Minority Interests, Majority Politics: A Comment On Richard Collins’ "Telluride's Tale Of Eminent Domain, Home Rule, And Retroactivity", Ashira Ostrow

Hofstra Law Faculty Scholarship

In his article, Telluride's Tale of Eminent Domain, Home Rule, and Retroactivity, Professor Richard Collins skillfully parses many of the unique legal issues that confronted the Colorado Supreme Court in Town of Telluride v. San Miguel Valley Corp. In particular, Professor Collins explores the constitutional right to a change of venue based on jury bias in an eminent domain action, the scope of Telluride's home rule power of eminent domain, and the extent to which a state statute purporting to limit such power could be retroactively applied.

Addressing Business Agility Challenges With Enterprise Systems, D. Goodhue, D. Chen, M. C. Boudreau, Ashley R. Davis Jan 2009

Addressing Business Agility Challenges With Enterprise Systems, D. Goodhue, D. Chen, M. C. Boudreau, Ashley R. Davis

Faculty Publications

It is clear that systems agility (i.e., having a responsive IT infrastructure that can be changed quickly to meet changing business needs) has become a critical component of organizational agility. However, skeptics continue to suggest that, despite the benefits enterprise system packages provide, they are constraining choices for firms faced with agility challenges. The reason for this skepticism is that the tight integration between different parts of the business that enables many enterprise systems' benefits also increases the systems' complexity, and this increased complexity, say the skeptics, increases the difficulty of changing systems when business needs change. These persistent concerns …

Marginal Zone B-Cell Precursors As Cellular Agents For Type I Ifn Promoted Antigen Transport, John Hsien Wang Jan 2009

Marginal Zone B-Cell Precursors As Cellular Agents For Type I Ifn Promoted Antigen Transport, John Hsien Wang

All ETDs from UAB

Type I IFN is a known pro-inflammatory cytokine that is associated with the development of systemic lupus erythematosus (SLE). At the level of B-cell regulation, current literature primarily attributes the formation of autoantibodies at the post-germinal center stage when type I IFN is known to promote plasmablast differentiation. However, our findings here point to a type I IFN effect at the pre-germinal stage. Type I IFN promotes T-dependent antibody response, activation-induced cytidine deaminase (AID) expression, germinal center formation, all of which are processes before the onset of plasmablast differentiation. We have determined a subset of splenic transitional B-cells, that is …

Forsaken Generation: Stress, Social Suffering And Strategies Among Working-Class Pensioners In Post-Socialist Moldova, Romania, Gerard A. Weber Jan 2009

Forsaken Generation: Stress, Social Suffering And Strategies Among Working-Class Pensioners In Post-Socialist Moldova, Romania, Gerard A. Weber

Dissertations, Theses, and Capstone Projects

This dissertation examines the lives of working-class pensioners in post-socialist, Galati, Romania. Its central thesis is that the transformation of Romania from socialism to capitalism beginning in 1989 has led to an "epidemic of stress" among retired, working-class people in the city. Marginalized by their age, class and location in the relatively economically underdeveloped region of Moldova, they have been among the hardest hit by the changes brought about with the introduction of neoliberal capitalism. Long familiar with life in a relatively stable economy, they have faced dramatic changes in this area since the revolution, including massive price instability and …

Rival Radical Feminists--Frances Willard And Ida B. Wells: The Rhetorical Slugfest Of Two Nineteenth-Century Queen Bees Over Lynching, Anita August Jan 2009

Rival Radical Feminists--Frances Willard And Ida B. Wells: The Rhetorical Slugfest Of Two Nineteenth-Century Queen Bees Over Lynching, Anita August

Open Access Theses & Dissertations

Rival Radical Feminists considers the role of gender and race as master status determining traits and examines them as influential social markers of identity and representation within a nineteenth-century feminist social movement (FSM)--the Woman's Christian Temperance Union (WCTU). Rival Radical Feminists examines how, within a FSM where gender issues understandably govern the political narrative that the philosophical core of the movement shifts into separate and competing spheres when gender issues intersect with racial prejudice? Specifically, Rival Radical Feminists argues that when both political actors are female, with one circumscribed politically by her gender, like Willard, and the other by both …

The Constant Jugglers- Single Mothers Amidst Patriarchy And University, Christopher Bordon Goldsmith Jan 2009

The Constant Jugglers- Single Mothers Amidst Patriarchy And University, Christopher Bordon Goldsmith

Open Access Theses & Dissertations

This case study juxtaposes feminist literature with an examination of single mothers pursuing an undergraduate degree in teacher education. The Patriarchy and the English language emerged as definers of cultural norms that are oppressive to outsiders. Three single mothers living on the U.S.-Mexico border were interviewed. Their stories were compared to the literature of the Patriarchy. The status quo was examined in its roles as lawmaker and as rights taker. Patriarchy and the English language emerged as definers of cultural norms that are impacting and controlling the choices of these women. Themes that emerged from the data are dependence vs. …

The Pluvial Lake Palomas - Samalayuca Dunes System, Miguel Dominguez Acosta Jan 2009

The Pluvial Lake Palomas - Samalayuca Dunes System, Miguel Dominguez Acosta

Open Access Theses & Dissertations

A lacustro-aeolian system formed by the Pluvial Lake Palomas (PLP), the Samalayuca Dunes (SMD) and a connecting aeolian corridor is found in the central Chihuahuan Desert of North America approximately 50 km upwind (SW) of the binational Paso del Norte metroplex. The system is described by its three individual components. They comprise one of the largest paleo-lacustrine (Pleistocene) environments in the Chihuahuan Desert (PLP), one of the largest and least-studied sand seas of North America (SMD), and a newly described and geomorphically heterogeneous aeolian corridor connecting the two.

The Chihuahuan Desert has been a major and underappreciated dust production region …

The purpose of this study was to obtain a better understanding of the career paths and profiles of contemporary university presidents. The study provided a broad perspective in terms of what institutions and governing boards are looking for when searching for a new president. It also helped to know the trends in those accepting these positions, namely education, career path, gender, and age. I I used the following questions to guide the focus of this study:

* RQ1. What are the demographic characteristics of current university presidents (e.g., gender, age, ethnicity, marital status, and geography)?

* RQ2. What academic and …

Oregon's Acts, Cross-Jurisdictional Collaboration And Improved Transportation Planning, Susan Brody, Richard D. Margerum Jan 2009

Oregon's Acts, Cross-Jurisdictional Collaboration And Improved Transportation Planning, Susan Brody, Richard D. Margerum

National Policy Consensus Center Publications

The Oregon Transportation Commission (OTC) created Area Commissions on Transportation (ACTs) to improve coordination, help prioritize infrastructure investment, and provide input on statewide transportation issues. The structure of the ACTs is designed to provide a cross-section of input from the state, regional, local, private, and community sectors. A research project was initiated to: assess the role and experiences of ACTs, research comparative approaches in the state and nationally, and develop and assess options for improving coordination and increasing effectiveness. This study used interviews, an on-line survey, case studies from Oregon and comparative studies from three other states to assess ACTs …

Health Disparities In Kidney Transplantation: An Equity Analysis, Shirley A. Wells Jan 2009

Health Disparities In Kidney Transplantation: An Equity Analysis, Shirley A. Wells

Occupational Therapy Faculty Publications

The growing incidence of end stage renal disease along with advances of the past 40 years that have improved the success rate of kidney transplantation have created an unprecedented demand for kidney transplant. Yet, certain racial and ethnic groups and women consistently have longer waiting times and lower rates of transplantation which makes a review of the kidney procurement and transplantation system in view of its equity imperative. Reasons given for these disparities have varied from cultural attitudes and beliefs on the part of patients and health care providers, socioeconomic status, rates of organ donation, and geographic location. The equity …

Fine-Scale Activity, Distribution And Habitat Utilization Of Atlantic Cod (Gadus Morhua) On The Ipswich Bay Spawning Ground, Laughlin Siceloff Jan 2009

Fine-Scale Activity, Distribution And Habitat Utilization Of Atlantic Cod (Gadus Morhua) On The Ipswich Bay Spawning Ground, Laughlin Siceloff

Master's Theses and Capstones

Data storage tags (DSTs) and acoustic telemetry were applied to examine cod spawning habitat utilization in Ipswich Bay and compare seasonal activity patterns. I tagged 200 spawning cod in Ipswich Bay during April--May 2006 with DSTs recording depth and temperature. Twenty-six cod were also implanted with acoustic transmitters and relocated manually and with stationary listening stations during May and June. Twenty-five DSTs were returned, showing that most cod departed the spawning ground during May and June and dispersed throughout the western Gulf of Maine. Cod shared a low vertical activity pattern in Ipswich Bay, but adopted various site-specific vertical behaviors …

Using Icesat's Geoscience Laser Altimeter System To Assess Large Scale Forest Disturbance Caused By Hurricane Katrina, Katelyn A. Dolan Jan 2009

Using Icesat's Geoscience Laser Altimeter System To Assess Large Scale Forest Disturbance Caused By Hurricane Katrina, Katelyn A. Dolan

Master's Theses and Capstones

We assessed the use of GLAS data as a tool to quantify large-scale forest damage. GLAS data for the year prior to and following Hurricane Katrina were compared to wind speed, forest cover, and MODIS NPV maps to analyze senor sampling, and changes in mean canopy height. We detected significant losses in mean canopy height post-Katrina that increased with wind intensity, from ∼.5m in forests hit by tropical storm winds to ∼4m in forests experiencing category two force winds. Season of data acquisition was shown to influence calculations of mean canopy height. There was insufficient sampling to adequately detect changes …

Patterns Of Population Structure And Productivity In Saltmarsh Sparrows, Jennifer Walsh Jan 2009

Patterns Of Population Structure And Productivity In Saltmarsh Sparrows, Jennifer Walsh

Master's Theses and Capstones

The Saltmarsh Sparrow (Ammodramus caudacutus) is one of the few species globally that is exclusively restricted to coastal wetlands. Despite the high vagility characteristic of avian species, the highly patchy distribution of tidal marshes can often lead to fine scale genetic structure in salt marsh obligates. To elucidate patterns of population structure, we investigated the degree of genetic differentiation among nine Saltmarsh Sparrow populations along the northeastern coastline of the United States. Although overall FST values were small (0.008), population substructuring was detected along with a positive correlation between geographic distance and genetic differentiation, suggesting that Ammodramus caudacutus follow an …

A Regional Scale Modeling Analysis Of Aerosol And Trace Gas Distributions Over The Eastern Pacific During The Intex-B Field Campaign, D. Adhikary, Brian G. Heikes, Et Al

Graduate School of Oceanography Faculty Publications

The Sulfur Transport and dEposition Model (STEM) is applied to the analysis of observations obtained during the Intercontinental Chemical Transport Experiment-Phase B (INTEX-B), conducted over the eastern Pacific Ocean during spring 2006. Predicted trace gas and aerosol distributions over the Pacific are presented and discussed in terms of transport and source region contributions. Trace species distributions show a strong west (high) to east (low) gradient, with the bulk of the pollutant transport over the central Pacific occurring between ~20° N and 50° N in the 2–6 km altitude range. These distributions are evaluated in the eastern Pacific by comparison with …

Trade And Income Convergence: Sorting Out The Causality, Xuepeng Liu Jan 2009

Trade And Income Convergence: Sorting Out The Causality, Xuepeng Liu

Faculty Articles

This paper studies the linkage between international trade and income convergence across countries. Different theories offer conflicting predictions regarding how they might affect each other. In the existing empirical literature estimating the trade impact on income convergence, a long-lasting problem is the reverse causality from income convergence to trade. This paper provides a disaggregated bilateral trade data analysis to solve this problem. The results show that the reverse causality from income convergence to trade exists in differentiated product sectors, but not in homogeneous product sectors. Trade in homogeneous sectors reduces the income gaps among trade partners, but it is not …

Geography Of Pestecide Exposure In The Lower Valley (El Paso County, Texas), Critina Solis Sanchez

Open Access Theses & Dissertations

Previous studies using GIS have been used to understand the demographics of particular areas of a city and the risks associated with living there. In the Lower Valley (Socorro, Clint, and San Elizario) area of El Paso County (TX), there has been a rapid growth in population. This increase in growth has led to this project about the types of pesticides used in farms and if they are creating possible health risks for people living in this area and which populations are most at risk. To determine population risk, I use existing GIS information, specifically a USDA aerial photograph taken …

Problem. Pressures created by consistently higher expectations of No Child Left Behind (NCLB) legislation are forcing school boards and professional educators to examine current practices and structures in an effort to reach Average Yearly Progress (AYP). The concept of a single-campus K-12 school may be a viable school structure that can provide an optimum learning climate while addressing academic needs to provide a well- rounded education for the children of America.

Purpose. The purpose of this study was to closely examine the school climate of a K-12 school that operated as a single entity for 20 years. The intent was …

Science Versus Religion: Protestant Dominance And Cultural Discrimination In Public Schools, Melissa Marie Brock Jan 2009

Science Versus Religion: Protestant Dominance And Cultural Discrimination In Public Schools, Melissa Marie Brock

Open Access Theses & Dissertations

This research offers a critical analysis of the current controversy concerning religion. The study explores the establishment of the public school system under Protestant dominance and use of this dominance to assert authority over minority groups. Legislation and court action have created a position of opposing policy; placing science as the opposite of religion, and Atheists and Christian activists are using curriculum as an ideological battle field. Currently, since 9/11, religious discrimination and hate crimes are on the rise. In order to investigate this controversy, this study explores literature, published surveys, and government documents. The American public school systems are …

Open Access Theses & Dissertations

This Dissertation presents an analysis and interpretation of particular aspects of the social, cultural, and ideological history of motorcycling in the US-Mexican Borderlands from 1900 to 2000. It is based on interviews with historical correspondents, archival and other documents as well as thirty years of participant reflection during which the author was immersed in biker culture. The motorcycle served as a vehicle for personal and group identity, resistance, and liberation. Issues related to identity, gender, race, marginalization and resistance, imagery, and rhetoric become clearer when considering the perspective of riders. This study surveys interactive processes that occurred between historic motorcyclists, …

Un/Commonplaces: Redirecting Research And Curricula In Rhetoric And Writing Studies, Brian J. Mcnely Jan 2009

Un/Commonplaces: Redirecting Research And Curricula In Rhetoric And Writing Studies, Brian J. Mcnely

Open Access Theses & Dissertations

Un/Commonplaces is guided by a broad and fundamental question of inquiry regarding writing and disciplinary research: how can some of the predominant ways that our discipline has approached writing be retheorized to better approximate the complexity of contemporary rhetorical knowledge work? A corollary inquiry explores the resonances with English Studies that persist--and seeks to uncover how they persist--in our field. I argue that we can negotiate such issues by tracing and troubling some of our core disciplinary commonplaces, those commonsense notions and practices too frequently and easily adopted from English Studies and perpetuated within the often tumultuous and hegemonic relationship …
