Proceeding With (Pre)Caution: Environmental Principles As Interpretive Tools In Applications For Pre-Trial Injunctions, Heather Mcleod-Kilmurray Oct 2009

Proceeding With (Pre)Caution: Environmental Principles As Interpretive Tools In Applications For Pre-Trial Injunctions, Heather Mcleod-Kilmurray

Dalhousie Law Journal

In many cases of imminent environmental harm, a trial may take years. To prevent harm in the meantime, pre-trial injunctions are essential. The author highlights the important role of interlocutory injunctions in Canadian environmental litigation, uncovers the judicial assumptions and attitudes toward the environment which these decisions reveal, and proposes a precautionary approach to interpreting the interlocutory injunction test in environmental cases. She argues that prevailing judicial attitudes and presumptions in relation to environmental claims often negatively influence how the discretionary elements in procedural rules governing pre-trial injunctions are applied. Although there has been much analysis of principles such as …

Ministerial Misfeasance: R. V. Morris And A Unique Early Privacy Breach, Barry Cahill Oct 2009

Ministerial Misfeasance: R. V. Morris And A Unique Early Privacy Breach, Barry Cahill

Dalhousie Law Journal

According to Klein &Kratchanov (Government Information: The Right to Information and Protection of Privacy in Canada, 2nd ed., 2009), "there is one reported case of a successful private prosecution for violation of an access statute through the unauthorized release of personal information. The matter arose under a former Nova Scotia Act and resulted in a modest fine being imposed against a Minister of the Crown who had disclosed information about the complainant." What follows is a close, contextual study of a case unique in the short history of privacy law in Canada, from the perspective of the thirty-year development of …

Journeys To 20th Street: The Inner City As Critical Pedagogical Space For Legal Education, Sarah Buhler Oct 2009

Journeys To 20th Street: The Inner City As Critical Pedagogical Space For Legal Education, Sarah Buhler

Dalhousie Law Journal

This essay draws on critical geographical theories to propose that the location of clinical legal education programs in inner city space can affect the production of professional identities and ideologies oflaw students. It anchors its analysis in an examination of the clinical law program at the University of Saskatchewan College of Law, where students work at a poverty law clinic in Saskatoon's inner city. The paper first turns to a critical examination of law school space, which can function to promote dominant notions about law and legal practice. The author cautions that ifnot navigated attentively, thejourney to inner city space …

A Nonlinear Constituent Based Viscoelastic Model For Articular Cartilage And Analysis Of Tissue Remodeling Due To Altered Glycosaminoglycan-Collagen Interactions, Gregory C. Thomas, Anna Asanbaeva, Pasquale Vena, Robert L. Sah, Stephen M. Klisch Oct 2009

A Nonlinear Constituent Based Viscoelastic Model For Articular Cartilage And Analysis Of Tissue Remodeling Due To Altered Glycosaminoglycan-Collagen Interactions, Gregory C. Thomas, Anna Asanbaeva, Pasquale Vena, Robert L. Sah, Stephen M. Klisch

Mechanical Engineering

A constituent based nonlinear viscoelastic (VE) model was modified from a previous study (Vena, et al., 2006, “A Constituent-Based Model for the Nonlinear Viscoelastic Behavior of Ligaments,” J. Biomech. Eng., 128, pp. 449–457) to incorporate a glycosaminoglycan (GAG)-collagen (COL) stress balance using compressible elastic stress constitutive equations specific to articular cartilage (AC). For uniaxial loading of a mixture of quasilinear VE constituents, time constant and relaxation ratio equations are derived to highlight how a mixture of constituents with distinct quasilinear VE properties is one mechanism that produces a nonlinear VE tissue. Uniaxial tension experiments were performed with newborn bovine AC …

The Definition Of "Accident" In Canadian Coverage Cases And The Unspoken "Useful Purpose" Test, Eric J. Adams Oct 2009

The Definition Of "Accident" In Canadian Coverage Cases And The Unspoken "Useful Purpose" Test, Eric J. Adams

Dalhousie Law Journal

Thispaper argues that courts tacitly weigh risks againstrewards when constructing the meaning of the term "accident." It suggests the phrase "courting the risk" takes on two distinct meanings. Firstly, at some point, the risks associated with an activity are said to be so substantial as to suggest an insured expected and, thus, courted any resulting losses.. Secondly, a party is deemed to court the risk of. loss if acting solely for the experience of risk, in and of itself, and not for any other redeeming benefit. The author outlines the evolution of the term "accident" in the case law and contrasts …

International Students’ Perspectives Of An Introductory Course As Preparation For Entry Into A Postgraduate Physiotherapy Program, Jennifer Roberts, Rebekah Das, Saravana Kumar

Internet Journal of Allied Health Sciences and Practice

Purpose: Introductory or preparatory courses are often provided to international students in Australia as means to help them adjust to a new cultural and communication environment and a foreign educational setting. However, there is very little evaluation research on these introductory courses, especially from students’ perspectives, on their merits and demerits. Methods: This research utilised primary and secondary research methods. Firstly, a systematic review of the literature was undertaken to identify international students’ perspectives of education in Australia. Secondly, using qualitative and quantitative research methods, international postgraduate physiotherapy students’ perspectives of an introductory course at an Australian educational institution was …

The Ged And Alternative Learning Center Diploma As A Factor In Post-Secondary Persistence And Success, Michael C. Autenrieth Oct 2009

The Ged And Alternative Learning Center Diploma As A Factor In Post-Secondary Persistence And Success, Michael C. Autenrieth

UNLV Theses, Dissertations, Professional Papers, and Capstones

The purpose of this paper will be to analyze how graduates of alternative learning high schools and GED certificate holders compare to traditional high school diploma recipients in terms of academic success at post-secondary institutions. A review of the existing literature and statistical analysis of entering students at a private career college will provide both a historical perspective and illustrate pertinent facts surrounding this issue. Analysis of the available information will provide the foundation for future planning and initiatives designed to improve the process or mitigate any identified inequities.

Introduction

The objective of this cross-sectional study was to examine the nutrition literacy status of adults in the Lower Mississippi Delta.

Methods

Survey instruments included the Newest Vital Sign and an adapted version of the Health Information National Trends Survey. A proportional quota sampling plan was used to represent educational achievement of residents in the Delta region. Participants included 177 adults, primarily African Americans (81%). Descriptive statistics, X(2) analysis, analysis of variance, and multivariate analysis of covariance tests were used to examine survey data.

Results

Results indicated that 24% of participants had a high likelihood of limited nutrition literacy, 28% …

Quality Health Information On The Internet: Developing A Diabetes Pathfinder For The Chinese Population, Ana D. Cleveland, Jodi Philbrick, Xuequn Pan, Xinyu Yu, Jiangping Chen, Marty O'Neill, Lisa Smith

Faculty Publications

A Web-based bilingual diabetes information pathfinder was created to help the Chinese population access quality health information on the Internet as part of a collaborative outreach project in the Dallas-Fort Worth area. A survey was conducted to identify the demographics, Internet usage, health information needs, and preferences for training sessions of the Chinese population. Breast cancer, diabetes, and hepatitis B were the top three diseases of interest. The process of developing the pathfinder is described from start to finish, and it can serve as a model for the development of others. Pathfinder training sessions also were held.
