The Effects Of Liberalization On Litigation: Notes Toward A Theory In The Context Of Japan, Tom Ginsburg Jan 2009

The Effects Of Liberalization On Litigation: Notes Toward A Theory In The Context Of Japan, Tom Ginsburg

Articles

This Essay examines the under-studied relationship between liberalization and litigation. Liberalization should lead to expanded civil litigation for four reasons: (1) new market entrants are less subject to informal sanctions and may have a greater propensity to go to court; (2) privatization transfers resources away from the state, expanding the number of transactions subject to civil law regimes; (3) liberalization reduces the government’s ability to resolve disputes outside the courts; and (4) liberalization leads to economic development, which is generally litigation-enhancing. We test these propositions using a unique dataset of prefecture-level civil litigation data in Japan during the 1990s. Using …

Expanding Rural Elder Care Options: Models That Work, Peter Fitzgerald Msc, Andrew F. Coburn Phd, Sharon K. Dwyer Ms

Population Health & Health Policy

Rural communities and elders need better access to elder care options that enable them to continue to live in the community. Despite a larger proportion of the population over age 65 than urban and suburban America, rural communities lack the services and care coordination systems older adults need to continue living independently in their own communities as they age.

In November 2008, the Rural Long Term Care Workgroup convened a national Rural Long Term Care: Access and Options Workshop to identify lessons and strategies for building and sustaining rural community-based elder care services. Finding and building on successful models is …

Solidifying The Defensive Line: The Nfl Network's Current Position Under Antitrust Law And How It Can Be Improved, Ethan Flatt

Vanderbilt Journal of Entertainment & Technology Law

In the United States, the broadcasting of professional sporting events is a multi-billion dollar industry, and the National Football League (NFL) alone earned more than $3 billion from television contracts during its 2008 season. Considering the massive revenues that broadcast rights can generate, it is no surprise that some major professional sports leagues have recently developed their own television networks. While it was not the first league-owned television network, the NFL Network has certainly generated the most attention. Since it started broadcasting a select number of NFL regular season games in 2006, the NFL Network has been subject to media …

Eliminating The Secondary Earner Bias: Lessons From Malaysia, The United Kingdom, And Ireland, Tonya Major Gauff Jan 2009

Eliminating The Secondary Earner Bias: Lessons From Malaysia, The United Kingdom, And Ireland, Tonya Major Gauff

Northwestern Journal of Law & Social Policy

This Student Comment explores the long-standing gender bias inherent in the United States Internal Revenue Code ("IRC"). Specifically, this Comment discusses the bias of the taxing code against secondary earners in dual-income families. Under the IRC, primary earners in a dual-income household are taxed at a much lower rate than secondary earners in the household. As women have historically suffered from lower wages and income than their husbands, the effect of the IRC is to tax married women at much higher rates than married men. Indeed, the average working married woman loses over two-thirds of her pay to income taxes. …

100 Years Strong: Southern Minnesota Regional Legal Services And The On-Going Pursuit For Equal Rights And Equal Justice, Tom I. Romero

Sturm College of Law: Faculty Scholarship

As the lead essay in the Hamline Journal of Public Law and Policy's symposium issue on "Barriers to Justice: Responding to the Needs of the Low-Income Population in America," our essay provides a narrative account of the history of legal aid in Minnesota. From its humble origins in the basement of a mutual aid society in 1909 to the recent broad based community-lawyering programs for immigrants, the disabled, and those families who were hurt by predatory lending practices at the start of the 21st century, this is an "insiders" legal history concerning the values, people, and public private collaborative practices …

Pro Bono Publico In A Parallel Universe: The Meaning Of Pro Bono In Solo And Small Law Firms, Leslie C. Levin Jan 2009

Pro Bono Publico In A Parallel Universe: The Meaning Of Pro Bono In Solo And Small Law Firms, Leslie C. Levin

Hofstra Law Review

This article looks at pro bono and "low bono" (reduced fee) work in the solo and small firm law firm context, compares it to the large firm experience, and considers the implications for access to justice in the U.S. It starts by describing the significant differences between pro bono as performed in large firms and in solo and small firms. It then describes the history and bar politics that led to ABA Model Rule 6.1, which reflects the elite (i.e., large law firm) views of pro bono, and seemingly devalues the pro bono work that solo and small firm lawyers …
