Intellectual Property Infringement: The Question Of Advertising Injury, Hilary Ditch Jan 2009

Intellectual Property Infringement: The Question Of Advertising Injury, Hilary Ditch

UC Law SF Communications and Entertainment Journal

Over the past several decades, business entities have increasingly relied on Commercial General Liability insurance for coverage and protection against the significant costs of defending against intellectual property lawsuits. However, despite this increased usage, the coverage provided for intellectual property infringement claims by Commercial General Liability insurance policies remains uncertain and indeterminate. This frustrating conclusion, reached by numerous courts, legal scholars and insurance practitioners, captures the current state of the law as it applies to coverage for intellectual property infringement claims. Consequently, many business entities seeking to apply their insurance policies to defend against intellectual property claims may face uncertainty …

The Primacy Of Consciousness: A Triple Aspect Ontology, Joseph Naimo Jan 2009

The Primacy Of Consciousness: A Triple Aspect Ontology, Joseph Naimo

Philosophy Books

Consciousness – What is it? How does it arise? These are perhaps the two most perplexing questions on the minds of researchers extending across a broad spectrum of disciplinary enquiry. Consider the interested disciplines of cognitive science notably psychology, philosophy, linguistics, quantum mechanics, artificial intelligence and the neurosciences. Cognitive science is the study of intelligence and intelligent systems. Cognitive science attempts to organize and unify views of thought as developed within these distinct disciplines (Sheedy & Chapman, 1995:ix). The concept of consciousness is in one sense readily recognized, putatively held to be that which makes humans different from the rest …

Empowerment Or Imposition? Dilemmas Of Local Ownership In Post-Conflict Peacebuilding Processes, Timothy A. Donais Jan 2009

Empowerment Or Imposition? Dilemmas Of Local Ownership In Post-Conflict Peacebuilding Processes, Timothy A. Donais

Global Studies Faculty Publications

This article examines questions of local ownership in post‐conflict peacebuilding and makes the case that the complex relationship between insiders and outsiders lies at the very heart of contemporary peacebuilding processes. While the discourse of local ownership has increasingly become part of the vocabulary of post‐conflict peacebuilding, the discussion to date on both the meanings and the practices of local ownership in peacebuilding contexts remains underdeveloped. This article is therefore an effort to add substance to the local ownership debate, and outlines two forms of peacebuilding—liberal and communitarian—which contain markedly different assumptions concerning the role of local actors in peacebuilding …

The Number Of States And The Economics Of American Federalism, Steven G. Calabresi, Nicholas K. Terrell Jan 2009

The Number Of States And The Economics Of American Federalism, Steven G. Calabresi, Nicholas K. Terrell

Faculty Working Papers

In 1789 it was possible to speak of a federation of distinct States joined together for their mutual advantage, but today it is rather the Nation that is divided into subnational units. What caused this shift in focus from the States to the Federal Government? Surely the transformation from a collection of thirteen historically separate States clustered along the Atlantic seaboard to a group of fifty States largely carved out of Federal territory has played a role. Building on previous analysis of the economics of federalism, this essay considers the dynamic effects of increasing the number of states on the …

Culturally Identifying The Performance Practices Of Astor Piazzolla's Second Quinteto, Kacey Quin Link Jan 2009

Culturally Identifying The Performance Practices Of Astor Piazzolla's Second Quinteto, Kacey Quin Link

Open Access Theses

Astor Piazzolla (1921-1992) captivated Argentine and international audiences with his innovative works in a nuevo tango style and his bandoneón performances. Piazzolla?s success culminated during the 1980s with his second Quinteto, which performed remarkable concerts in venues such as the Teatro Colón in Buenos Aires and the Central Park Bandshell in New York, in addition to the performances at the Montreal and Montreux Jazz Festivals. His music also grew popular with a plethora of internationally acclaimed classical and jazz artists as well as with Argentine musicians themselves. However, Piazzolla?s music poses a challenge today, because nuevo tango represents a synthesis …

Films On Paper: Adaptation Of Eileen Chang's Novels, Funing Tang

Open Access Theses

Eileen Chang (1920-1995), a legendary female writer in Chinese literature history, lived in the most turbulent time of contemporary China. Her works are all about love. Her characters are all insignificant people, unrealistically invested with illusory dreams of life, but meanwhile, absorbed by worldly pursuits and pleasures. And her tone is desolate. People worship her, both as a great writer and as a mysterious woman. From 1980s, the fascination with her and her literature overtly announces itself in Chinese language cinema. Several critically acclaimed directors have intended to adapt her aura and charisma through adapting her literature. But, the result …

The Third Nation: A Project Of National Identity Formation In Bolivia, Sandra Vanessa Bernal Heredia Jan 2009

The Third Nation: A Project Of National Identity Formation In Bolivia, Sandra Vanessa Bernal Heredia

Open Access Theses

Over the past decade, well-organized mobilizations have brought groups of Bolivian miners, urban workers, farmers, and especially indigenous peoples together in identification with and response to the rhetoric of indigenous self-recognition. These events culminated in the election of Evo Morales in 2005 as the country's first indigenous president. The contemporary resurgence of indigeneity has been perceived by many as either revolutionary or apocalyptic. My thesis examines why a country with an indigenous population of some 80%, has now decided to politically voice their indigeneity after years of silence. My paper begins with an analysis of the history of indigenous peoples …

The Salta Trilogy Of Lucrecia Martel, Oscar Jubis Jan 2009

The Salta Trilogy Of Lucrecia Martel, Oscar Jubis

Open Access Theses

During the past decade, Lucrecia Martel has emerged as the most respected filmmaker from South America. This thesis is motivated by my conviction that Martel's films are worthy of serious engagement and critical scrutiny. It is also motivated by my curiosity about the seemingly inexhaustible pleasure and edification I derive from them. Martel describes her filmmaking as "cine de autor" (auteur cinema). Indeed, her films evidence a personal involvement in every aspect of filmmaking. This thesis will define and explore the characteristics and conditions of her authorship. This thesis constitutes an expression of the enduring usefulness of auteurist criticism. In …

A Time To Define: Making The Specific Learning Disability Definition Prescribe Specific Learning Disability, Kenneth A. Kavale, Lucinda S, Spaulding, Andrea P. Beam

Faculty Publications and Presentations

Unlike other special education categories defined in U.S. law (Individuals with Disabilities Education Act), the definition of specific learning disability (SLD) has not changed since first proposed in 1968. Thus, although the operational definition of SLD has responded to new knowledge and understanding about the construct, the formal definition has remained static for 40 years, creating a schism between theory and practice. Using concepts gleaned from the scientific study of formal and operational definitions as well as the history of another special education category (i.e., mental retardation), in this article we demonstrate why change in the SLD definition is necessary. …
