A More Lasting Comfort?: The Politics Of Minimum Sentences, The Rule Of Law And R. V. Ferguson, Benjamin L. Berger Jan 2009

A More Lasting Comfort?: The Politics Of Minimum Sentences, The Rule Of Law And R. V. Ferguson, Benjamin L. Berger

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

As a priori political judgments about what is a just punishment in all circumstances, minimum sentences pose particular and profound problems for the administration of criminal justice. Mandatory minimums are, however, politically seductive. Faced with their proliferation in Canadian penal law, Canadian courts have experimented with using the constitutional exemption as a means of addressing the excesses created by mandatory minimum sentences. This experimentwas terminated in the Supreme Court of Canada’s recent decision in R. v. Ferguson. Although this judgment has been met with dismay in some quarters, this paper argues that the decision is best read as a welcome …

Regulating Robocalls: Are Automated Calls The Sound Of, Or A Threat To, Democracy, Jason C. Miller Jan 2009

Regulating Robocalls: Are Automated Calls The Sound Of, Or A Threat To, Democracy, Jason C. Miller

Michigan Telecommunications & Technology Law Review

African-American voters receive a phone message implying that they are not registered to vote. Others hear "an almost threatening male voice," a "fake New York accent," factual distortions about legislation, false endorsements from controversial groups, calls promoting one candidate claiming to be from his opponent, and a constant barrage of annoying phone calls designed to make voters think a different candidate was sponsoring them. These messages were delivered through automated political telephone calls, also known as robocalls. Robocalls are cheap and efficient--one can deliver a pre-recorded message through 100,000 automated phone calls in one hour for only $2000. Consequently, robocalls …

"You Can't Get There From Here?": Ineffective Assistance Claims In Federal Circuit Courts After Aedpa, Gregory J. O'Meara S.J.

Marquette Law Review

One measure of a society is how it treats those with little power, those who have suffered from problems not of their own choosing. Surely victims of crime fit into this category, and society has not often given them what they desire and need. Though they garner far less sympathy, perpetrators of crime may also be vulnerable to forces beyond their control, including physical and mental disabilities, childhoods marked by abuse and neglect, and incompetent attorneys who fail to fulfill constitutionally mandated standards. The criminal justice system attempts to address deficiencies in the representation criminal defendants receive in part through …

The Effects Of Goldshield Antimicrobial On Bacillus Anthracis Sterne And Clostridium Difficile, Victor Petreca Jan 2009

The Effects Of Goldshield Antimicrobial On Bacillus Anthracis Sterne And Clostridium Difficile, Victor Petreca

Senior Honors Theses and Projects

Clostridium difficile, a non-aerobic spore former, is currently one of the most serious causes of nosocomial infections and antibiotic associated diarrhea (AAD). Due to the resilient nature of spores, its propagation can be difficult to control. Preventing infections through efficient and durable disinfection of hospitals’ facilities would result in diminished contaminations. This project was based on testing the efficacy of a new substance called Goldshield® Antimicrobial (a patented nano-molecular-assembly technology developed at Emory University) against Clostridium difficile. The tests were also done with the aerobic spore forming Bacillus anthracis Sterne.

Goldshield’s active reagents were tested against the …

Socioeconomic Impacts Of Developing Wind Energy In The Great Plains, F. Larry Leistritz, Randal C. Coon Jan 2009

Socioeconomic Impacts Of Developing Wind Energy In The Great Plains, F. Larry Leistritz, Randal C. Coon

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Wind energy has been growing rapidly in the Great Plains because of the region’s favorable wind resources and because it has been stimulated by a federal production tax credit and by state renewable portfolio standards. Wind energy installations also offer economic development opportunities for rural areas. The purpose of this study was to determine the socioeconomic effects of the recent development of a wind energy center on nearby communities. Project construction occurred over a six-month period, with the workforce peaking at 269. Project operation supports 10 permanent jobs and expenditures to local businesses and households totaling $1.4 million annually. These …

Thirty years ago, published research concluded that an expert’s chance of predicting recidivism was no more accurate than flipping a coin would be, and there was little in the way of valuable research on risk factors generally for criminal behavior or effective means of rehabilitation. Much has changed, and the Chapman Journal of Criminal Justice …

Only The Really Hard Part Of Ecourt Is Really Worth Doing, Michael H. Marcus Jan 2009

Only The Really Hard Part Of Ecourt Is Really Worth Doing, Michael H. Marcus

Court Review: Journal of the American Judges Association

Some 20 years ago, I released a defendant facing a minor charge pending his trial, who promptly beat up proprietors in a new attempted robbery. I had no access to information about the defendant’s criminal history. Even today, my mistakes that are based on inadequate information can allow tremendous harm to victims, communities, families, and children. I profoundly hope that I’m sending the right people to prison, to probation under proper conditions, and to the right providers.

It is, of course, terrible when someone we release promptly causes great harm. It is understandable that observers blame the judge for that …

Sovereign Comity: Factors Recognizing Tribal Court Criminal Convictions In State And Federal Courts, Matthew L.M. Fletcher Jan 2009

Sovereign Comity: Factors Recognizing Tribal Court Criminal Convictions In State And Federal Courts, Matthew L.M. Fletcher

Court Review: Journal of the American Judges Association

State and federal courts increasingly are being confronted with prosecutors moving the court to consider prior convictions in American Indian tribal courts during the sentencing phase, and sometimes earlier. For example, in People v. Wemigwans, the Michigan Court of Appeals allowed the use of a defendant’s two prior tribal court convictions to support a state-law felony charge for drunk driving, third offense. But in United States v. Lente, a divided panel of the Tenth Circuit noted that prior tribal court convictions (that apparently were uncounseled) for drunk driving did not support an upward departure under the federal sentencing …

The U.S. Geological Survey (USGS) Multi-Hazards Demonstration Project in Southern California (Jones and others, 2007) is a five-year project (FY2007-FY2011) integrating multiple USGS research activities with the needs of external partners, such as emergency managers and land-use planners, to produce products and information that can be used to create more disaster-resilient communities. The hazards being evaluated include earthquakes, landslides, floods, tsunamis, wildfires, and coastal hazards.

For the Coastal Hazards Task of the Multi-Hazards Demonstration Project in Southern California, the USGS is leading the development of a modeling system for forecasting the impact of winter storms threatening the entire Southern California …
