"14 These laws include Title VII of the Civil Rights Act of 1964,15 Section 1981 of the Civil War Reconstruction statutes,16 the Age Discrimination in Employment Act of 1967 (ADEA),17 the Equal Pay Act (EPA),18 and the Americans with Disabilities Act of 1990 (ADA).19 While the statutes define different types of discrimination, each addresses discrimination in employment and defines a limitations period in which an employee can bring a claim.20 With Title VII defining the "paradigm," the first step in determining whether a claim is timely under any statute is determining when the discriminatory act takes place.21 To do that, …

The Bfoq Defense: Title Vii’S Concession To Gender Discrimination, Katie Manley

Should the BFOQ exception still exist? Because permitting discrimination under Title VII seems fundamentally contrary to the anti-discrimination purpose of the statute, this article questions whether the BFOQ defense is consistent with the aims of Title VII or whether, in actuality, the defense undermines the Act's effectiveness by providing a loophole for employers to participate in the discriminatory practices Title VII seeks to forbid.

Sergei Prokofiev composed his last work for violin in 1947, the Sonata for Solo or Unison Violins, Op. 115. This work stands apart from Prokofiev’s other works because it serves the dual purpose of both solo or unison sonata, and is the least performed or recorded work among the violin repertoire of Prokofiev. This work was written exactly at the point in Soviet history when its government launched official attacks on many composers including Prokofiev, and was never performed during Prokofiev’s lifetime. Humans produce large amounts of waste that must be processed or stored so that it does not contaminate the environment. When hazardous wastes are stored, waste site monitoring is typically conducted in situ which can lead to a serious time lag between the onset of a problem and detection. A Remote Sensing and GIS-assisted Spatial Decision Support System for Hazardous Waste Site Monitoring was developed to improve hazardous waste site management. Role Of Cyclophilin D In Secondary Spinal Cord And Brain Injury, Jordan Mills Clark

In the hours and days following acute CNS injury, a secondary wave of events is initiated that exacerbate spinal tissue damage and neuronal cell death. A potential mechanism driving these secondary events is opening of the mitochondrial permeability transition pore (mPTP) and subsequent release of several cell death proteins. Previous studies have shown that inhibition of cyclophilin D(CypD), the key regulating component in mPTP opening, was protective against insults that induce necrotic cell death. We therefore hypothesized that CypD-null mice would show improved functional and pathological outcomes following spinal cord injury (SCI) and traumatic brain injury (TBI). Moderate and severe …

Glutamate Regulation In The Hippocampal Trisynaptic Pathway In Aging And Status Epilepticus, Michelle Lee Stephens

A positive correlation exists between increasing age and the incidence of hippocampal-associated dysfunction and disease. Normal L-glutamate neurotransmission is absolutely critical for hippocampal function, while abnormal glutamate neurotransmission has been implicated in many neurodegenerative diseases. Previous studies, overwhelmingly utilizing ex vivo methods, have filled the literature with contradicting reports about hippocampal glutamate regulation during aging. For our studies, enzyme-based ceramic microelectrode arrays (MEA) were used for rapid (2 Hz) measurements of extracellular glutamate in the hippocampal trisynaptic pathway of young (3-6 months), late-middle aged (18 mo.) and aged (24 mo.) urethane-anesthetized Fischer 344 rats. An Examination Of The Association Between Middle School Students' Perceptions Of Teacher Interactions, Home-School Dissonance, And School Attachment, Ruby Jewel Stevens

The purpose of this study was to investigate whether middle school students’ perceptions of teacher interactions and home-school dissonance are predictors of school attachment. The study sought to determine if there were differences in students’ perceptions of teacher interactions and home-school dissonance based on ethnicity, gender and/or grade level. This investigation is one of the first to explore the association between these variables.

The Association Between Alcohol Sales And County Level Economic Growth In Kentucky, Julia Hinkle Rollins

This thesis evaluates the effectiveness of using alcohol sales as an indicator of development or lag associated with development in Kentucky counties using summary statistics, shift-share analysis and an econometric model. The summary statistics are used to evaluate possible lines of causality and the Shift-share analysis and econometric model deal the specific characteristics of the county that are assumed to be influenced by the sale of alcohol. Limitations to the county level data were limiting to the time period evaluated in this thesis. In the spring of 2009, public outcry erupted over the multi-million dollar bonuses paid to AIG executives even as the company was receiving TARP funds. Various measures were proposed in response, including a 90% retroactive tax on the bonuses, which the media described as a "clawback." Separately, the term "clawback" was also used to refer to remedies potentially available to investors defrauded in the multi-billion dollar Ponzi scheme run by Bernard Madoff. While the media and legal commentators have used the term "clawback" reflexively, the concept has yet to be fully analyzed. In this article, we propose a doctrine of …
