Book Review: Carl Cranor, Toxic Torts: Science, Law, And The Possibility Of Justice, David S. Caudill

Carl F. Cranor’s Toxic Torts: Science, Law, and the Possibility of Justice is a sustained, comprehensive argument that the Daubert gatekeeping regime has tilted the playing field against injured plaintiffs in toxic tort litigation. More generally, Cranor joins those who argue that the Daubert regime has not fared well in practice. Complex scientific evidence is not handled well in trials because scientific methods, data, and inferential reasoning are not well understood by gatekeeping judges. Cranor’s goal is to help solve this problem by offering a detailed description of the patterns of reasoning, evidence collection, and inference in nonlegal scientific settings. …

The purpose of this critical study is to improve Adelphi University's student teaching program protocol in order to enhance future teacher candidates and cooperating teachers, standard procedural information, as well as factors that contribute to teacher candidate success. Fourteen Teaching English as a Second Language (TESOL) teacher candidates were observed, completed journals, and shared their personal experiences in their student teaching placement. Data gathered from a variety of sources illuminated the need to improve communication and collaboration between the parties of the student teaching triad (university supervisor, cooperating teacher, and teacher candidate). The research method adopted here is to present various socio-economic and political participation indicators across caste and ethnic groups to find out how unequal the groups, based on the concept of horizontal inequalities (HIs). HI is inequality between culturally defined groups with shared identities that are formed by religion, ethnicities, racial affiliations, or other salient features which bind groups of people together. To study the inequalities, secondary data has been used from the following surveys: Population census 1991 and 2001, Nepal living standards survey (NLSS) 1995/96 and 2003/04, and Nepal Demographic and Health Survey (NDHS) 2006. We recently reported a direct, inverse, significant linear correlation of Env divergence from our live-attenuated vaccine strain (EIAVD9) and protection from disease. This marked effect of Env variation or viral evolution on vaccine efficacy begged the current questions: what is the relationship of Env variation and viral evolution to vaccine efficacy and does the evolution of virus in inapparent carriers differ from the evolution of attenuated vaccine viruses? Surviving On Margins: Dilemmas Of A Himalayan Primitive Tribe (Bhoxas) Over Developmental Paradigms In Globalizing India, Bina Saklani

This ethnographic study based on the socio-economic survey of every Bhoxa householder (N=7000) in Garhwal region was undertaken in 2005 and 2007. We explore a variety of problems this tribal group is facing such as subsistence, education, health and hygiene, land alienation, and demands on tribal land for industrial production and commercial agriculture resulting from skewed developmental priorities of government policy. This paper analyzes the causes of growing economic and political marginalization of our tribal group and strives to find some solutions to the problem.

In this paper we estimate the benefits of improving water quality in the Bagmati River in Kathmandu using Choice Experiments. Water quality of the Bagmati has direct impact on health, environment, ecology and development of the Kathmandu valley. Exercise-induced asthma/exercise-induced bronchospasm (EIA/EIB) is a prevalent and clinically important disease affecting young children through older adulthood. These terms are often used interchangeably and the differences are not clearly defined in the literature. The pathogenesis of EIA/EIB may be different in those with persistent asthma compared to those with exercise-induced symptoms only. The natural history of EIA is unclear and may be different for elite athletes. Leukotriene biology has helped the understanding of EIB. Analogy As Higher-Order Metaphor In Aquinas, Robert Masson

At a Thomas Instituut conference in 2000, Otto-Hermann Pesch suggested somewhat enigmatically that the sharp distinction in scholastic Thomism between analogy and metaphor can no longer be maintained since on closer examination analogous statements are in effect instances of a kind of 'higher-order metaphor'. I Pesch intended this qualification primarily to draw attention to the agnostic or negative aspect of analogous speech.2 It is evident from Herwi Rikhof's portrait of 'Thomas at Utrecht' ,3 that this emphasis on the negative dimension did not introduce anything controversial or novel at the Instituut.
