Vol. 1 No. 1, Fall 2009; Current Trends In Inequitable Conduct Are Adverse To Patent Policy As Seen Through The Exemplary Case Of Big Pharma, Joshua M. Austin

Northern Illinois Law Review Supplement

This Comment explores the rather difficult and rapidly changing field of patent law, discussing specifically the doctrine of inequitable conduct, a defense raised by the infringing party by which a patent can be rendered unenforceable. Recent trends in inequitable conduct, as it has been used by the Federal Circuit, have made this confusing area of law even more so. This comment identifies these confusions and the Federal Circuit's failure to maintain clear cut precedent. This Comment further discusses the impacts of these current trends, postulating that these trends go so far as to undercut the principal policy purposes behind patent …

Deliberative Democracy And Inequality: Two Cheers For Enclave Deliberation Among The Disempowered, Christopher F. Karpowitz, Chad Raphael, Allen S. Hammond Iv Dec 2009

Deliberative Democracy And Inequality: Two Cheers For Enclave Deliberation Among The Disempowered, Christopher F. Karpowitz, Chad Raphael, Allen S. Hammond Iv

Communication

Deliberative democracy grounds its legitimacy largely in the ability of speakers to participate on equal terms. Yet theorists and practitioners have struggled with how to establish deliberative equality in the face of stark differences of power in liberal democracies. Designers of innovative civic forums for deliberation often aim to neutralize inequities among participants through proportional inclusion of disempowered speakers and discourses. In contrast, others argue that democratic equality is best achieved when disempowered groups deliberate in their own enclaves (interest groups, parties, and movements) before entering the broader public sphere. Borrowing from each perspective, the authors argue that there are …

Study Of Thermal Frontal Polymerization Utilizing Reactive And Non-Reactive Additives, Veronika Grace Viner Dec 2009

Study Of Thermal Frontal Polymerization Utilizing Reactive And Non-Reactive Additives, Veronika Grace Viner

Dissertations

Thermal frontal polymerization is a process that involves a propagating front travelling through a monomer/initiator solution and converting monomer into polymer. The effects of different reactive and non-reactive additives on front temperature, front velocity, and pot life were studied in a thermal frontal polymerization system of multifunctional acrylates. One issue with thermal frontal polymerization of acrylate monomers is the amount of smoke and fumes produced due to high front temperatures. The effect of thermally-expandable microspheres was studied utilizing a variety of monomers. Solid additives including fillers, inert phase changer materials, and high thermal conductive fillers were investigated. The addition of …

Cytotoxicity Effects Of Different Surfactant Molecules Conjugated To Carbon Nanotubes On Human Astrocytoma Cells, Lifeng Dong, Colette M. Witkowski, Michael M. Craig, Molly M. Greenwade, Katherine L. Joseph Dec 2009

Cytotoxicity Effects Of Different Surfactant Molecules Conjugated To Carbon Nanotubes On Human Astrocytoma Cells, Lifeng Dong, Colette M. Witkowski, Michael M. Craig, Molly M. Greenwade, Katherine L. Joseph

College of Natural and Applied Sciences

Phase contrast and epifluorescence microscopy were utilized to monitor morphological changes in human astrocytoma cells during a time-course exposure to single-walled carbon nanotube (SWCNT) conjugates with different surfactants and to investigate sub-cellular distribution of the nanotube conjugates, respectively. Experimental results demonstrate that cytotoxicity of the nanotube/surfactant conjugates is related to the toxicity of surfactant molecules attached on the nanotube surfaces. Both sodium dodecyl sulfate (SDS) and sodium dodecylbenzene sulfonate (SDBS) are toxic to cells. Exposure to CNT/SDS conjugates (0.5 mg/mL) for less than 5 min caused changes in cell morphology resulting in a distinctly spherical shape compared to untreated cells. …

Driving Reform And Innovation Diffusion In Government: It Takes Guerilla Tactics To Slay A Gorilla, George K. Makiya Dec 2009

Driving Reform And Innovation Diffusion In Government: It Takes Guerilla Tactics To Slay A Gorilla, George K. Makiya

Student Scholarship

Key IT and business executives at all twenty six US Federal government departments and agencies were interviewed to assess constraints to Enterprise Architecture Programs congressionally mandated in 1996 to transform bureaucratic political institutions into efficient business enterprises. Results demonstrate the vital role of the individual in reform and innovation diffusion. Past empirical and longitudinal studies in reform and innovation diffusion have been conducted separately. This study synthesizes the twin diffusion phenomena. Our data show that "guerilla" tactics can overcome the "gorilla" forces of dominant culture and rigid institutional frameworks.

Correlates Of Teachers' Job Satisfaction: A Hierarchical Linear Model Study Using 2003-2004 Schools And Staffing Survey, Jeffrey M. Leslie Dec 2009

Correlates Of Teachers' Job Satisfaction: A Hierarchical Linear Model Study Using 2003-2004 Schools And Staffing Survey, Jeffrey M. Leslie

Dissertations

This study examines the correlates of teachers' job satisfaction. Based on the literature, it proposes that teacher satisfaction is a function of, among others, the following school process variables: (a) school influence, (b) classroom control, (c) student behavior, (d) parental support, (e) staff collegiality, (f) career/working conditions, (g) administrative communication, and (h) administrative support. The research first decomposed the amount of variance attributable to the teacher level and the school level. Since there was a significant amount of variance at the school level, the next step was to determine if and how the above school process variables were associated with …

Important Or Impotent? Radical Right Political Parties And Public Policy In Germany And Austria, Marcella J. Myers Dec 2009

Important Or Impotent? Radical Right Political Parties And Public Policy In Germany And Austria, Marcella J. Myers

Dissertations

Across Western Europe throughout the 1990s radical right political parties emerged and gained some electoral success. Since that time, particularly in the face of the popularity of the National Front in France and the Freedom Party in Austria, many studies have been conducted examining the voting behavior, party membership and ideologies of these parties, and what the parties mean to democratic governments. Largely unexamined are the effects of radical right political parties on public policy. This study attempts to evaluate the effect of radical right parties on public policy by using a most similar, case study research design, relying heavily …

The Ethnic Identity Of Returning Immigrants To A Pueblo In Yucatan, David Piacenti

Dissertations

This study seeks to understand: 1) motivations for leaving and, if applicable, racialized, segregated environment, which is represented by the returned cholo, whose "urban gangbanger" mentality confronts the traditional, rural ethnic identity. San Francisco also affects the overall perception of immigration and desire for permanent U.S. residence. Of the San Francisco cohort, 42% say immigration is "positive overall." Conversely, 62% of the Kalamazoo cohort says that immigration is "positive overall." Only 29% of the San Francisco cohort desire permanent residence in the U.S. while 54% of the Kalamazoo cohort desire permanent U.S. residence. Therefore, the suburban context of Kalamazoo may …

Whores And Other Sex Slaves: Why The Equation Of Prostitution With Sex Trafficking In The William Wilberforce Reauthorization Act Of 2008 Promotes Gender Discrimination., Elizabeth Kaigh Dec 2009

Whores And Other Sex Slaves: Why The Equation Of Prostitution With Sex Trafficking In The William Wilberforce Reauthorization Act Of 2008 Promotes Gender Discrimination., Elizabeth Kaigh

The Scholar: St. Mary's Law Review on Race and Social Justice

Congress should vote to exclude the William Wilberforce Reauthorization Act from the Victims of Trafficking and Violence Protection Act (VTVPA).  The William Wilberforce Reauthorization Act concerns prostitution, whereas the VTVPA concerns human trafficking. Lawmakers dealing with sex trafficking and prostitution in the United States wrongly combine them as one unified activity. A significant difference between sex trafficking and prostitution concerns the consent of the women having sex. Nevertheless, it is unfair for states to strengthen prostitution laws on a federal level, which is what the William Wilberforce Reauthorization Act would do. The Act would effectively turn prostitution into a federal …

Review Of Browser Extensions, A Man-In-The-Browser Phishing Techniques Targeting Bank Customers, Nattakant Utakrit

Australian Information Security Management Conference

Initially, online scammers (phishers) used social engineering techniques to send emails to solicit personal information from customer in order to steal money from their Internet banking account. Data, such as passwords or bank account details, could be further used for other criminal activities. For instance, the scammers may intend to leave the victim’s information behind after they have successfully committed the crime so that the police can suspect the visible evidence as a suspicious criminal. Many customers are now aware of the need to protect their banking details from the phishers by not providing any sensitive information. Recently, phishing attacks …

The Role Of Pkc-Epsilon In Models Of Alcohol- And Toxin-Induced Liver Disease., J. Phillip Kaiser 1981-

Electronic Theses and Dissertations

Alcoholic liver disease (ALD) is a serious concern for the world's population. It is one of the leading causes of death and is also a huge economic burden. The biochemical mechanisms responsible for ALD are incompletely understood, therefore there is no FDA approved therapy to treat or reverse liver damage caused by alcohol exposure. Whereas the mechanisms behind ALD are poorly understood, the disease progression is well known. The first pathological step of ALD is steatosis followed by inflammation and necrosis; if the insult(s) responsible for the previous pathologies persists, fibrosis and cirrhosis can then develop. In previous experimental studies, …

The Del Rosa Youth Program, an outreach program sponsored by Del Rosa SDA Church, provides mentoring and religious programming for at-risk youth. In an effort to assist them in becoming more competitive for funding, the current project has reviewed the relevant literature and provided recommendations …

Hiding In Plain Sight? Timing And Transparency In The Administrative State, Anne Joseph O'Connell, Jacob Gersen Dec 2009

Hiding In Plain Sight? Timing And Transparency In The Administrative State, Anne Joseph O'Connell, Jacob Gersen

Public Law and Legal Theory Working Papers

Anecdotal evidence of agencies burying bad news is rife in law and politics. The bureaucracy regularly is accused of announcing controversial policies on holidays and weekends when public attention is elsewhere. We show that this conventional wisdom is wrong, or at least significantly incomplete. The conventional wisdom is riddled with theoretical holes, and there is little systematic empirical evidence to support it. After critiquing the conventional account of agencies hiding bad news, we articulate and defend a revised theory of strategic timing in administrative law. We argue that timing decisions rarely affect the visibility of decisions but can drive up …
