Facilitating Access To Dispute Settlement Facilitating Access To Dispute Settlement For African Members Of The For African Members Of The World Trade Organization, Michelle Sanson

Indian Journal of International Economic Law

The reasons why African Member States have not pursued a single formal complaint since the inception of the WTO legal system are complex and multilayered. They may be characterised as four key barriers: first, the significant cost and high levels of expertise in law and economics required; second, the lack of appropriate domestic mechanisms such as legislation implementing WTO law, procedures for receipt and investigation of complaints, and avenues for raising industry awareness; third, the inadequate remedy of trade sanctions under the dispute settlement mechanism; and fourth, issues of politics, arising from the power imbalance between donor and donee nations, …

Eighth Circuit Loosens The Grip Of The Bankruptcy Gag Rule, But Holds Attorneys To Advertising Disclosure Requirement, The, Bethany R. Findley

Missouri Law Review

The Court of Appeals for the Eighth Circuit, in a case of first impression, struck down a provision of the 2005 bankruptcy reform law that prohibits attorneys from advising their clients to incur more debt in contemplation of filing for bankruptcy. At the same time, the court upheld a provision of the Bankruptcy Code that compels attorneys to include a specified disclosure within their bankruptcy-related advertisements. The court's rationale for striking down the Code's restriction on attorney advice was that its broad application restricted attorneys from rendering advice that in some situations would be entirely lawful and beneficial to their …

If Not Eea State Liability, Then What? Reflections Ten Years After The Efta Court's Sveinbjörnsdóttir Ruling, Carl Baudenbacher

Chicago Journal of International Law

On the basis of this comparison, the ECJ concluded that identical wording of EC and EEA law was no guarantee of homogeneity. Since there were no other mechanisms that would secure homogeneity, the ECJ did not consider the fundamental principles of direct effect and primacy to be safeguarded. On the contrary, it assumed that these principles were "irreconcilable with the characteristics of the [EEA] agreement." The final conclusion was therefore that "the divergences which exist between the aims and context of the agreement, on the one hand, and the aims and context of Community law, on the other, stand in …

Ethical Issues Concerning The Experience Of Representational Predicaments At Work, Robin Stanley Snell, Mei Ling, May Wong, Suk Kwan, Sandy Hui Jun 2009

Ethical Issues Concerning The Experience Of Representational Predicaments At Work, Robin Stanley Snell, Mei Ling, May Wong, Suk Kwan, Sandy Hui

Hong Kong Institute of Business Studies Working Paper Series

Representational predicaments refer to situations in which job incumbents believe that dominant authorities are holding incomplete or otherwise incorrect work-related assumptions about them. We carried out qualitative interviews with a diverse and gender-balanced sample of 55 Hong Kong Chinese job incumbents, from whose perspective we identified three broad categories of representational predicament: (1) doing unvalued work; (2) doing thankless work; and (3) being subject to distorted representation. Each category of representational predicament was reported both by female and male informants, with females reporting more representational predicaments than males. Stories of unvalued work referred either to unnoticed and unvalued work, which …

Parent Education Programs: Review Of The Literature And Annotated Bibliography, Barbara A. Babb, Gloria Danziger, Judith D. Moran, Itta Englander

All Faculty Scholarship

Court-connected parent education programs are an integral family service component in most of the nation’s family courts. These programs are implemented to enable the courts to respond efficiently and effectively to the proliferation of cases involving separation, divorce, and related issues such as child custody and access (Sigal, Sandler, Wolchik, and Braver, 2008; Pollet and Lombreglia, 2008; McIntosh and Deacon-Wood, 2003). Since 2007, parent education classes are mandatory in forty-six states (Pollet and Lombreglia, 2008). In Maryland, every court with jurisdiction over divorce and child custody matters utilizes some form of parent education.

The findings discussed in this literature review …

Behind The Fan: Conservative Activists In The New Orleans Christian Woman's Exchange, 1881-1891, Gabrielle Walker

LSU New Orleans Theses and Dissertations

In 1881, Margaret Bartlett of New Orleans crafted the Christian Woman's Exchange using the New York Exchange chapter as a model. Bartlett hoped this new organization would help alleviate at least some of the economic suffering "reduced gentlewomen"faced. Despite the Exchange's original mission to help the elite, the group soon crossed class and racial boundaries in a campaign of conservative activism. The Christian Woman's Exchange helped women provide for their families by training them to produce homemade goods for sale in consignment shops. Simultaneously, working-class women found employment within the Christian Woman's Exchange lunch room and other business ventures. Since …

Nowhere To Go: How Stigma Limits The Options Of Female Drug Users After Release From Jail, Juliana Van Olphen, Michele J. Eliason, Nicholas Freudenberg, Nicholas Freudenberg

Publications and Research

Background Drug and alcohol using women leaving prison or jail face many challenges to successful re-integration in the community and are severely hampered in their efforts by the stigma of drug or alcohol use compounded by the stigma of incarceration. Methods This qualitative study is based on individual semi-structured interviews and focus groups with 17 women who had recently left jail about the challenges they faced on reentry. Results Our analysis identified three major themes, which are related by the overarching influence of stigma: survival (jobs and housing), access to treatment services, and family and community reintegration. Conclusion Stigma based …
