Predicting how technology will affect the future of the legal profession is difficult and unreliable work. I have made my share of such predictions in the past thirty years, including foretelling the death of the paper casebook in law schools and vast improvements in law practice that would be triggered by computers and document assembly software. Neither of these two prophesies has yet been fulfilled. Yet a real success story has emerged based in part on my persistent optimism that technology can improve the delivery of legal services. American Bar Association: Summary Of Ethics Rules Governing Collaborative Practice

The purpose of this paper is to address ethical issues considered in the above-mentioned opinions, including: (1) limited scope representation, informed consent, and restriction on practice; (2) conflict of interests; (3) competence and diligence; (4) mandatory withdrawal provisions, including withdrawal due to client behavior and withdrawal requiring the court's permission; (5) zealous representation; (6) confidentiality and disclosure; (7) communications and advertising; and (8) collaborative non-profit organizations. This Article shows that, for the reasons set forth below, Collaborative Practice is consistent with the rules of ethics for lawyers and provides an important method for clients and attorneys to achieve fair settlements …

Boumediene’S Quiet Theory: Access To Courts And The Separation Of Powers., Stephen I. Vladeck

At the core of Justice Kennedy's majority opinion in Boumediene v. Bush are his repeated suggestions that habeas corpus is an integral aspect of the separation of powers, and that, as such, the writ remains relevant even when the individual rights of those who would seek its protections are unclear. And whereas some might view these passages as little more than rhetorical flourishes, it is difficult to understand the crux of Kennedy's analysis - of why the review available to the Guantanamo detainees failed to provide an adequate alternative to habeas corpus - without understanding the significance of his separation-of-powers …

Teacher Compensation And The Academic Achievement Of Elementary Students, Doug Arnold

This study examined Missouri Assessment Program achievement scores and teacher salaries to determine if a correlation existed. Student achievement scores and teacher salaries were obtained from the Missouri Department of Elementary and Secondary Education for the 2006-2007 school year. Analysis of the data indicated there was a significant correlation between student achievement as measured by the Missouri Assessment Program and teacher salaries. This study is part of a companion project. The researchers collaborated on the research portion of this study. The researchers shared common goals, defined their roles in the review of literature and coordinated efforts to produce this project. …

'Once Upon A Time, In A Land Far, Far Away...' Lawyers And Clients Telling Stories About Ethics (And Everything Else), Carolyn Grose

UC Law SF Journal on Gender and Justice

Framed by an analysis of two particular ethical rules and their application to specific situations, this piece uses the metaphor of storytelling to explore the lawyer's role as an effective and ethical client representative. Drawing from the experiences of two sets of clients and their lawyers, the piece proposes an approach to ethical regulation (as one component of the lawyer-client relationship) that requires the lawyer to engage in a deeply contextual analysis of the specific and particular ethical conflicts presented to him in any particular case; and work with his client to determine how to resolve those conflicts.

In 2006, the Canadian Forum on Civil justice conducted the Self-Represented Litigant (SRL) Mapping Project. This Project aimed to gain a better understanding about SRLs in Alberta, what their legal needs are and what resources are available to them. Mapping for this project was conducted in three sites; Grand Prairie, Red Deer and Edmonton. Findings from this Project were strongly indicative of the lack of public understanding of the justice system and the need for easily accessible public legal information. Based on the recommendations from the SRL Mapping Project, Law Information Centres (LInCs) were established in all three jurisdictions.

My purpose in this commentary is twofold. First, I want to offer a few thoughts on why the American medical profession sometimes has a hard time accepting law on its own terms. Second, I want to suggest that even “good law” from the perspective of the medical profession—should it overcome its habits of resistance—may still be bad health policy for the United States.

Lessons From The Laboratory: The Polar Opposites On The Public Sector Labor Law Spectrum, Ann C. Hodges

Section I analyzes the legal framework and history of collective bargaining in Illinois, and Section II follows with a similar analysis for Virginia. Each section includes current data about public sector employees and union activity in the two states. Section III follows with a discussion of possible explanations for the differences in the law of the two states. Section IV looks at the lessons from this analysis for state and federal lawmakers, unions, employers, and labor relations advocacy groups.

This article reviews developments in transnational legal practice during 2006 and 2007, including international developments, U.S. developments and regional developments in Australia and Europe. The primary focus of the international developments section is the WTO's General Agreement on Trade in Services (GATS). This article discusses GATS Track 1 Activities related to legal services, including the Legal Services Collective Requests and issues related to GATS Track 2 and the potential development of GATS disciplines. See No Evil: Applying A Labor Lens To Prostitute Organizing, Monica R. Moukalif

UC Law SF Journal on Gender and Justice

This Note examines labor organizing efforts of marginalized labor and, based on that examination, formulates a theory of what the author call "margins-organizing." It then applies that theory to the labor organizing efforts of sex workers. It argues that whatever one's feelings are about sex work itself, the separate work of labor organizing is as similar to and as valid as that of other marginalized workers. The hope is that by bringing sex workers within the margins-organizing lens, that group will be better able to form ties with, learn from, and teach other marginalized labor groups. This Article explores rules of professional responsibility, theory, and reasoning processes related to advising clients to seek mental health treatment. Furthermore, this Article looks at cultural and financial aspects of treatment, and concludes with recommendations on how a lawyer should counsel her client once she determines that mental health treatment is appropriate. Collateral Children: Consequence And Illegality At The Intersection Of Foster Care And Child Support, Daniel L. Hatcher

This Article is the third in a series addressing the conflict between state revenue maximization strategies and the missions of state agencies serving low-income children. The Article examines the policy of foster care cost recovery through child support enforcement. When children are removed from poor families and placed in foster care, federal law requires child welfare agencies to initiate child support obligations against the parents. Resulting payments do not benefit the children but are converted into a government funding stream to reimburse the costs of foster care. This cost recovery effort often subordinates the child welfare system’s primary goals of …
