In a period when students, parents, teachers and administrators are bombarded with images related to school shooting attacks, efforts to prevent such attacks in the future and to identify students who pose a threat to school safety have intensified. These efforts to fight the seemingly mounting wave of school violence have contributed to the rise of stereotypes of what a school shooter looks, talks, and acts like. This study examines one of these stereotypes: the writer-of-violence-as-school-shooter stereotype. The fusion of young people to the prison setting has been described as a toxic combination. This is especially pertinent when applied to youth in remand custody. Previous research studies have identified young people on remand as a highly vulnerable prison population and custodial remand to be a particularly stressful prison experience. Despite this, little research to date has examined how young people cope while remanded in custody. Our neighborhoods, Olde Towne and Gridley, Allin and Prickett (GAP), are long-established areas of Bloomington located directly west of downtown along Market Street. Our area is home to historic housing and long-standing churches, social service agencies and small businesses. In 2007, community and business organizations representing the public, private and nonprofit sectors started discussing the challenges confronting GAP and Olde Towne and the steps that could be taken to revitalize our community. Linking land use with climate change and sustainability topped state legislative land use reform agenda in 2008. The only discernible state land use reform trends in 2008 have focused primarily on themes surrounding sustainability. Many states pursued statutory reforms to address the strong linkages between land use and climate change, green development and affordable housing. Only one state, Michigan, focused on recodification of its planning and zoning enabling acts.

This paper proposes a prototype solution for a mobile web resource tracking system using mobile devices during an emergency situation. The system provides real time data to a decision maker so that he/she can effectively and efficiently monitor resources and assess the situation accordingly. This article, one in a collection of articles on the British Columbia Court of Appeal, surveys that court's jurisprudence in the field of Aboriginal and treaty rights. It begins in the 1960s and 1970s with a series of cases that reveal a court confident in its assumption that Aboriginal rights had little bearing on the province. The decisions of the court through the 1970s reflected and consolidated a status quo that had all but ignored Aboriginal rights and title. The authors identify a gap in Canadian policing law. Police have neither common law nor statutory authority to undertake the sorts of public order policing measures that are thought to be essential to securing large public events, such as Vancouver's 2010 Olympics. The paper argues for the adoption of a Public Order Policing Act designed to confer the necessary powers and ensure their operation in a manner that respects constitutional law and fundamental civil liberties. The design and control of work zone traffic control areas is governed by standards published by the United States Department of Transportation (US-DOT) and documented in the Manual for Uniform Control Devices (MUTCD). While these configurations have evolved over time to reflect safer and more efficient management practices and have become familiar to drivers, they are also recognized as areas of vehicle conflict that can cause congestion and safety problems. In the wake of the "Amerithrax” anthrax attacks of September and October 2001, the United States committed a large amount of funding towards biodefense research. With this commitment came a large increase in the number of federally-funded and private laboratories conducting biodefense research that was not well-regulated by the federal government. The result is that many laboratories are currently studying dangerous agents such as anthrax with inadequate security measures and little oversight. Unless reform is enacted to correct this situation, these laboratories will continue to represent a potential threat to public safety.

The Sacramento-San Joaquin Bay-Delta region is unique in terms of its natural resources and disproportionate economic impact on the State of California. Several aspects of its history have also given rise to unusual legal problems affecting property rights in both land and water. In the wake of District of Columbia v. Heller, lower courts have entertained a number of challenges to myriad federal, state, and local gun-control laws. Not surprisingly, given language in Heller seemingly intended to forestall some claims, courts have not, to date, invalidated federal or state gun-control laws that fall short of D.C.'s near-prohibition on private gun ownership. While the lower court cases to date confirm our earlier predictions that lower courts would not run wild with Heller, it is not clear that Heller was a purely symbolic victory either. Supply Restrictions At The Margins Of Heller And The Abortion Analogue: Stenberg Principles, Assault Weapons, And The Attitudinalist Critique, Nicholas J. Johnson

Through a consideration of the assault weapons question, this Article engages the criticism that District of Columbia v. Heller provides an insufficient standard for resolving many questions that emerge under the newly-clarified Second Amendment. After arguing that assault weapons might enjoy threshold protection under Heller's common-use test, the Article shows how the principles grounding the Supreme Court's abortion jurisprudence are especially suited for resolving aspects of the question that Heller does not explicitly answer. Criminological studies which identify perpetrator characteristics are unanimous in finding that almost all murderers fall into three categories: (i) the mentally disturbed, and/or (2) adults with criminal records, and/or (3) juveniles with juvenile records. Many murder perpetrators exhibit two or all three characteristics. Thus laws such as the ones Heller invalidated that seek to disarm the general population have minimal value and deprive victims of the means of self-defense.

Four Exceptions In Search Of A Theory: District Of Columbia V. Heller And Judicial Ipse Dixit, Carlton F. W. Larson

This Symposium Essay examines the Supreme Court's Second Amendment decision in District of Columbia v. Heller. Specifically, the Essay examines four exceptions to the right to bear arms that the Court specifically approved: (i) laws disarming felons, (2) laws disarming the mentally ill, (3) laws prohibiting the possession of firearms in sensitive places, and (4) laws regulating the commercial sale of firearms. The Essay argues that these exceptions cannot be completely justified on originalist grounds, at least under the form of originalism that the Court is likely to employ. For several years, the Supreme Court has been systematically erecting obstacles to the litigation of constitutional claims in federal court. Although this trend toward limiting federal court authority affects all types of constitutional claims, including those involving traditional individual constitutional rights, the most serious effect is on what can be called "structural rights." The term "structural rights" describes constitutional provisions that are designed to protect the basic nature of democratic government. This preliminary study investigated the voice initiation period (VIP) and voice offset period (VOP) using high-speed digital imaging. The purpose of the study was to obtain preliminary data on VIP and VOP patterns of normal voice and to investigate the variability in VIP and VOP patterns in young female subjects within and between recording sessions. VIP was segmented into 3 phases: VIPa, VIPb, and VIPc. Results of the analysis of the data demonstrated that VOP is a more consistent measure than VIP and that VIPa is the most consistent phase of VIP. Mass evacuation of urban areas due to hurricanes is a critical problem that requires extensive basic and applied research. Knowing the accurate evacuation time needed for the entire region in advance such that the evacuation order can be issued on a timely basis is crucial for the officials. Microsimulation modeling, which focuses on the characteristics of individual motorists and travel behavior, has been used widely in traffic simulation as it can lead to the most accurate result.
