), Fenner L. Stewart Jr. Jan 2009

Review Article: Bainbridge’S The New Corporate Governance (In Context), Fenner L. Stewart Jr.

Comparative Research in Law & Political Economy

If corporate boards are becoming more than “rubber stamps”, then Stephen Bainbridge and his new book are in the middle of a coup d'état in corporate governance. On the other hand, if this shift is not occurring and boards remain “rubber stamps”, then director primacy is no more than managerialism with a twist. Moreover, if director primacy represents the emergence of a new order for American corporate governance, then the merits of maintaining Delaware’s status quo director primacy must be carefully assessed, because the stakes are changing - maybe for the better and maybe for the worse. This article traces what …

The Contribution Of Justice Bastarache To Equality Law, James Hendry Jan 2009

The Contribution Of Justice Bastarache To Equality Law, James Hendry

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Justice Bastarache made a number of positive contributions to equality law, in respect of both the Canadian Charter of Rights and Freedoms and human rights legislation. This paper considers his contribution in light of a the ory that judges do at least two things when implementing a constitutional provision. They determine its meaning and the n they develop constitutional doctrine that they think best achieves it. Justice Bastarache came to the Court after it had determined the meaning of the equality right. He devoted his efforts to developing doctrine that aimed at putting it to work. Perhaps his keenest interest …

Emotional Speech Corpus Creation, Structure, Distribution And Re-Use, Brian Vaughan, Charlie Cullen

Conference papers

Abstract This paper details the on-going creation of a natural emotional speech corpus, its structure, distribution, and re-use. Using Mood Induction Procedures (MIPs), high quality emotional speech assets are obtained, analysed, tagged (for acoustic features), annotated and uploaded to an online speech corpus. This method structures the corpus in a logical and coherent manner, allowing it to be utilized for more than one purpose, ensuring distribution via a URL and ease of access through a web browser.
