Climate Change And Sustainable Development: The Quest For Green Communities, Part I, John R. Nolon Oct 2009

Climate Change And Sustainable Development: The Quest For Green Communities, Part I, John R. Nolon

Elisabeth Haub School of Law Faculty Publications

This is the first of two commentaries that explore the role of local governments in mitigating and adapting to climate change through sustainable development strategies. They focus on the significant authority to regulate land use and building construction that is delegated to local governments by their states, and how that authority can be coordinated with the roles and responsibilities of state and federal governments to manage climate change and achieve sustainable development.

[2009 Undergraduate Prize Winner]

Brazil serves as a potent example of a nation striving to meet the public healthcare needs of a complex and diverse society. To evaluate how a public hospital in Montes Claros, Brazil has attempted to reconcile HIV/AIDS outcome gaps, this study examined aspects of the demographic profi les of public health clients receiving HIV exams in the largest city in Northern Minas Gerais at two respective sites. Age, sex, and residential neighborhood for clients tested for HIV during an eight month period in 2007-2008 at HUCF and CTA were statistically compared. In comparison to CTA, the …

Preserving And Providing Access To Digital State Publications In Alabama: A Case Of Cooperation, Rickey Best Oct 2009

Preserving And Providing Access To Digital State Publications In Alabama: A Case Of Cooperation, Rickey Best

The Southeastern Librarian

As initiatives to achieve a more interactive web-format for government information expand, concerns continue to mount over data security and preservation. While efforts to address these issues are ongoing at the federal level, at the state and local levels there continues to be gaps between state and local agencies creating digital publications and services and ensuring the long-term preservation of those publications. The nature of government information on theWeb also presents challenges. Some information is generated from databases (often federal) which pull together information and make it readily available. Such data, such as the Alabama’s agricultural statistics, are actually derived …

An Innovative Approach For Creating A Self-Guided Video Tour In An Academic Library, John H. Sandy, Mangala Krishnamurthy, Wayne Rau Oct 2009

An Innovative Approach For Creating A Self-Guided Video Tour In An Academic Library, John H. Sandy, Mangala Krishnamurthy, Wayne Rau

The Southeastern Librarian

Millions of students visit academic libraries each year, hoping to achieve success in the classroom and make progress with their research. Many of these students need help in navigating the complex services, collections, and facilities of a large academic library. Librarians often respond to this need by offering in-person orientation tours. However, with this approach, library personnel are unable to reach all who need assistance. Furthermore, the schedules of busy students and busy librarians do not always coincide, and students may prefer to learn about the library in a more flexible, self-paced fashion. It’s known that in-person tours are a …

Information Needs In A Hurricane Gustav Evacuation Shelter: Reflections On A Librarian’S Volunteer Experience, Donna Braquet Oct 2009

Information Needs In A Hurricane Gustav Evacuation Shelter: Reflections On A Librarian’S Volunteer Experience, Donna Braquet

The Southeastern Librarian

For three years following Hurricanes Katrina and Rita, residents of the Gulf Coast enjoyed a reprieve from serious threats. But in 2008 Hurricanes Gustav and Ike confirmed that massive evacuations are now a reality of hurricane season. A consequence of such large evacuations is the establishment of hundreds of shelters across the country. Opportunities exist to improve information assistance and information dissemination in hurricane shelters. Information professionals can help by conducting research and documenting their experiences in shelters. This article discusses observations of evacuees’ information needs at a Hurricane Gustav shelter in Knoxville, Tennessee, and details the resources and methods …

Incentives For Surveillance Of Infections Disease Outbreaks, Anup Malani, Ramanan Laxminarayan Oct 2009

Incentives For Surveillance Of Infections Disease Outbreaks, Anup Malani, Ramanan Laxminarayan

Coase-Sandor Institute for Law & Economics Research Paper Series

This paper examines the incentives for countries to report disease outbreaks such as swine flu, avian flu and SARS to the international community. Even cursory analysis suggests countries have conflicting incentives regarding whether to report an outbreak. Reporting an outbreak may bring medical assistance, but also trigger trade sanctions to contain an outbreak. Modeling the decision as a signaling game where a country has private but imperfect evidence of an outbreak provides additional insights. First, not all sanctions discourage reporting. Sanctions based on fears of an undetected outbreak (false negatives) encourage disclosure by reducing the relative cost of sanctions that …

Liability For Future Harm, Ariel Porat, Alex Stein Oct 2009

Liability For Future Harm, Ariel Porat, Alex Stein

Coase-Sandor Institute for Law & Economics Research Paper Series

This Article considers the possibility of imposing liability in torts for a wrongfully created risk of future harm. We examine the American and English court decisions pertaining to this issue and consider whether a probability-based compensation for the victim's expected—albeit not yet materialized—harm is just and efficient. We demonstrate how the virtues of a legal regime that allows a tort victim to recover compensation for her expected harm overshadow its vices. We conclude that a person's risk of sustaining harm in the future should be actionable whenever the risk is substantial. We further conclude that it should be left to …

One-Way Contracts: Consumer Protection Without Law, Omri Ben-Shahar Oct 2009

One-Way Contracts: Consumer Protection Without Law, Omri Ben-Shahar

Coase-Sandor Institute for Law & Economics Research Paper Series

What if consumer contracts were legally enforceable only against the consumers, but not against the business? This paper, part of my project on the "myths of consumer protection," describes a regime of "one-way contracts"— contracts between consumers and business to which only consumers are bound, the business is not. A breaching business would face no contractual liability. The paper argues that many consumer contracts are already disguised one-way contracts. It then demonstrates the variety of alternative consumer protections devices that would emerge in the total absence of legal protection. In a one-way contracts world, transactions will be redesigned to limit …

The Standard Of Review Does Matter: Evidence Of Judicial Self-Restraint In The Illinois Appellate Court, Timothy J. Storm Oct 2009

The Standard Of Review Does Matter: Evidence Of Judicial Self-Restraint In The Illinois Appellate Court, Timothy J. Storm

Southern Illinois University Law Journal

The level of review that an appellate court grants to a lower court’s decision, expressed as the standard of review, is usually treated as a merely procedural and often unimportant matter. However, standards of appellate review actually serve a vital role in limiting the power of reviewing courts so as to maintain the proper balance between courts at various levels of the judicial system.
An appellate system without such standards would effectively subject every case to a boundless review process amounting to a new trial for every issue, thereby extending the duration and cost of litigation. On the other hand, …

5523 St. Claude Avenue: Bringing Fresh Food To The Lower Ninth Ward, Department Of Planning & Urban Studies, University Of New Orleans, Kellstadt Graduate School Of Business, Depaul University, School Of Architecture, Louisiana State University

Planning and Urban Studies Reports and Presentations

In order to address the lack of a fresh food retailer in the Lower Ninth Ward, a need that has been repeatedly expressed in a variety of community meetings and plans, we propose thedevelopment of a grocery store on the 5523 block of St. Claude Avenue. This site sits in a city-designated Housing Opportunity Zone and is strategically located on a major commercial corridor that is accessible by public transit. It is also at the center of a variety of public and non-profit foundation investments in the neighborhood.

This is Old Dominion University's 10th annual State of the Region report. While it represents the work of many people connected in various ways to the university, the report does not constitute an official viewpoint of Old Dominion or it's president, John R. Broderick. The report maintains the goal of stimulating thought and discussion that ultimately will make Hampton Roads an even better place to live. We are proud of our region's many successes, but realize that it is possible to improve our performance. In order to do so, we must have accurate information about "where we are" and a …

Egfr May Couple Moderate Alcohol Consumption To Increased Breast Cancer Risk, Christopher P. Mill, Julia Chester, David J. Riese Ii Oct 2009

Egfr May Couple Moderate Alcohol Consumption To Increased Breast Cancer Risk, Christopher P. Mill, Julia Chester, David J. Riese Ii

Department of Psychological Sciences Faculty Publications

Alcohol consumption is an established risk factor for breast cancer. Nonetheless, the mechanism by which alcohol contributes to breast tumor initiation or progression has yet to be definitively established. Studies using cultured human tumor cell lines have identified signaling molecules that may contribute to the effects of alcohol, including reactive oxygen species and other ethanol metabolites, matrix metalloproteases, the ErbB2/Her2/Neu receptor tyrosine kinase, cytoplasmic protein kinases, adenylate cyclase, E-cadherins, estrogen receptor, and a variety of transcription factors. Emerging data suggest that the epidermal growth factor receptor (EGFR) tyrosine kinase may contribute to breast cancer genesis and progression. Here we integrate …

Donnie Darko And The Messianic Motif, Kevin V. Dodd Oct 2009

Donnie Darko And The Messianic Motif, Kevin V. Dodd

Journal of Religion & Film

Savior or deliverer movies are a staple in today’s theaters. Often they are action/adventure films where they tend to substitute action for character development. In the first background section I will use an ancient Hindu epic to demonstrate that this is by no means novel. But there have also been richer films that are psychologically, religiously, and often politically, savvy. Many have been examined in this journal, including Cool Hand Luke, One Flew Over the Cuckoo’s Nest, and the highly provocative Breaking the Waves. The last especially points to a particular category of savior film, the Messianic, …

State-Created Property And Due Process Of Law: Filling The Void Left By Engquist V. Oregon Department Of Agriculture, Michael Wells, Alice Snedeker Oct 2009

State-Created Property And Due Process Of Law: Filling The Void Left By Engquist V. Oregon Department Of Agriculture, Michael Wells, Alice Snedeker

Scholarly Works

Several years ago, in Village of Willowbrook v. Olech, the Supreme Court recognized a 'class-of-one' Equal Protection theory, under which individuals charging that they were singled out for arbitrary treatment by officials may sue for vindication. Last term, in Engquist v. Oregon Department of Agriculture, the Court barred recourse to this type of claim on the part of government employees. The reasoning of Engquist, which emphasizes the discretionary nature of employment decisions, threatens to eliminate a wide range of class-of-one claims outside the employment area as well. There is a pressing need for an alternative. This article proposes another basis …

Applying The Service Profit Chain To The Gaming Industry, Emphasizing On Table Games Dealers, In Las Vegas, David Lee

UNLV Theses, Dissertations, Professional Papers, and Capstones

Gaming has been a significant part of the tourism industry in Las Vegas. Most gamblers come to Las Vegas hoping to win big, but are often disappointed. So what keeps people coming back time and again to contribute to Las Vegas’ economy? The casinos and the gaming industry believe that the unique and individual service guests experience at their establishment is the primary reason why guests return. For example, at Harrah's employees are upbeat and positive in an effort to keep customers returning; at the Venetian the core value instilled in each and every employee is to provide un-matched guest …

Department of Pathology, Anatomy, and Cell Biology Faculty Papers

Context: Simple tandem repeat loci are used to track bone marrow engraftment using mononuclear buffy coat cells and T-cells. Poor isolation purity of these subpopulations can result in lower analytical sensitivity of the bone marrow engraftment assay by diluting the cell population in question with other nucleated cells. Validation of the mononuclear cell preparation can be performed by flow cytometry or by counting cell populations on the slide. Conclusions: Our results show that the purity of the Histopaque-1077 mononuclear cell preparation is excellent and that morphology may be sufficient to validate the mononuclear cell isolation method if flow cytometry is …
