Western Europe: Last Holdout In The Worldwide Acceptance Of Clinical Legal Education, Richard J. Wilson Jan 2009

Western Europe: Last Holdout In The Worldwide Acceptance Of Clinical Legal Education, Richard J. Wilson

Scholarly Articles in Law Reviews & Journals

Clinical legal education has achieved widespread acceptance throughout the world, growing by leaps and bounds during recent decades in countries like Russia and China, and expanding rapidly in other areas of Eastern Europe, Latin America and Africa. It is, arguably, the most significant innovation in legal education since the “invention” of the Socratic-case method in the United States, at the turn of the 20th Century. There is, however, one geographic area where the philosophy and methodology of clinical legal education has been resisted. That area is Continental Western Europe (the UK has some clinics, though not widespread). This article examines …

Mckillop Library Electricity Use, Impacts And Solutions, Nellie Tarini, Marisa Volo, Carly Ouellette, Other Students

BIO140 Carbon Footprint Project

A few weeks ago, our class went on a guided tour of the library, which taught us about what goes on in the library, how resources are used, and basically how the library operates. From our tour, we saw many problem areas that could use improvements. One of these areas is the library’s use of electricity. Our group focused on the computers, printers, copiers, lights, and elevators in the library and how the library could use their electricity more efficiently. We have found that the library is not always using electricity effectively and efficiently. There are lights on when nobody …

Identity, Oppression, And Group Rights, Andrew Jared Pierce Jan 2009

Identity, Oppression, And Group Rights, Andrew Jared Pierce

Dissertations

The dissertation argues for a conception of group rights based on Habermasian discourse theory, as an alternative to the dominant multicultural liberal approach to group rights, which treats group rights as instrumental to individual rights.

Effects Of Misassignment On Bias In The Fuzzy Regression Discontinuity, Kelci M. Price Jan 2009

Effects Of Misassignment On Bias In The Fuzzy Regression Discontinuity, Kelci M. Price

Dissertations

The question of whether social interventions are effective has become an ever more important concern as programs are asked to justify their funding and theories of action. Although the randomized control trial (RCT) is a rigorous choice of design with regards to establishing causality, there are many reasons a researcher might want to consider an alternative design. One design which has been shown to provide unbiased estimates of the program effect is the regression discontinuity (RD). However, a major problem encountered when using RD is that participants must be assigned to groups strictly based on a cutoff score - a …

Patient Negligence: The Unreasonableness Of Relying On Trust, Song Richardson Jan 2009

Patient Negligence: The Unreasonableness Of Relying On Trust, Song Richardson

Scholarly Articles in Law Reviews & Journals

This project initiates a conversation about patient negligence and trust in the medical setting and offers a test to determine whether patient negligence should be considered in litigation. The project examines the line at which a physician’s impermissible conduct should become reasonably obvious to a patient and therefore trigger a reasonable response. Absent a reasonable response by patients, this project considers whether comparative negligence attaches. Goodwin and Richardson argue due diligence, an aspect of loyalty, is treated as a value fiduciaries owe their clients, rather than a reasonable step that clients owe themselves.

In this collaboration, the authors imagine and …

Regulatory Takings: A Chronicle Of The Construction Of A Constitutional Concept, Garrett Power Jan 2009

Regulatory Takings: A Chronicle Of The Construction Of A Constitutional Concept, Garrett Power

Faculty Scholarship

In the American constitutional system the sovereign has the power to enact “regulations which are necessary to the common good and general welfare.” But the Fifth Amendment to the United States Constitution proscribes that : “No person shall be . . . deprived of . . . property, without due process of law; nor shall private property be taken for public use, without just compensation.” And the question of whether a sovereign regulation has “taken” private property without just compensation has puzzled the United States Supreme Court for over two hundred years in over four hundred cases. This paper chronicles …

A Kinship-Based Modification Of The Armitage Trend Test To Address Hidden Population Structure And Small Differential Genotyping Errors, Cyril Rakovski, Daniel O. Stram Jan 2009

A Kinship-Based Modification Of The Armitage Trend Test To Address Hidden Population Structure And Small Differential Genotyping Errors, Cyril Rakovski, Daniel O. Stram

Mathematics, Physics, and Computer Science Faculty Articles and Research

Background/Aims We propose a modification of the well-known Armitage trend test to address the problems associated with hidden population structure and hidden relatedness in genome-wide case-control association studies.

Methods The new test adopts beneficial traits from three existing testing strategies: the principal components, mixed model, and genomic control while avoiding some of their disadvantageous characteristics, such as the tendency of the principal components method to over-correct in certain situations or the failure of the genomic control approach to reorder the adjusted tests based on their degree of alignment with the underlying hidden structure. The new procedure is based on Gauss-Markov …

Before You Slip Into The Night, You’Ll Want Something To Drink: Exploring The Reasons For Prepartying Behavior Among College Student Drinkers, Eric R. Pedersen, Joseph W. Labrie, Jason R. Kilmer Jan 2009

Before You Slip Into The Night, You’Ll Want Something To Drink: Exploring The Reasons For Prepartying Behavior Among College Student Drinkers, Eric R. Pedersen, Joseph W. Labrie, Jason R. Kilmer

Heads Up!

Prepartying among college students is an emerging topic of research and clinical focus. Unfortunately for some students, prepartying, or quick drinking before going out for the primary event of the evening, can lead to high blood alcohol levels, further drinking, and subsequent consequences. The present study was designed to explore the reasons for prepartying among a sample of 444 male and female students. Males and females reported arriving to a social event already under the influence, saving money, and making the night more interesting as their most highly endorsed reasons for prepartying. Males endorsed reasons relating to increased social and …

A Brief Live Interactive Normative Group Intervention Using Wireless Keypads To Reduce Drinking And Alcohol Consequences In College Student Athletes, Joseph W. Labrie, Justin F. Hummer, Karen K. Huchting, Clayton Neighbors

Heads Up!

Introduction and Aims

Misperceptions of how members of one’s social group think and act influence behaviour. The current study was designed to extend the research of group-specific normative feedback interventions among salient campus groups with heightened risk. Although not a randomised controlled trial, this research used normative feedback that was obtained using wireless keypad technology during a live session, within sex-specific student athlete groups to extend the proof of concept of using this brief interactive intervention.

Design and Methods

Participants included 660 intercollegiate athletes from all varsity athletic teams at two private, mid-size universities. Intervention data were gathered in vivo …

Normative Misperceptions And Marijuana Use Among Male And Female College Athletes, Joseph W. Labrie, Joel R. Grossbard, Justin F. Hummer

Psychological Science Faculty Works

This research assessed the frequency of marijuana use and perceptions of gender-specific marijuana use among intercollegiate athletes from two National Collegiate Athletic Association (NCAA) Division 1 universities. Normative data were gathered in a live setting. Male athletes reported significantly greater marijuana use than female athletes and the overall sample reported higher prevalence of use than national averages for college athletes and non-athletes. Gender-specific perceptions among male and female athletes exceeded actual self-reported use, and perceived marijuana use among male athletes was strongly associated with personal use. The findings demonstrate the salience of group-specific marijuana norms and present implications for normative …

Mental And Social Health Impacts The Use Of Protective Behavioral Strategies In Reducing Risky Drinking And Alcohol Consequences, Joseph W. Labrie, Shannon R. Kenney, Andrew Lac, Jonathan A. Garcia, Paul Ferraiolo

Psychological Science Faculty Works

The present study is the first to examine the moderating effects of mental and social health status in the relationship between protective behavioral strategies utilized to reduce high risk drinking (e.g., alternating alcoholic and nonalcoholic drinks or avoiding drinking games) and alcohol outcomes (drinking variables and alcohol-related negative consequences) among first-year college females (N = 128). Findings revealed that protective behaviors were particularly effective in reducing both alcohol consumption and related risks among participants reporting lower mental health as compared to higher mental health. Further, participants with higher social health who utilized protective behaviors consumed significantly fewer maximum drinks per …

Reclaiming Koreatown: A Prescription For Current And Future Needs Of Koreatown Residents, Edward J.W. Park, Koreatown Immigrant Workers Alliance

Asian and Asian American Studies Faculty Works

This report presents current and future needs of neighborhood residents and analyzes the challenges facing the multi-ethnic, low-income Koreatown community in Los Angeles. For the thousands of low-income residents of Los Angeles's Koreatown, the economic hardships brought on by the recent subprime mortgage housing and financial crises are not new. In the words of a Koreatown resident, "....the housing 'crisis' has been a crisis for us for a long time." Well before the current recession, Koreatown residents were complaining of increased housing costs due to the influx of upscale luxury housing units that replaced affordable housing units. The 2008 financial …

Ecosystem Modeling Of College Drinking: Parameter Estimation And Comparing Models To Data, Azmy S. Ackleh, Ben G. Fitzpatrick, Richard Scribner, Neal Simonsen, Jeremy J. Thibodeaux Jan 2009

Ecosystem Modeling Of College Drinking: Parameter Estimation And Comparing Models To Data, Azmy S. Ackleh, Ben G. Fitzpatrick, Richard Scribner, Neal Simonsen, Jeremy J. Thibodeaux

Mathematics, Statistics and Data Science Faculty Works

Recently we developed a model composed of five impulsive differential equations that describes the changes in drinking patterns (that persist at epidemic level) amongst college students. Many of the model parameters cannot be measured directly from data; thus, an inverse problem approach, which chooses the set of parameters that results in the “best” model to data fit, is crucial for using this model as a predictive tool. The purpose of this paper is to present the procedure and results of an unconventional approach to parameter estimation that we developed after more common approaches were unsuccessful for our specific problem. The …

Mycorrhizal Colonization And Nutrient Supply Rate Influence Elemental And Isotopic Tracers Of Calcium Cycling In Plant-Substrate Systems, Claire J. Hoff Jan 2009

Mycorrhizal Colonization And Nutrient Supply Rate Influence Elemental And Isotopic Tracers Of Calcium Cycling In Plant-Substrate Systems, Claire J. Hoff

Master's Theses and Capstones

Intraplant (root-foliage) fractionation of Ca isotopes and Ca/Sr were determined in Pinus sylvestris seedlings grown at different nutrient supply rates with or without ectomycorrhizal colonization. Foliar 44Ca/40Ca and Ca/Sr are uniformly higher than those of roots in individual seedlings, and these ratios in both foliage and roots differed significantly from those of nutrient sources. The measured offsets indicate that isotopic and trace element ratios can identify relative contributions from distinct calcium pools in terrestrial ecosystems. Furthermore, the results clearly show that fractionation of calcium isotopes and calcium from strontium in plants must be assessed in ecosystem-scale budgets and large watershed …
