Ohio Trust Code Update: Recent Developments, Alan Newman

This article is based on the author’s presentations at the 20th Annual Estate Planning Conference on Wealth Transfer in Columbus on June 26, 2009.
Since its enactment in 2006, effective January 1, 2007, the Ohio Trust Code (“OTC”) has been amended, a number of cases have been decided under it, and a variety of issues related to or raised by it have been identified. This article will review those developments.

From the perspective of both religious entities and local governments, religious land use requests are best resolved quickly, locally and cooperatively. The traditional framework for addressing religious land use disputes, which the Religious Land Use and Institutionalized Persons Act (RLUIPA)1 adopted, is ill-suited to those goals. Legally, disputes have long been framed as denials of the free exercise of religion – the broadest of all claims and the one requiring the most intrusive and subjective determinations about a particular religious group and its proposed use (what religion is, what a particular sect requires and how religion qua religion is affected …

Statement of problem. Although the superior qualities of microwave technology are common knowledge in the industry, effects of microwave glazing of dental ceramics have not been investigated.
Purpose. The purpose of this study was to investigate the surface roughness and flexural strength achieved by glazing porcelain specimens in a conventional and microwave oven.
Material and methods. Thirty specimens of each type of porcelain (Omega 900 and IPS d.Sign) were fabricated and sintered in a conventional oven. The specimens were further divided into 3 groups (n=10): hand polished (using diamond rotary ceramic polishers), microwave glazed, and conventional oven …

CONTEXT: An important phase of HIV prevention research is replicating successful interventions with different groups and in different settings.
METHODS: Be Proud! Be Responsible!, a successful intervention originally targeting black urban males and carried out in nonschool settings, was presented in health classes at urban and suburban schools with diverse student bodies. A group-randomized intervention study, which included 1,357 ninth and 10th graders from 10 paired schools in a Midwestern metropolitan area, was conducted in 2000-2002. Half the schools received the intervention, and half received a general health promotion program. Students' reports of their sexual behavior and selected cognitive mediators …

The author reflects on direct to consumer advertising which is concerned with erectile dysfunction drugs. She suggests that many people have problems with open discussions of sexual health problems. She argues that urologic nurses should have discussions with pharmaceutical representatives about ways to responsibly educate the public about erectile dysfunction drugs in a manner that is not offensive.

Evaluation Of The Urinary Incontinence Scales© To Measure Change After Experiential Learning: A Pilot Study, Karen A. Karlowicz

Evaluation of the effectiveness of the Urinary Incontinence Scales© to measure change after student participation in a disability-incontinence experiential learning activity was the focus of this pilot study. A comparison between pretest and posttest scores showed a significant increase in Belief and Practice subscale scores after participation in the experience. However, positive correlations between the variables measured could not be established.

Are The Outcomes Of Immediate And Early Single Tooth Implants Comparable To Conventionally Placed Implants?, Gary L. Stafford

Data Sources
Medline, Embase, the Cochrane Central Register of Controlled Trials (Central) and references of relevant studies were searched.
Study selection
Longitudinal studies [randomised controlled trials (RCT), clinical trials, cohort-studies and case series] were considered for evaluation. Retrospective studies were excluded. Only case series that investigated at least five patients were considered for inclusion. Outcome measures considered were implant survival, radiographical assessment of marginal peri-implant bone levels, dental-professional-assessed aesthetics, peri-implant biological structures (level of marginal gingiva, papilla index, probing depth, presence of plaque, bleeding on probing), patient satisfaction, and biological and technical complications.

In this Essay, I evaluate three issues of attribution and misattribution that arise in the so-called area of "government speech."' First, I explore when an individual might have a constitutional claim for misattribution by the state. Second, I discuss the citizen's interest in proper attribution by the government when it is speaking. Third, I consider the government's interest in avoiding expression being improperly attributed to it. This concern arises less often than is commonly assumed; what many scholars (and governments) claim to be a state interest in avoiding attribution or endorsement is in fact a state interest in not providing …

Chinese cadre responsibility systems are a core element of Chinese law and governance. These top-down personnel systems set concrete target goals linked to official salaries and career advancement. Judges and courts face annual targets for permissible numbers of mediated, reversed, and closed cases; Communist Party secretaries and government bureaus face similar targets for allowable numbers of protests, traffic accidents, and mine disasters. For many local Chinese officials, these targets have a much more direct impact on their behavior than do formal legal and regulatory norms.

We have arrived at a crossroads in terms of the intersection between law, sexuality, and globalization. Historically, and even today, the majority of accounts of GLBT migration tend to remain focused on “a narrative of movement from repression to freedom, or a heroic journey undertaken in search of liberation.” Within this narrative, the United States is usually cast as a land of opportunity and liberation, a place that represents freedom from discrimination and economic opportunity. But this narrative also elides the complexity that erupts from grappling with the reality that many other jurisdictions outside of the United States can be …

In my opinion most of the legal and social problems that arise under the Constitution stem from the belief, held by some people, that they are better than other people. They do not hate anyone. They simply believe that they are superior and that the law ought to treat them better than the other group. This is true of whites who think they are superior to blacks, men who think they are superior to women, and heterosexuals who think they are superior to homosexuals.

White Paper: Walking Speed: The Sixth Vital Sign, Stacy Fritz, Michelle M. Lusardi

Walking speed is "almost the perfect measure." This review summarizes the strong psychometric properties of walking speed and robust evidence for using this clinical measurement. Walking speed is easily measurable, clinically interpretable, and a potentially modifiable risk factor. For these reasons, using WS as the sixth vital sign is both pragmatic and essential.

It is not known whether a clinical prediction rule or a whiplash associated disorder (WAD) classification may be applied effectively in a second traumatic event to predict the outcome in a patient recovering from cord trauma. Therefore, the purpose of this case was to apply a decision rule and a whiplash classification to predict the outcome of a second traumatic event in a recovering incomplete spinal cord injured (SCI) patient who was ambulatory.

This essay will evaluate the embargo and its consequences in three parts. First, it briefly sets out the Human Rights framework within which this work scrutinizes the embargo. Following it presents a brief history of Cuba-U.S. relations including the creation and progression of the economic sanctions the U.S. has imposed on the neighboring island. Next, the essay evaluates the legality of the sanctions and concludes with a critical analysis of the impact of the sanctions.

It is incorrect to say that people trafficking is a breach of human rights for the same reason that it is incorrect to say that 2+2=5: because it is wrong and there is an inherent good in getting things right. This article assesses what, legally, is actually happening when trafficking in human beings (THB) takes place, and considers the practical ramifications arising from that assessment. What actually is THB? With the belief that fertile ground for a literate environment is created through lots of oral language, ancestral anecdotes, and reading a variety of genre in fiction and nonfiction, it is possible to link home and school literacy communities. This chapter describes the connection between district literacy events and functional home activities as the basis for a partnership in developing higher level thinking that transcends the classroom. At monthly get-togethers, families were encouraged to participate in the very activities that were used in the classroom as part of the district's literacy block. Seven years ago the Centre for Distance Learning and Innovation began a virtual high school within the Canadian province of Newfoundland and Labrador. The processing of sour gases within Abu Dhabi Gas Liquefaction Company (ADGAS) LNG Trains located in Das Island involves sulfur dioxide (SO2) emissions that mainly result from fuel gas usage to produce steam and electricity, and incomplete recovery of sulfur from acid gases.
