Attorney-Client Fee Agreements That Offend Public Policy, Alex B. Long Jan 2009

Attorney-Client Fee Agreements That Offend Public Policy, Alex B. Long

Scholarly Works

Under traditional contract law principles, an agreement may be deemed unenforceable because it so clearly offends established public policy that recovery under the contract is inappropriate. In such cases, there has traditionally been a presumption against permitting the offending party to recover, either under the contract or in quantum meruit. Yet, the legal profession (through the Restatement of the Law Governing Lawyers) and the courts (through their decisions) have effectively reversed that presumption and have announced a general rule in favor of permitting lawyers to recover fees even when their fee agreements clearly offend well-established and strong public policy. Moreover, …

Occupational Health And Safety Status Of Indigenous And Latino Farmworkers In Oregon, Stephanie Farquhar, Nancy M. Goff, Nargess Shadbeh, Julie Samples, Santiago Ventura, Valentin Sanchez, Pamela Rao, Shelley Davis Jan 2009

Occupational Health And Safety Status Of Indigenous And Latino Farmworkers In Oregon, Stephanie Farquhar, Nancy M. Goff, Nargess Shadbeh, Julie Samples, Santiago Ventura, Valentin Sanchez, Pamela Rao, Shelley Davis

Community Health Faculty Publications and Presentations

Exposure to pesticides poses great risk to agricultural workers and their families. Of the approximately 174,000 agricultural workers in Oregon, studies estimate that up to 40% of the workers in Oregon are indigenous and may be particularly vulnerable to the health risks of working in pesticide treated areas. Surveys conducted with Oregon farmworkers suggest that Latino and indigenous farmworkers differ demographically and may have diverse occupational and health needs. All Latino workers reported Spanish as their native language, while indigenous workers spoke several different native languages. Latino workers were employed mostly in orchards (28%) and nurseries (24%), while indigenous workers …

Społeczna Odpowiedzialność Biznesu. Wymiar Konstytucyjny I Międzynarodowy, Maciej Bernatt Jan 2009

Społeczna Odpowiedzialność Biznesu. Wymiar Konstytucyjny I Międzynarodowy, Maciej Bernatt

Monografie CARS/CARS Monographs

Global Conventions Go Local: A Human Rights Movement In New York City, Yalidy M. Matos

Gender, Sexuality, and Intersectionality Studies Honors Papers

The United Nations (UN) has a multitude of global conventions and treaties in which its members states can choose to sign and ratify. Two of those treaties are CERD, the International Convention on the Elimination of Racial Discrimination, adopted in 1966; and CEDAW, the Convention on the Elimination of all forms of Discrimination Against Women, adopted in 1979. Throughout the world, almost all UN member states have ratified CERD; however, all but a few minority states have ratified CEDAW. Amongst those few minorities is the United States. Although the U.S. has decided not to ratify CEDAW, there are various localities, …

Aggregate Litigation Across The Atlantic And The Future Of American Exceptionalism, Richard A. Nagareda Jan 2009

Aggregate Litigation Across The Atlantic And The Future Of American Exceptionalism, Richard A. Nagareda

Vanderbilt Law Review

In long-running debates over civil justice reform, two points remain broadly shared: the legal regime for civil litigation in this country is exceptional by comparison to European systems as a positive matter, and the United States is much the worse for it in normative terms. The positive dimension of this account pinpoints several exceptional features of the U.S. civil justice system: class actions, primarily on an opt-out basis; contingency-fee financing of litigation; rejection of Euro-style "loser-pays" rules that link responsibility for the fees of both sides to the outcome of the litigation; extensive reliance on juries as fact finders; costly …
