Expelling Law Firm Partners, Douglas R. Richmond Jan 2009

Expelling Law Firm Partners, Douglas R. Richmond

Cleveland State Law Review

Law firm partners may be de-equitized or expelled by their firms in good times as well as lean. Such actions appear to be on the upswing. There are, however, relatively few cases on these subjects. The leading case, Holman v. Coie, is dated; the practice of law, at least in large law firms, has changed considerably in the thirty plus years since Holman was decided. Looking ahead, courts must carefully reanalyze the intra-firm duty of good faith and fair dealing. Rather than confining liability to cases of economic predation, courts should review partner de-equitizations and expulsions under either excluder or …

Reproductive Rights As Health Care Rights, B. Jessie Hill Jan 2009

Reproductive Rights As Health Care Rights, B. Jessie Hill

Faculty Publications

U.S. legal scholarship concerning reproductive rights has largely revolved around the poles of decisional autonomy, privacy, and equality, with a concomitant a tendency to de-emphasize the medical aspect of abortion rights. The medical approach has been particularly disfavored by feminist scholars, largely due to concerns about undermining the equality rationale for reproductive rights and placing too much power in the hands of physicians. In addition, American constitutional law has tended to treat reproductive-rights cases differently from other cases raising challenges to government restrictions on individuals’ rights to access certain forms of medical treatment, granting heightened judicial scrutiny to the former …

Devaluing Life And Education: The Effect Of Naturalism On The Field Of Education, Erin R. Reynolds Jan 2009

Devaluing Life And Education: The Effect Of Naturalism On The Field Of Education, Erin R. Reynolds

Senior Honors Theses

The rise of naturalism has affected every area of life. This thesis seeks to address the negative influence of naturalism in various educational settings, exposing the degradation of the secular society while challenging the Christian to pursue change. The United States’ participation in eugenics during the early 20th century caused a lack of regard for the lives of special education students. Regular education, specifically the science classroom, has been a target for the naturalistic point of view. Even the abolition of God in the public school setting stems from the rise of naturalism. Lastly, many scientists and professors who hold …

Adapting Governance To Climate Change: Managing Uncertainty Through A Learning Infrastructure, Alejandro E. Camacho Jan 2009

Adapting Governance To Climate Change: Managing Uncertainty Through A Learning Infrastructure, Alejandro E. Camacho

Emory Law Journal

Though legislatures and agencies are considering how to prevent further climate change, some adverse effects from a warming climate are already inevitable. Adapting to these effects is essential, but regulators and scholars have largely neglected this need. This Article evaluates the capacity of natural resource governance to cope with the effects of climate change and provides a framework for Congress to help it do so. First, it uses case studies to illustrate valuable lessons about the challenges of creating effective natural resource management. Second, the Article is anchored in the specific implications of climate change, considering the value of interagency …

Wikitruth Through Wikiorder, David A. Hoffman, Salil K. Mehra Jan 2009

Wikitruth Through Wikiorder, David A. Hoffman, Salil K. Mehra

Emory Law Journal

How does large-scale social production coordinate individual behavior to produce public goods? In 1968, Hardin denied that the creation of public goods absent markets or the State is possible. Benkler, Shirky, Zittrain, and Lessig recently countered that the necessary coordination might emerge though social norms. However, scholars have not fully explained how this coordination is to occur. Game theorists have modeled large-scale social production as a solution to the herder problem/multi-player Prisoner¿s Dilemma. But we demonstrate that the ¿weeding in function reflects dynamics more accurately captured in coordination games. In this way, dispute resolution can provide a constitutive function for …

I Object: The Rluipa As A Model For Protecting The Conscience Rights Of Religious Objectors To Same-Sex Relationships, Erin N. East Jan 2009

I Object: The Rluipa As A Model For Protecting The Conscience Rights Of Religious Objectors To Same-Sex Relationships, Erin N. East

Emory Law Journal

In most states, the battle over same-sex marriage has become a showdown with either gay rights activists or religious conservatives prevailing. Each side is fearful of losing ground to the other. Many scholars have noted the threats to religious liberty that arise upon the recognition of same-sex marriage, but few have given significant attention to how religious liberty might be protected without abolishing the rights of same-sex couples. This Comment focuses on one manifestation of the conflict between same-sex rights and religious liberty: the conflict that arises when individuals and organizations are compelled by their religious beliefs to violate state …

Practice, Theory, And The War On Terror, Fred C. Zacharias Jan 2009

Practice, Theory, And The War On Terror, Fred C. Zacharias

Emory Law Journal

This Essay considers whether lawyers should offer legal advice that clients request and will pay for, even when giving that advice might facilitate wrongful behavior. As a vehicle for analyzing the issue, this Essay discusses memoranda written for the Administration of President George W. Bush by Deputy Assistant Attorney General John Yoo, who advised that the physically and psychologically abusive interrogation of enemy combatants in Afghanistan was, or might be, legally justifiable. This Essay is neither intended to critique or defend the legal analysis underlying the so-called ¿torture memos,¿ nor to serve as a referendum on Yoo¿s political views. Rather, …

The Federal Inaction Commission, Glen Staszewski Jan 2009

The Federal Inaction Commission, Glen Staszewski

Emory Law Journal

This Article proposes the establishment of a ¿Federal Inaction Commission¿ (FIC). This new, independent agency would be charged with investigating and reviewing the inaction of Executive Branch agencies and reporting its findings and recommendations to elected officials and the public. The FIC would provide many of the same benefits that would result from increasing the availability of judicial review of non-enforcement decisions and other regulatory inaction. At the same time, the FIC would be in a position to minimize the practical disadvantages that have been identified with judicial review of such decisions. Not only would the establishment of the FIC …

The Interdependent Relationship Between Internal And External Separation Of Powers, Gillian E. Metzger Jan 2009

The Interdependent Relationship Between Internal And External Separation Of Powers, Gillian E. Metzger

Emory Law Journal

In this Essay, I first describe internal separation of powers mechanisms and the constitutional role they can play. I next take up the question of whether these constraints are effective checks on Executive Branch overreaching and emphasize the mutually reinforcing relationship between such internal constraints and external checks on the Executive Branch. Finally, I discuss the general failure of current separation of powers doctrine to directly connect internal and external constraints and analyze whether including such a linkage would be appropriate.

Weighing The Value Of Information: Why The Federal Government Should Require Nutrition Labeling For Food Served In Restaurants, Devon E. Winkles Jan 2009

Weighing The Value Of Information: Why The Federal Government Should Require Nutrition Labeling For Food Served In Restaurants, Devon E. Winkles

Emory Law Journal

Obesity has become a growing public health concern in the United States. State and local policymakers, as well as the federal government, have proposed and implemented a variety of measures to curb consumption of unhealthy food and promote healthy lifestyles. Providing nutrition information to consumers is one strategy that has been implemented, most notably in the Nutritional Labeling and Education Act of 1990. Such a strategy should again be employed to address overconsumption and over-marketing of high calorie food at restaurants, as well as to remedy the patchwork of menu labeling requirements that has been created in recent years and …

Turkish Journal of Veterinary & Animal Sciences

A 12-week-old, intact, male German shepherd dog was presented with a history of regurgitation since weaning to solid food. The dog was emaciated, and the cervical esophagus of the animal was palpable as a flaccid and air-filled cavity. Contrast radiography of esophagus revealed contrast material accumulation in the thoracic esophagus craniodorsal to the heart. A diagnosis of vascular ring anomaly was made and surgical correction of the defect was decided. The dog died during the preoperative period despite supportive treatment in intensive care unit. Necropsy findings confirmed a diagnosis of persistent right aortic arch.

The Relationship Between Morphometric And Long Bone Measurements Of The Morkaraman Sheep, Hasan Alpak, Vedat Onar, Rifat Mutuş Jan 2009

The Relationship Between Morphometric And Long Bone Measurements Of The Morkaraman Sheep, Hasan Alpak, Vedat Onar, Rifat Mutuş

Turkish Journal of Veterinary & Animal Sciences

In this study, a total of 40 adult female Morkaraman sheep, a local Turkish breed, were used. After taking their body measurements and carcass weights, the meat was cut off the bones; the skeletal bones were then removed, macerated and every long bone weighed. Thereafter, morphometric measurements of the long bones were taken. The coefficients obtained from the correlation of osteometric measurements and morphological data were in general low (r < 0.600), though certain relationships were found to be significant. Regression of morphological variables on osteometric measurements was statistically significant. By this, regression formulas were obtained which can contribute to predict the visible morphology in zooarchaeological studies. Length measurements would be more suitable for predicting shoulder height than using width measurements of the long bone. On the other hand, body and carcass weights and chest circle would be determined more efficiently by measuring the width of long bones (Bp, Bd, SD). Furthermore, the humero-femoral index formula can be used to identify sheep in an archaeological bone collection of several animals.

Turkish Journal of Veterinary & Animal Sciences

Measurements of biomarker responses in fish from contaminated sites could provide valuable data for environmental risk assessment. Biomarkers are sensitive to both environmental pollution and confounding factors that are not related to pollution (e.g., season, nutritional status, and population density). Unfortunately, data about the latter group are scarce. Therefore, juvenile sterlet (Acipenser ruthenus L.) specimens were collected on a monthly basis from the Danube River from September 2002 through August 2003 to determine if seasonal changes exist in condition, hepatosomatic index, and parasitism. Fulton condition factor (FCF range: 0.27 - 0.79), hepatosomatic index (HSI range: 1.14 - 6.67) and Skrjabinopsolus …

Growth Response Of Yearling Buffalo Male Calves To Different Dietary Energy Levels, Homayoun Mahmoudzadeh, Hassan Fazaeli Jan 2009

Growth Response Of Yearling Buffalo Male Calves To Different Dietary Energy Levels, Homayoun Mahmoudzadeh, Hassan Fazaeli

Turkish Journal of Veterinary & Animal Sciences

To evaluate different levels of energy for optimum growth in Iranian regional buffalo male calves, a completely randomized study was conducted, using 27 yearling buffalo male calves with initial live weight of 201 ± 14 kg. Three diets were formulated to provide 90%, 100%, and 110% energy level requirements equivalent to those of steers derived from NRC beef cattle recommendations and they were fed ad libitum for 2 consecutive 90 day trial periods where the crude protein was 11.2% in the first and 10.22% in the second period. Dry matter intake of the high energy diets was significantly (P < 0.05) lower than those with lower energy contents in both periods. At both stages, daily gain was higher (P < 0.05) and feed conversion ratio improved when the animals received NRC recommended energy diets. There were no significant differences between treatments for the carcass traits with exception of abdominal fat, which was significantly affected by the energy levels (P < 0.05). It can be concluded that the optimum growth rate of buffalo male calves may be obtained by providing the NRC beef cattle standard dietary metabolizable energy from yearling to 18 months of age.
