The current financial turmoil shaking the world illustrates the connectedness of national markets and economies. Legal practice is no exception: lawyers and their firms are experiencing the upheaval along with their clients.1 This has resulted in new opportunities for lawyers and firms–in bankruptcy and restructuring and, likely in the future, in regulatory advising as well–and, at the same time, in substantial challenges. The promise of benefits from a diversified practice–in terms of both substance and geography–is being tested as lawyers and law firms follow their clients through the uncertainties of the current economic conditions.

Journal of Dispute Resolution

The purpose of this Bill is to provide notice to owners of residential real property owners that mediation with the mortgagee is an option at the onset of foreclosure proceedings. The Bill changes the mechanism by which borrowers are notified of foreclosures; instead of receiving a writ and summons, borrowers receive a notice of mediation, a foreclosure mediation certificate, and a blank appearance form. Borrowers still receive the writ, summons, and complaint, however. The lender must appear at the mediation with the authority to approve a proposed settlement in order to receive a remedy, and no attorney's fees will be …

Law schools across the county can significantly contribute to improving the public’s access to the justice system. Improving the public’s access to the justice system helps to ensure that equal justice is enjoyed by all classes of people. One way to provide equal justice to all is through a cooperative effort among academia, courts, and practitioners. A prime example of one such cooperative effort is that of the Southern Illinois University School of Law and the First Judicial Circuit of Illinois, which collaborated to create the First Judicial Circuit Court-Referred Family Mediation Program. This case study focuses on the transformational leadership style used by Nelson Mandela. Transformation leadership is a theory championed by James MacGregor Burns, who originally coined the term, and Bernard M. Bass (1990). In addition to transformational leadership, the study includes theories from other prominent individuals who have contributed to the study of Mandela's leadership. This research underscores how Nelson Mandela, an anti-apartheid activist who became president of South Africa, played a leading role in bringing his country from a racially divided society to a free democratic society. Health Policy and Management Faculty Publications

This policy brief presents options for financing and delivering case management services to low-income and special-needs children in Medicaid. The analysis builds on a literature review of case management, a review of the legal underpinnings of Medicaid case management, and consultation with experts in the fields of health care finance and program operations. It aims to inform the policy community about the importance of case management for assuring the health and development of our youngest and most vulnerable children.

Facilitating Access To Dispute Settlement For African Members Of The For African Members Of The World Trade Organization, Michelle Sanson

Indian Journal of International Economic Law

The reasons why African Member States have not pursued a single formal complaint since the inception of the WTO legal system are complex and multilayered. They may be characterised as four key barriers: first, the significant cost and high levels of expertise in law and economics required; second, the lack of appropriate domestic mechanisms such as legislation implementing WTO law, procedures for receipt and investigation of complaints, and avenues for raising industry awareness; third, the inadequate remedy of trade sanctions under the dispute settlement mechanism; and fourth, issues of politics, arising from the power imbalance between donor and donee nations, …

This dissertation analyzes the liberalization of legal education and training in East Africa. It explores avenues for developing a legal education policy that addresses various problems with regard to the quality of law graduates and of legal services in the market place currently available given the large number of law graduates entering the professional field each year.

The legal systems in Kenya, Tanzania and Uganda to a large extent follow the Common Law theories and practices of English Law. The three countries also share a history in the establishment of law schools and they face similar problems and challenges with …
