Reflections On Capital Punishment, Rob Warden Jan 2009

Reflections On Capital Punishment, Rob Warden

Northwestern Journal of Law & Social Policy

Authored by the Executive Director of the Center on Wrongful Convictions, this powerful article reviews the many different arguments against the death penalty and uses a multitude of case discussions to show how the death penalty works, not in theory, but in practice. Some of these arguments include: the death penalty does not have a demonstrable deterrent effect; it costs more to maintain the system than to imprison murderers for life; many wrongfully condemned defendants have been saved by the serendipitous discovery of evidence not available during trial; innocent persons have been executed; the death penalty has been applied in …

100 Years Strong: Southern Minnesota Regional Legal Services And The On-Going Pursuit For Equal Rights And Equal Justice, Tom I. Romero Jan 2009

100 Years Strong: Southern Minnesota Regional Legal Services And The On-Going Pursuit For Equal Rights And Equal Justice, Tom I. Romero

Sturm College of Law: Faculty Scholarship

As the lead essay in the Hamline Journal of Public Law and Policy's symposium issue on "Barriers to Justice: Responding to the Needs of the Low-Income Population in America," our essay provides a narrative account of the history of legal aid in Minnesota. From its humble origins in the basement of a mutual aid society in 1909 to the recent broad based community-lawyering programs for immigrants, the disabled, and those families who were hurt by predatory lending practices at the start of the 21st century, this is an "insiders" legal history concerning the values, people, and public private collaborative practices …

Standing And Statistical Persons: A Risk-Based Approach To Standing, Bradford Mank Jan 2009

Standing And Statistical Persons: A Risk-Based Approach To Standing, Bradford Mank

Faculty Articles and Other Publications

This Article proposes that any individual has standing to challenge government action that exposes her to an increased lifetime risk of 1 in 1 million or greater of death or serious injury. Because most regulation involves statistical probabilities of harm, a plaintiff challenging a government regulatory action or inaction as insufficiently protective cannot demonstrate that he or she would likely be harmed by the allegedly inadequate regulation, but merely that a different regulation might reduce the probability of future harm. The beneficiaries of a suit seeking better government regulation are, therefore, statistical persons rather than identifiable persons. By contrast, standing …

The Effects Of Financial Liberalization On The Growth Of The Jamaican Economy, Aditi Shukla Jan 2009

The Effects Of Financial Liberalization On The Growth Of The Jamaican Economy, Aditi Shukla

Theses & ETDs

This paper examines the role of financial liberalization in the nation of Jamaica and its effect on the economic development of the country. In particular, this paper investigates the important link between the oligopolistic structure of the nation's banks and the obstacles placed in the path to liberalization and globalization. This research involves an evaluation of the interest rate spread found as the difference between the loan and deposit rates of the nation. The paper also addresses the way in which the Jamaican real exchange rate reacted to an influx of foreign capital following liberalization of the financial sector. The …

Crisis Of Confidence: Cinematic Environmentalism Of The Seventies, Jacob Scott Starks Jan 2009

Crisis Of Confidence: Cinematic Environmentalism Of The Seventies, Jacob Scott Starks

Theses & ETDs

In the 1970's, film played a reflective and contributory role in American environmental culture. Many films of the decade reflected a cultural environmentalism driven by a crisis of confidence in government and industry's ability to ensure a viable and natural environment. This project examines six films' content, cultural context of production, and reception, which indicate a notion of American uncertainty concerning government and industry's protection or conservation of the environment. The opening chapter provides a context for the economic and political conditions of the 1970's, explaining the American “crisis of confidence.” The second chapter examines the public‟s lack of faith …

The Rights Of Migrants: An Optimal Contract Framework, Adam B. Cox, Eric A. Posner Jan 2009

The Rights Of Migrants: An Optimal Contract Framework, Adam B. Cox, Eric A. Posner

Articles

Why do migrants enjoy some of the rights associated with citizenship? Existing accounts typically answer this question in terms of obligation-of a duty on the part of states to confer citizenship. Moreover, scholars tend to lump together the rights conventionally associated with citizenship when they answer this question. In contrast, this Article disaggregates the rights associated with citizenship, asks what both states and migrants want, and inquires into how the suite of rights associated with citizenship might advance those interests. States want to encourage migrants to enter their territory and to make country-specific investments, but states also have an interest …

Corporate Philanthropy And The Market For Altruism, M. Todd Henderson, Anup Malani Jan 2009

Corporate Philanthropy And The Market For Altruism, M. Todd Henderson, Anup Malani

Articles

Academics and businesspeople have long debated the merits of corporate philanthropy. It is our contention that this debate is too narrowly focused on the role of corporations. There is a robust market for philanthropic works--which we call the market for altruism--in which nonprofit organizations, the government, and for-profit corporations compete to do good works. In this Essay, we describe this market and the role corporations play in satisfying the demand for altruism. We conclude that corporations should only engage in philanthropy when they have a comparative advantage over nonprofits and the government. Moreover, the government must avoid discriminating--particularly when setting …

Privatizing Democracy: Promoting Election Integrity Through Procurement Contracts, Jennifer Nou Jan 2009

Privatizing Democracy: Promoting Election Integrity Through Procurement Contracts, Jennifer Nou

Articles

Voting machine failures continue to plague American elections. These failures have fueled the growing sense that private machine manufacturers must be held accountable. This Note argues that, because legitimacy externalities and resource disparities across election jurisdictions pose persistent threats to electoral integrity, meaningful accountability will require greater federal oversight. This oversight must take into account the unique nature of the public-private partnership that defines this nation's system of election administration. This Note thus proposes an amendment to the Help America Vote Act of 2002, which would condition federal funds on state procurement contracts. These procurement contracts would mandate performance-based requirements …

One Strike And You're Out: Alcohol In The Major League Baseball Clubhouse, Steven B. Berneman Jan 2009

One Strike And You're Out: Alcohol In The Major League Baseball Clubhouse, Steven B. Berneman

Vanderbilt Journal of Entertainment & Technology Law

In the past decade, much has been written about Major League Baseball's (MLB) mistaken policies regarding performance-enhancing substance abuse by players. MLB executives are shortsighted, however, if they believe that steroids are the only substances being abused by players. Along with performance-enhancing drugs, professional baseball has a long-standing history of alcohol abuse. Steroids may provide better headlines--Congress has never held an investigation into alcohol abuse by professional athletes--but professional baseball faces a real danger from the unchecked liability of allowing players to overindulge at the ballpark and drive home shortly thereafter. By serving beer in the clubhouse after games, clubs …

An Indirect-Effects Model Of Mediated Adjudication: The Csi Myth, The Tech Effect, And Metropolitan Jurors' Expectations For Scientific Evidence, Hon. Donald E. Shelton, Young S. Kim, Gregg Barak Jan 2009

An Indirect-Effects Model Of Mediated Adjudication: The Csi Myth, The Tech Effect, And Metropolitan Jurors' Expectations For Scientific Evidence, Hon. Donald E. Shelton, Young S. Kim, Gregg Barak

Vanderbilt Journal of Entertainment & Technology Law

Part I of this article defines the "CSI effect," a phrase has come to have many different meanings ascribed to it. It emphasizes the epistemological importance of first describing the effect of the "CSI effect" as observed in juror behavior documented in a new study conducted in Wayne County (Detroit), Michigan, and then looking at causative factors that may be related to an explanation of those observed effects. Part II describes the methodology of the Wayne County study, provides a descriptive analysis of Wayne County jurors, and compares the jurors demographically to the Washtenaw County jurors who were surveyed in …

Loo Law: The Public Washroom As A Hyper-Regulated Space, Irus Braverman Jan 2009

Loo Law: The Public Washroom As A Hyper-Regulated Space, Irus Braverman

Journal Articles

The article suggests that the public washroom is the most regulated of all public spaces, at least in the United States. It offers several possible explanations for this hyper-juridical attention. First and foremost, the article argues, such hyper-regulation of the public washroom has to do with the sanitary and moral significance of this space. Secondly, the intensity of washroom regulation is due to its ambiguous public/private properties. Finally, the intense regulation of the public washroom is the result of physio-anatomical functions performed in it. Utilizing the State of New York as a lens through which to observe the various issues …

Prisons Must Cease Re-Traumatizing Women: A Call For Gender-Responsive Programs That End The Cycle Of Abuse, Sally Abrahamson Jan 2009

Prisons Must Cease Re-Traumatizing Women: A Call For Gender-Responsive Programs That End The Cycle Of Abuse, Sally Abrahamson

Legal Writing Competition Winners

“They break us out there and then more in here. And they don't do anything to build us back up.” This is a quote from a woman serving thirty-one years for assault and crack-cocaine possession. Like many other incarcerated women, she has a history of being in domestically abusive relationships. Prison, she said, felt like an extension of feeling the same hopelessness she did before entering prison. Using drugs was a means to escape the reality of abuse and poverty. Her time in prison further disempowered her economically and socially, as she received no job-training and lost many of her …
