Information Overload: Cctv, Your Networks, Communities And Crime, Vandra Harris, Crispin Harris
Australian Security and Intelligence Conference
Electronic surveillance continues to play a central but often unobserved role in contemporary Western societies and attempts to police them. This paper focuses on closed circuit television (CCTV) footage and its technological implications, particularly relating infrastructure and data storage and integrity. While CCTV might appear attractive in augmenting law enforcement systems, the authors argue that the debate on use of CCTV in crime prevention remains incomplete without an effective understanding of the diverse costs. This discussion reveals startling ICT resource needs and associated costs, together with very specific technological capacity. These contribute significantly to the costs of such systems, reinforcing …

Portraits Of The Undocumented Immigrant: A Dialogue, Stephen H. Legomsky
Portraits Of The Undocumented Immigrant: A Dialogue, Stephen H. Legomsky
Georgia Law Review
Few subjects can match the pure polarizing power of illegal immigration. Yet the scholarly literature has made surprisingly little effort even to identify, much less evaluate, the critical philosophical and empirical assumptions that have driven either the perceptions or the policy prescriptions of the opposing camps. This Article seeks to fill that gap. Through a spirited dialogue between two fictional professors with sharply differing views, it paints contrasting portraits of undocumented immigrants. Two patterns emerge. First, the more restrictive positions invariably reflect what this Article calls "aggregation"-a tendency to visualize undocumented immigrants en masse and to emphasize their collective impact …
Sniffing Out The Ancillary Powers Implications Of The Dog Sniff Cases, James Stribopoulos
Sniffing Out The Ancillary Powers Implications Of The Dog Sniff Cases, James Stribopoulos
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper critically evaluates the Supreme Court of Canada’s recent decisions in the dog sniff cases: R. v. Kang-Brown and R. v. M. (A.). After briefly assessing the impact of these decisions on the law of search and seizure, the paper considers the significance of the disagreement between the majority and dissent in these cases on the appropriateness of using the ancillary powers doctrine to recognize new “common law” police powers. The paper explains the origins of that doctrine, its operation and the controversy that continues to surround its use as a source of police powers. On this fundamentally important …
R. V. B. (D.): The Constitutionalization Of Adolescence, Nicholas Bala
R. V. B. (D.): The Constitutionalization Of Adolescence, Nicholas Bala
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
Canadian law has long recognized that because youth have limited capacities and greater vulnerability, they should be afforded a special status in the criminal justice system. Since the Youth Criminal Justice Act (“YCJA”) came into force in 2003, the Supreme Court has favoured a “pro-youth” interpretation of the Act, restricting the use of custody for young offenders and protecting their legal rights. The 2008 decision of the Supreme Court in R. v. B. (D.) significantly extended this protective approach, recognizing that the principle of the “diminished moral blameworthiness” of youth in the criminal justice system has not only a statutory …

The Differential Treatment Of Adolescents As A Principle Of Fundamental Justice: An Analysis Of R. V. B. (D.) And C. (A.) V. Manitoba, Cheryl L. Milne
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper discusses the Supreme Court’s characterization of adolescence in R. v. B. (D.) and its application of the criteria established by the Court as to what constitutes a principle of fundamental justice. The author also discusses implications of the decision on a subsequent case which focused on the nature of adolescent decision-making in the child health and welfare context, C. (A.) v. Manitoba (Director of Child and Family Services), and addresses the evidentiary aspects of the Court’s taking judicial notice of the psychological underpinnings of its decision in both cases. Ultimately, both cases establish a relatively consistent view of …
A Political Turn: Highways And Mass Transit In American Mobility History, Michael R. Fein Ph.D.
A Political Turn: Highways And Mass Transit In American Mobility History, Michael R. Fein Ph.D.
Humanities Department Faculty Publications & Research
Mark Rose’s Interstate: Express Highway Politics (1979) and Bruce Seely’s Building the American Highway System: Engineers as Policy Makers (1987) signaled the opening of U.S. highway politics as a field for sustained scholarly investigation. In Interstate, Rose examined the political competition among interest groups, such as truck operators, that produced the landmark 1956 highway legislation. Seely’s focus was the road engineers themselves, led by Thomas MacDonald, whose uncanny ability to present themselves as ‘apolitical’ experts paradoxically allowed them to dominate the highly politicized drafting of the main contours of American highway policy. Together these two texts opened a range of …

The War On Drugs, David Jakubiec, Andrew Kilcer, William Sager
Student Work
America is in an epic battle, not against a foreign country but to keep you and every other citizen from putting a certain list of chemicals in your body. Since President Nixon, this battle has been labeled "The War on Drugs". This battle is extremely expensive: total cost to local, state and federal government equals $19.2 billion a year. In a country of approximately 300 million that equates to $64 per person (Elsner, p. 22). All of these resources are used in an effort to keep people from getting high. What do Americans get for 64 dollars a year; they …

On Restating Products Liability Preemption, Mary J. Davis
On Restating Products Liability Preemption, Mary J. Davis
Law Faculty Scholarly Articles
This Article provides a brief explanation of the state of preemption doctrine and explains how the Court altered, quite dramatically, its treatment of preemption of common law tort actions in the last two decades. The Court's almost exclusive focus on the interpretation of express preemption provisions, which never specifically address common law tort claims one way or the other, turned "traditional" preemption analysis of common law tort claims on its head. The Court then, almost as suddenly, signaled a retreat from the emphasis on express preemption analysis and returned, awkwardly, to implied preemption doctrine. The Court has only recently begun …
