From a legal perspective, is a clinical laboratory a healthcare provider? Physicians are clearly healthcare providers who owe their patients the associated fiduciary duties. It is less clear, however, which-if any-legal duties genetic testing labs owe to the individuals who seek their services.

The question of whether clinical genetics laboratories are healthcare providers for legal purposes may be thornier than it could initially appear. Clinical genetics laboratories perform multiple tasks. Most significantly, they sequence genetic samples and then interpret the results. An integral concern across care settings is the prompt intervention for patients suffering with pain. Long-term care (LTC) settings present with unique challenges to assess and manage pain in resident populations. Advances in geophysical and remote sensing technology, specifically with ground penetrating radar (GPR) and geographic information systems (GIS), have led to increased use for archaeological research within cemeteries. Because of its non-invasive manner and high resolution of subsurface anomalies, GPR is ideal for surveying areas with marked or unmarked graves within cemeteries. Using a GIS assists cemetery research by facilitating integration of datasets and projection of spatial data. The purpose of this study is to determine whether children with autism recognize the same perceptual voicing boundaries of stop consonants as normally developing children of the same age group. This was explored using three groups of participants: ten children with autism between the ages of 8-14, five typically developing children between the ages of 8-14, and five typically developing seven-year-old children. Children in all groups listened to initial stop consonant syllables with voicing contrasts, with voiced and voiceless cognates presented. The initial consonants were altered along a voice onset time continuum within the typically perceived boundaries of each consonant. …

The purpose of the present study is to test the feasibility of implementing a video-game based intervention protocol as a means to improve therapy compliance in school age children with hyperfunctional voice disorders. Three levels of modification were made to an existing entertainment software program in order to implement the therapeutic protocol and test compatibility. The third level of modification included a two-phase quasi-experimental single subject design with a school age participant receiving the video game therapy protocol and traditional therapy for equal time. This thesis examines the relationship between Cypress Gardens and the state of Florida. Specifically, it focuses on how the creator of the park, Dick Pope, created his park after his own idealized vision of the state, and how he then promoted both his park and Florida as one and the same. The growth and later decline of Cypress Gardens follows trends in Florida's growth patterns and shifts in tourism. Between 1994 and 2004 the African National Congress (ANC) dominated government at every level of every branch. As a result, the checks and balances that are a necessary part of any democracy were non-existent. Understanding the powerful position they occupied, the ANC increasingly acted on its own accordance without any regard for the wishes of the South African populace. The citizen legislator is both a controversial and recurring phenomenon of interest in political science research. A longstanding concern for the discipline has been whether or not involvement of the public in the lawmaking process is an asset or a liability to quality governance. This study explores the desirability of citizen legislating in the American states. A four dimensional index is created that includes empirical indicators of "substantive" and "procedural" governance. The present study addresses identity distress and identity status in adolescents with clinical diagnoses, and their caregivers. There were 88 adolescent participants (43.2% female) ranging in age from 11 to 20 (mean =14.96; SD =1.85) who were recruited from community mental health centers in Volusia and Orange Counties. The 63 caregiver participants included mothers (82.5%), fathers (7.9%), grandmothers (7.9%), and grandfathers (1.6%), ranging in age from 28-70 (mean = 40.24; SD = 9.16). Children with Asperger's Disorder are considered to have impairments in social interaction, but to date few studies have empirically addressed this issue. This study examined the existence of social skills deficits in children with Asperger's Disorder, children with social phobia, and children with no psychological disorder. Using direct observation of social skills during role-play tasks, blinded observers rated an overall impression of social effectiveness and three specific categories of social skill: pragmatic behavior (e.g., effort to maintain conversation, latency to respond), speech and prosodic behavior (e.g., vocal inflection, voice volume), and paralinguistic conversational behaviors (e.g., facial orientation, motor movement). College students have been identified as at high risk for contracting Human Papillomavirus (HPV) due to engaging in risky behaviors, such as binge drinking and unprotected sex. Before preventative measures like vaccination and condom usage can be promoted, awareness must be evaluated. A random sample of 438 college students was surveyed on their awareness of HPV using both paper and online surveying methods. Using binary logistic regression, HPV awareness was predicted using demographic measures. The majority of the sample reported having heard of HPV before. A growing body of research has addressed the relationship between religiousness and spirituality. In addition, recent research focuses on the variations in definition and operationalization of the two concepts. Most of this literature examines spirituality as a construct under religion. Conceptualizing those who are spiritual but non-religious has received far less attention. This study uses recent data from the General Social Surveys to assess the relationship of those who are spiritual but not religious with education and a number of socio-demographic variables. This paper identifies social conditions that shape perceptions of risk to environmental toxins among residents in the Gulf Coasts of Louisiana and Mississippi following Hurricane Katrina. Demographic information from a randomly selected sample of 2,548 residents was used to explore the concept of the "White male effect" as discussed in previous literature, which has found that white males are particularly risk accepting compared to all other race and gender groups. Obesity is one of the major public health issues in the United States, often regarded as part of a global crisis. Companies invest billions of dollars each year towards television advertising campaigns aimed at convincing audiences how their ground-breaking discovery 'battles the bulge' or somehow offers an increased health benefit. This study examined how advertisers presented health-related claims, including health and nutrient-content claims, in U.S. adult-targeted television food commercials. This study built on previous literature linking instructor immediacy, student motivation, and student learning. The purpose of this research was to examine main and interaction effects of instructor immediacy and student trait motivation on student state motivation and cognitive learning. A main effect of instructor nonverbal immediacy on student state motivation and cognitive learning was found to be statistically significant. Further exploratory research did not yield statistical significance for a main effect of trait motivation, as measured by need for cognition, on student state motivation and cognitive learning, nor an interaction effect of immediacy and trait motivation on both state …

This essay is a lightly-edited version of a talk given at the University of Maryland School of Law and the Journal of Business & Technology Law's Conference on the Subprime Meltdown in October 2008. It briefly reviews the reputational risk literature and applies it to the rating agency industry. In particular, it looks at three of the inputs into reputation - trust, transparency, and leadership - and evaluates how rating agencies fared in the period leading up to the subprime meltdown. It concludes that rating agencies did poorly when it came to all three of these reputational inputs.

As this Symposium Article contends, religion increasingly overlaps with the commercial sphere, and courts are obligated to determine whether or not to adopt an entirely hands-off approach simply because the specter of religion lurks on the horizon. Whereas the jurisprudence of the European Court of Human Rights tends to accept its member states' separation of commercial elements out from the protections more generally accorded to religion, the U.S. Supreme Court has treated the two spheres as overlapping. The Afterlife Of Ford And Panetti: Execution Competence And The Capacity To Assist Counsel, Christopher W. Seeds

The capacity to assist counsel and communicate a defense once held a central place in assessing competence for execution. Since Ford v. Wainwright (1986), however, courts have discarded this measure, viewing Justice Powell’s concurring opinion, which required only that a prisoner understand the execution as mortal punishment for a capital crime, as the Eighth Amendment rule. In a significant development, the Supreme Court’s decision in Panetti v. Quarterman (2007) - its first interpreting Ford - sends notice that Justice Powell’s statements on the substantive standard are not Ford's rule, providing a long overdue opportunity to address whether executing prisoners with …

Travel time is an important metric of geographic access to health care. We compared strategies of estimating travel times when only subject ZIP code data were available.Using simulated data from New Hampshire and Arizona, we estimated travel times to nearest cancer centers by using: 1) geometric centroid of ZIP code polygons as origins, 2) population centroids as origin, 3) service area rings around each cancer center, assigning subjects to rings by assuming they are evenly distributed within their ZIP code, 4) service area rings around each center, assuming the subjects follow the population distribution within the ZIP code. Bacteriophage infection has profound effects on bacterial biology. Clustered regular interspaced short palindromic repeats (CRISPRs) and cas (CRISPR-associated) genes are found in most archaea and many bacteria and have been reported to play a role in resistance to bacteriophage infection. We observed that lysogenic infection of Pseudomonas aeruginosa PA14 with bacteriophage DMS3 inhibits biofilm formation and swarming motility, both important bacterial group behaviors. This inhibition requires the CRISPR region in the host. Mutation or deletion of five of the six cas genes and one of the two CRISPRs in this region restored biofilm formation and swarming …

In fall 1955, the University of Arkansas and three Arkansas public colleges ended their longstanding policies of segregation and admitted Black students to regular classes. This study examines the historical data o f this desegregation episode and explores the human side o f desegregation through oral histories of some of the individuals involved in the historic event.
