In Boumediene v. Bush, which grants non-citizens detained at Guantanamo Bay, Cuba, constitutional habeas corpus privileges the Supreme Court took notice that the United States maintains "de facto sovereignty" over that territory. As its sole precedential support, the Court cited a case that never mentions the term de facto sovereignty. What is this concept? How important is it to the Court's holding? Did the Court get the concept right given its longstanding usage and meaning in Supreme Court precedent? Canadian police lack specific statutory authorization to take measures commonly thought essential to good public order policing. The erection of security fences, creation of designated 'protest areas', restriction of access to public space, surveillance, and search without cause intrude massively into the ordinary freedoms of law-abiding subjects. Such measures may be helpful, perhaps necessary. But no Canadian legislature has ever expressly conferred such powers. They do not reside in the domain of the common law. The Original Meaning Of The Privileges And Immunities Clause, Robert G. Natelson

The Constitution's Privileges and Immunities Clause drew on words and phrases common in Anglo-American law and law practice at the time the Clause was written. Modern courts and commentators have largely overlooked that law and practice, and thus have misinterpreted the Clause. It did not protect a right to travel, natural rights in general, colonial charter rights, or the "rights of Englishmen." The Clause meant only that if a state voluntarily bestowed positive legal benefits as incidents of its own citizenship, then that state had to grant those same benefits to visitors who were citizens of other U.S. states. Street Stops And Broken Windows Revisited: The Demography And Logic Of Proactive Policing In A Safe And Changing City, Jeffrey Fagan, Amanda Geller, Garth Davies, Valerie West

The contributions of order-maintenance policing and broken windows theory to New York City’s remarkable crime decline have been the subject of contentious debate. The dominant policing tactic in New York since the 1990s has been aggressive interdiction of citizens through street encounters in the search for weapons or drugs. Research showed that minority citizens in the 1990s were disproportionately stopped, frisked and searched at rates significantly higher than would be predicted by their race-specific crime rates, and that this excess enforcement was explained by the social structure of predominantly minority neighborhoods than by either their disorder or their crime rates. …

Pot As Pretext: Marijuana, Race And The New Disorder In New York City Street Policing, Amanda Geller, Jeffrey Fagan

Although possession of small quantities of marijuana has been decriminalized in New York State since the late 1970s, arrests for marijuana possession in New York City have increased more than tenfold since the mid-1990s, and remain high more than ten years later. This rise has been a notable component of the City’s “Order Maintenance Policing” strategy, designed to aggressively target low-level offenses, usually through street interdictions known as “Stop, Question, and Frisk” activity. We analyze data on 2.2 million stops and arrests carried out from 2004 to 2008, and identify significant racial disparities in the implementation of marijuana enforcement. These …

Subsidizing Charitable Contributions: Incentives, Information, And The Private Pursuit Of Public Goals, David M. Schizer

The charitable deduction has enjoyed relatively little support in the legal academy. Many commentators have asked what it adds to the tax system and, as critics such as Stanley Surrey and Paul McDaniel have observed, the deduction obviously does not itself collect tax revenue. Defenders respond that the deduction helps to measure income and to keep taxpayers from inefficiently substituting leisure for work, but these points are, of course, contested. Instead of revisiting debates about what the deduction adds to the tax system, this Article focuses on the broader question of what it adds to the pursuit of public goals. …

This study explored middle school parents' perceptions of the contributions career and technical education could make to their child's educational or workforce plans. It also examined what actions parents undertake to influence their child's plans, specifically the impact of the career exploration tool, Coin Career Community©, on their actions. Last, the study explored the correlation between the course choices students made in ninth grade relative to their parents' perceptions.

Motor vehicle crashes are the number one cause of injuries and fatalities for persons 15-19 years of age in the United States. The higher fatality rate is caused in part from the lack of driving experience and the increased risk taking behaviors of adolescent drivers. Graduated driver licensing laws have been enacted in most states to address the risks associated with inexperience by adding restrictions on nighttime driving and limiting the number of teen passengers in the vehicle for novice drivers.

This report considers the relationship between rights and responsibilities within the context of the ongoing debate on a Bill of Rights and Responsibilities. "This thesis describes the design, testing, and proposed extended field test of a wireless sensor network based on the SmartBrick, a structural health monitoring (SHM) device developed at Missouri S&T. The SmartBrick serves as the base station for the network, which utilizes additional sensor nodes to monitor the structure. Each node measures a range of environmental and structural phenomena, including vibration, tilt, humidity, and strain. The nodes use Zigbee short-range communication to transmit their data to the base station, which in turn uses the GSM cellular network to provide long-range communication capability and support for remote control.

"This research investigates the potential for an alternative masonry product to use in masonry infill wall systems. The study also investigates the effects of an external fiber reinforced polymer (FRP) strengthening system on in-plane behavior of the alternative unreinforced masonry (URM) walls. The alternative masonry product is produced in a solid unit configuration and utilizes recycled white oak wood-fibers and an ASTM Class-C fly ash as its raw materials. A load-bearing vehicle must be carefully positioned on a bridge for quantitative bridge monitoring. The road to marijuana prohibition is paved with prejudice, hysteria, and the outright rejection of science and rationality. Despite its proven medical value, marijuana remains misclassified under federal law, misrepresented and misunderstood by most of our drug policy makers. Seizing their role as innovators in our federalist system, California and twelve other states have declared their support for the many doctors and patients who believe in the therapeutic benefits of cannabis. In January of 2007, Drs. Gordon and Angela Crews traveled with their graduate assistant, Mr. Kofi Annor Boye-Doe, and Ghanaian Fulbright Scholar, Mr. Ken Aikins, to Ghana, West Africa, in order to conduct a research study. The original research plan was to conduct a three part examination of: 1) the blend of indigenous government (rooted in religious practices and strongly associated with spirituality and mysticism) and state government in the Ghanaian justice system; 2) the treatment of women and children within these systems; and 3) the alternative dispute resolution, restorative justice, and conflict resolution strategies within the two systems.

A great deal of criminological literature asserts that many non-violent drug offenders are being unnecessarily incarcerated in our nation's prisons. This argument suggests that those offenders typically specialize solely in drug crimes and alternative sanctions would be the most logical and cost-effective way to handle this growing segment of offenders. The purpose of the current research is to examine sentences for non-violent drug convictions and to assess whether presumably non-violent drug offenders pose a significant risk or threat to public safety. An analysis of a sample of 530 convicted drug offenders shows the majority do indeed have significant criminal histories …
