A Survey Of Community College Faculty, Their Teaching Methodologies, And Congruence With Student Learning Needs, Susan J. Campbell Jan 2009

A Survey Of Community College Faculty, Their Teaching Methodologies, And Congruence With Student Learning Needs, Susan J. Campbell

Walden Dissertations and Doctoral Studies

National movements for greater quality in education have increased concerns about student learning and the effectiveness of teaching for the community college. Faculty are responsible for student learning, yet criticized for using ineffective teaching methods despite limited data on community college teaching practices. The purpose of this study was to gain a descriptive understanding of current teaching practices in three community colleges. This single-phase study used a concurrent mixed-method exploratory research design. A purposeful sample of 185 community college faculty across three colleges in the southwestern United States were surveyed about what methods they use, how they perceive their teaching …

Understanding Middle School Students' Perspectives Regarding Physical Activity And Fitness, Susan Yesalonia Jan 2009

Understanding Middle School Students' Perspectives Regarding Physical Activity And Fitness, Susan Yesalonia

Walden Dissertations and Doctoral Studies

Research confirms inactivity increases in adolescence and that unfit youth are at risk of acquiring cardiovascular diseases, diabetes, obesity, or other significant physical disorders later in life. Thus, the purpose of this phenomenological study was to describe the experience of chronically inactive children who were exposed to an exercise intervention program. The specific focus of the research was to better understand the essential educational needs of the participants and the effective elements of the program, Moving for Fun (MFF), a 7-week after-school fitness intervention program designed to modify chronic inactivity. Open-ended interviews and 3 observations were conducted with 8 middle …

A Comparison Of Lifestyle Intervention Sessions And Clinical Screening As Motivators In The South Dakota Wisewoman Program, Jacy Clarke Jan 2009

A Comparison Of Lifestyle Intervention Sessions And Clinical Screening As Motivators In The South Dakota Wisewoman Program, Jacy Clarke

Walden Dissertations and Doctoral Studies

WISEWOMAN (WW) is a comprehensive program for medically underserved women in South Dakota (SD), aged 30 to 64, which aims to reduce morbidity and mortality from chronic diseases. Screening services include blood total cholesterol, blood pressure and blood glucose, and body mass index (BMI). Lifestyle intervention (LSI) sessions are also offered to address physical activity and nutrition. The purpose of this retrospective longitudinal study was to quantitatively examine whether the combination of LSI's and clinical screenings or clinical screenings alone lead to improvements in blood pressure, blood glucose, total cholesterol, and/or BMI at rescreening 10 to14 months from initial screening. …

Personal And Professional Spirituality: Muslim Social Workers' Perspectives, Cheryl W. El-Amin Jan 2009

Personal And Professional Spirituality: Muslim Social Workers' Perspectives, Cheryl W. El-Amin

Walden Dissertations and Doctoral Studies

Research in the area of religion and spirituality in social work practice is lacking minority practitioner representation. This phenomenological study explored the questions of how American Muslim social workers define and experience the religious/spiritual, and perceive the propriety of integrating either, in practice. Ibn Khaldun and Durkheim, early social theorists, suggested that group feeling and affiliation impact personal and professional perception and decision making. American societal views of Muslims are often negative and uninformed. A group of 15 Muslim practitioners with bachelor's or more advanced degrees in social work were recruited through a survey administered via an Internet survey site. …

Faces In The Mirror: Exploring Conflict Styles Of Adults In School Communities Using The Face -Negotiation Theory, Christine D. Gross Jan 2009

Faces In The Mirror: Exploring Conflict Styles Of Adults In School Communities Using The Face -Negotiation Theory, Christine D. Gross

Walden Dissertations and Doctoral Studies

This correlation study focused on the lack of understanding of the relationship between social self-image "face" and conflict styles among adult employees on school campuses. An individual's social self-image may involve concerns for the social representation of oneself, another individual, or a relationship. Limited research pertaining to the degree face concerns affect conflict styles within school communities is a problem for school administrators because conflict styles can influence conflict outcomes and impact workplace quality on school campuses. This study relied on Ting-Toomey's face-negotiation theory, which proposes that individuals prefer conflict styles based upon face concerns. Research questions explored correlations between …

This research is a phenomenological study investigating the meaning and personal significance of the small group experience (personal growth) for a single cohort of eight mature-age graduates (male and female) who completed the Bachelor of Counselling degree at The University of Notre Dame Australia in the years 2005 and 2006. Two facilitators of these personal growth groups were interviewed, as were two agency supervisors who had access to these graduates during their clinical practice.

The research used qualitative methods in the collection of data. A semi-structured interview was conducted with purposefully selected participants to determine their understanding of the significance …

Confidential Arbitration Of Whistleblower Actions: A Loophole That Could Effectively Undo The Sarbanes-Oxley Act Of 2002, Nicholas E. Eckelkamp Jan 2009

Confidential Arbitration Of Whistleblower Actions: A Loophole That Could Effectively Undo The Sarbanes-Oxley Act Of 2002, Nicholas E. Eckelkamp

Journal of Dispute Resolution

Among Sarbanes-Oxley Act of 2002 's many requirements and protections are protections for whistleblowers, the Sherron Watkins' and Cynthia Coopers' of the world, who are the first to take risks to alert others of a potential fraud. These whistleblowers normally would be able to utilize the court system to vindicate their rights in the event of a retaliatory employment action. Recently, however, employers have begun using mandatory arbitration agreements to keep potentially embarrassing whistleblower actions out of the court system. Guyden v. Aetna, Inc. is a recent Second Circuit case that examined the enforceability of such agreements, ultimately holding that …

Governmentality, Biopower, And The Debate Over Genetic Enhancement, Ladelle Mcwhorter Jan 2009

Governmentality, Biopower, And The Debate Over Genetic Enhancement, Ladelle Mcwhorter

Philosophy Faculty Publications

Although Foucault adamantly refused to make moral pronouncements or dictate moral principles or political programs to his readers, his work offers a number of tools and concepts that can help us develop our own ethical views and practices. One of these tools is genealogical analysis, and one of these concepts is “biopower.” Specifically, this essay seeks to demonstrate that Foucault’s concept of biopower and his genealogical method are valuable as we consider moral questions raised by genetic enhancement technologies. First, it examines contemporary debate over the development, marketing, and application of such technologies, suggesting that what passes for ethical deliberation …

Evaluating Task-Technology Fit And User Performance For An Electronic Health Record System, Matthew J. Wills, Omar F. El-Gayar, Amit Deokar Jan 2009

Evaluating Task-Technology Fit And User Performance For An Electronic Health Record System, Matthew J. Wills, Omar F. El-Gayar, Amit Deokar

Research & Publications

Assessing user satisfaction, acceptance and performance impacts of information systems have long traditions in information systems research. With an increasing focus on broader adoption and implementation of electronic health records (EHR’s), research examining user evaluation and performance impacts will play an essential role in the successful design, implementation, and efficient use of these systems. In this study, we analyze user evaluations of an EHR system and assess the impact on individual performance of such systems using the Task-technology Fit (TTF) theory. TTF postulates that individual performance is more likely to be positively impacted if there is a “fit” between the …

Sample Size Calculation For Finding Unseen Species, Hongmei Zhang, Hal Stern Jan 2009

Sample Size Calculation For Finding Unseen Species, Hongmei Zhang, Hal Stern

Faculty Publications

Estimation of the number of species extant in a geographic region has been discussed in the statistical literature for more than sixty years. The focus of this work is on the use of pilot data to design future studies in this context. A Dirichlet-multinomial probability model for species frequency data is used to obtain a posterior distribution on the number of species and to learn about the distribution of species frequencies. A geometric distribution is proposed as the prior distribution for the number of species. Simulations demonstrate that this prior distribution can handle a wide range of species frequency distributions …

Understanding Generalist Function, F. Matthew Mihelic Jan 2009

Understanding Generalist Function, F. Matthew Mihelic

Faculty Publications

A major concern in dealing with multi-agent complex adaptive systems is the understanding of how such systems build order in the midst of an otherwise chaotic universe. The ordering principles of such systems that are found at the biological level can be applied to better understanding human organizations, and can also be used to develop or modify highly complex intelligent agent software systems for greater efficacy. This paper describes the theoretical mechanism of how huge multi-agent complex adaptive systems overcome the exponential increases in entropy that would otherwise cause system collapse, through the use of agents that function to maintain …

Ending Jim Crow Life Insurance Rates, Mary L. Heen Jan 2009

Ending Jim Crow Life Insurance Rates, Mary L. Heen

Law Faculty Publications

This Article tells the story of the rise and fall of explicit race-based pricing practices as American life insurance companies responded to changes in the social, economic, and legal status of former slaves. The role of law in that story, from the Civil War to the beginning of this century, illustrates the complex interaction between civil rights reform and private commercial markets. Despite early laws prohibiting race-based life insurance rates, racial discrimination persisted in various forms for over a century due to the strength of the underlying racial ideologies, the rhetorical power of actuarial language, and the structure and regulation …

The Tragedy Of The Commons: The Case Of The Blue Crab, Carl W. Tobias Jan 2009

The Tragedy Of The Commons: The Case Of The Blue Crab, Carl W. Tobias

Law Faculty Publications

The blue crab has achieved iconic status throughout the Chesapeake Bay area, while the pugnacious crustacean and the majestic estuary are national treasures. The shallow waters provide optimal habitat for the species that has been deeply woven into the bay's economic and cultural fabric. Last year, after a respected committee ascertained that the crab was in jeopardy, anticipated future deterioration, and proffered extreme recommendations, Virginia and Maryland imposed draconian strictures which could reduce harvests by one third and help ameliorate the creature's depletion. A recent Executive Order, ambitiously designed by President Barack Obama to safeguard and restore the Chesapeake, illuminates …

Leaving The Chisholm Trail: The Eleventh Amendment And The Background Principle Of Strict Construction, Kurt T. Lash Jan 2009

Leaving The Chisholm Trail: The Eleventh Amendment And The Background Principle Of Strict Construction, Kurt T. Lash

Law Faculty Publications

Most scholars and courts assume that the Eleventh Amendment emerged from a sudden 'shocked' public reaction to the Supreme Court's decision in Chisholm v. Georgia. The Supreme Court's decision in Hans v. Louisiana has been subject to particular criticism for extending the doctrine of sovereign immunity beyondthe text of the amendment and the particular subject matter before the Court in Chisholm. This article contends that the modern emphasis on Chisholm v. Georgia as the generative source of the Eleventh Amendment is historically incorrect. Public debate regarding the key issues behind the Eleventh Amendment had been underway long before the Court …

Comparative Metabolism Of Benzo(A)Pyrene By Ovarian Microsomes Of Various Species, Deacqunita L. Harris, Ashley C. Huderson, Mohammad S. Niaz, J. Joe Ford, Anthony E. Archibong, Aramandla Ramesh

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Knowledge of the ability of the female reproductive system to metabolize polycyclic aromatic hydrocarbons (PAHs) is critical to the diagnosis and management of female infertility and for risk assessment purposes. The PAHs are a family of widespread pollutants that are released into the environment from automobile exhausts, cigarette smoke, burning of refuse, industrial emissions, and hazardous waste sites. In exposed animals, PAHs become activated to reactive metabolites that interfere with target organ function and as a consequence cause toxicity. The extent of susceptibility to PAH exposure may depend on the ability of animals to metabolize these chemicals. The present study …

Protocol For Indicator Scoring In The Soil Management Assessment Framework (Smaf), Brian J. Wienhold, D. L. Karlen, S.S. Andrews, D. E. Stott

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Assessment tools are needed to evaluate agronomic management effects on critical soil functions such as carbon sequestration, nutrient cycling and water partitioning. These tools need to be flexible in terms of selection of soil functions to be assessed and indicators to be measured to ensure that assessments are appropriate for the management goals. The soil management assessment framework (SMAF) is being developed to meet this need. The SMAF uses soil physical, chemical and biological indicator data to assess management effects on soil function using a three-step process for (1) indicator selection, (2) indicator interpretation and (3) integration into an index. …

Background: Crohn’s disease (CD) is a chronic granulomatous inflammation of the intestine. The etiology is unknown, but an excessive immune response to bacteria in genetically susceptible individuals is probably involved. The response is characterized by a strong Th1/Th17 response, but the relative importance of the various bacteria is not known.

Methodology/Principal Findings: In an attempt to address this issue, we made T-cell lines from intestinal biopsies of patients with CD (n = 11), ulcerative colitis (UC) (n = 13) and controls (n = 10). The T-cell lines were tested for responses to various bacteria. A majority of the CD patients …

Evaluation Of Β-Glucosidase Activity As A Soil Quality Indicator For The Soil Management Assessment Framework, D. E. Stott, S. S. Andrews, M. A. Liebig, Brian J. Wienhold, D. L. Karlen

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The Soil Management Assessment Framework (SMAF) was developed to assess conservation effects on soil, and uses multiple soil quality indicator measurements to compare soil functioning. Our objective was to develop a SMAF compatible scoring equation for soil β-glucosidase (BG) activity using published data sets representing different soils and management. The resulting equation was an S-shaped curve: y = a/[1 + bexp(−cx)], where x is the measured BG activity (mg p-nitrophenol [PNP] released kg−1 soil h−1), a and b are constants, and c is a factor modified by soil classification, texture, and climate. …

Rambouillet ewe lambs (n = 84) were allotted to a 2 x 3 factorial design including dietary factors of Se [adequate Se (ASe; 11.5 μg/kg BW) or high Se (HSe; 77.0 μg/kg BW)] and nutritional plane [60% (RES), 100% (CON), or 140% (HIGH)]. At breeding Se treatments were initiated followed by nutritional treatments on d 40 of gestation. At birth, lambs (n = 13, …

Popular Constitutionalism, Civic Education, And The Stories We Tell Our Children, Thomas G. Donnelly Jan 2009

Popular Constitutionalism, Civic Education, And The Stories We Tell Our Children, Thomas G. Donnelly

Law Faculty Publications

This Note analyzes a set of constitutional stories that has not been the subject of focused study—the constitutional stories we tell our schoolchildren in our most widely used high school textbooks. These stories help reinforce a constitutional culture that is largely deferential to the Supreme Court, limiting references to popular resistance to the Court and often linking such popular resistance to the actions of self-interested politicians, at best, and historical villains, at worst. Our textbooks are especially critical of blunt institutional checks on the Court (like judicial impeachment and “court-packing”), but are sometimes receptive to subtler, longer-term checks (like social …

The Unexceptionalism Of Evolving Standards, Corinna Barrett Lain Jan 2009

The Unexceptionalism Of Evolving Standards, Corinna Barrett Lain

Law Faculty Publications

Conventional wisdom is that outside the Eighth Amendment, the Supreme Court does not engage in the sort of explicitly majoritarian state nose-counting for which the "evolving standards of decency" doctrine is famous. Yet this impression is simply inaccurate. Across a stunning variety of civil liberties contexts, the Court routinely-and explicitly--determines constitutional protection based on whether a majority of states agree with it. This Article examines the Supreme Court's reliance on the majority position of the states to identify and apply constitutional norms, and then turns to the qualifications, explanations, and implications of state polling as a larger doctrinal phenomenon. While …
