P.I.: Poetry And The Imagination, Higino Francisco V. Penones Jr.
P.I.: Poetry And The Imagination, Higino Francisco V. Penones Jr.
Master's Theses
The idea of a nation, a political concept spread during the Enlightenment with the invention of printing technology, has long been expressed through various representations. As a concept showing racial commonality and filiation, the notion of nation has been represented in various media, like printing and painting. Long before my country, the Philippines, became a sovereign state, it had been imagined and represented in various ways by early sea explorers, adventurers, writers, artists, cartographers, anthropologists, and its subsequent colonizers.
These representations, consistent with Benedict Anderson's definition of nation as an "imagined community," underlies this creative thesis project. My poems attempt …

A Case Study Of The State University, Extension, And The College Of Agriculture As They Explore And Implement A Metro Research And Outreach Initiative, Deno Deciantis
Electronic Theses and Dissertations
The national Cooperative Extension and Land Grant University Systems have been struggling with their future direction due to the question of relevance related to urban and metropolitan citizens for a great number of years. This system is quite traditional in that it follows the customary rural, production agriculture focus with an overwhelming percentage of its resources aimed at those efforts. At the State University, like most other traditional land grant institutions, there has been an inner systemic struggle regarding programming to urban areas. This institution was able to establish a metro initiative in one of the state's major cities. Its …
Saving The "Slaves Of Kings And Priests": The United States, Manifest Destiny, And The Rhetoric Of Anti-Catholicism, Michael Solomon
Saving The "Slaves Of Kings And Priests": The United States, Manifest Destiny, And The Rhetoric Of Anti-Catholicism, Michael Solomon
Electronic Theses and Dissertations
This paper seeks to demonstrate how anti-Catholicism, like other domestic issues such as race, economics, and politics, influenced U.S. foreign policy toward Latin America during the first half of the nineteenth century. Catholicism, the Roman Catholic Church, and monarchism/despotism were all seen by U.S. elites as interconnected forces that undermined the growth and stability of republicanism in Latin America. U.S. politicians were able to manipulate anti-Catholic rhetoric in order to justify certain U.S. diplomatic policies toward Latin America. Anti-Catholic rhetoric could be separated into missionary and exclusionary arguments. Followers of Manifest Destiny utilized missionary anti-Catholic rhetoric to sanction U.S. territorial …
America’S Other Half: Slum Journalism And The War Of 1898, John Patrick Leary
America’S Other Half: Slum Journalism And The War Of 1898, John Patrick Leary
English Faculty Research Publications
This article treats the links between the 1890s literature of urban reform in the United States, which focused on the downtown "other half" of New York, and the war literature of 1898, when American troops intervened in Cuba's war of independence. The article focuses on the work of Stephen Crane, who worked as a New York police reporter, slum novelist, and Cuba war correspondent in this turbulent decade. Leary shows how, in the martial culture of the American 1890s, the rhetoric of militarism informed the practice of urban reform, while the rhetoric of urban reform informed the military campaign in …
Tv Urgente: Urban Exclusion, Civil Society, And The Politics Of Television In Venezuela, John Patrick Leary
Tv Urgente: Urban Exclusion, Civil Society, And The Politics Of Television In Venezuela, John Patrick Leary
English Faculty Research Publications
This essay explores the politics of representation in contemporary Venezuelan television, which in its mainstream forms has produced an urban imaginary that models national citizenship on the geographic, class, and racial divisions of the Venezuelan metropolis. The nation's airwaves have been a crucial theater of partisan class conflict in Venezuelan society since the election of President Hugo Chávez, a radical social democrat who has counted on the residents of the nation's huge urban slums, or barrios, as a major constituency. This study concentrates on the two major antagonists in this televisual battle by exploring their visual content and production methods …

Public School Board Governance Practices In Western Pennsylvania And Ayp Scores; Is There A Relationship?, Kyle William Foust
Public School Board Governance Practices In Western Pennsylvania And Ayp Scores; Is There A Relationship?, Kyle William Foust
Electronic Theses and Dissertations
This study investigated what, if any, relationship exists between school board governance practices and student achievement as demonstrated by a school district's Adequate Yearly Progress (AYP) scores in both math and reading for 2007-2008 school year. To measure the effectiveness of governance practices, a survey created by Thomas Holland and adapted by Richard Smoley (1999), which empirically assesses the performance of school boards, was administered to members of the following types of public school boards: urban, suburban, rural, and charter. Smoley's survey measures six dimensions of effectiveness: Decision Making, Functioning as a Group, Exercising Authority, Connecting to the Community, Working …
Human Development As Integral Development: The Social Teaching Of The Church In An African Context, Joseph Kariuki Kamau
Human Development As Integral Development: The Social Teaching Of The Church In An African Context, Joseph Kariuki Kamau
Electronic Theses and Dissertations
It has been commonly held that the main cause of underdevelopment is the lack of capital. This dissertation is based on the observation that underdevelopment still persists in Kenya despite billions of dollars in foreign aid from Western Europe and North America. The main focus of this dissertation is an attempt to understand an effective remedial action to such an economic situation of underdevelopment. The dissertation seeks to find the remedy for underdevelopment by the methodological means of demonstrating how a holistic understanding of human development entails integral development in Kenya.
The thesis and the overview of this dissertation are …

Re-Visioning Into Third Space: Autobiographies On Losing Home-And-Homeland, Debbie Sonu, Seungho Moon

As one Asian and one Asian American both currently living in New York City, we explore the possibilities of transnational experience as a space of the real-and-imagined, as a potential Thirdspace. Moving away from humanist assumptions of dueling dualities in the formation of identity, we seek a place that collapses social and temporal borders and transgresses geographical and physical sites. For us, challenging the essentialisms that con-fine our sense of Asian-ness in America requires that we acknowledge the material and social present, while conceiving of a Thirdspace where all such qualities are inseparable, interdependent, simultaneous, and holistic. We use autobiographies …

From Here To Beijing: Public/Private Overlaps In Trade And Their Effects On U.S. Law, Elizabeth Trujillo
From Here To Beijing: Public/Private Overlaps In Trade And Their Effects On U.S. Law, Elizabeth Trujillo

Recent news involving contaminated pet food and unsafe toys imported from China makes us question the legal frameworks that facilitated such incidences and stirs anti-globalization sentiment. While consumers wonder about the role of their governments in this context and look for judicial remedies, deeper questions arise regarding the international forces lying beneath the surface of the legal remedial work of our domestic courts. This paper explores the international trade paradigm in place that facilitates the inner workings of private investors and has trickling effects on domestic law. Furthermore, it will show that the trade regime is transnational in nature, consisting …
Disestablishing Environmentalism, Andrew P. Morriss, Benjamin D. Cramer
Disestablishing Environmentalism, Andrew P. Morriss, Benjamin D. Cramer
Faculty Scholarship
The debate over environmental policy is increasingly conducted in language with strong religious overtones. Both proponents and opponents of various environmental policies appeal to religious doctrine to support their positions: Those who question human-caused global warming are labeled "heretics, " while appeals for environmental "stewardship" echo Biblical texts. Religious groups play an important role in defining environmental policy issues, and both supporters and critics of specific environmental policy views have labeled particular sets of beliefs about the environment a "religion." In this Article we engage in a thought experiment, arguing that there are valuable lessons to be learned from treating …
Understanding The New Virtualist Paradigm, Jonathon Penney
Understanding The New Virtualist Paradigm, Jonathon Penney
Articles, Book Chapters, & Popular Press
This article discusses the central ideas within an emerging body of cyberlaw scholarship I have elsewhere called the "New Virtualism". We now know that the original "virtualists"- those first generation cyberlaw scholars who believed virtual worlds and spaces were immune to corporate and state control - were wrong; these days, such state and corporate interests are ubiquitous in cyberspace and the Internet. But is this it? Is there not anything else we can learn about cyberlaw from the virtualists and their utopian dreams? I think so. In fact, the New Virtualist paradigm of cyberlaw scholarship draws on the insights of …
Metals Or Management? Explaining Africa's Recent Economic Growth Spurt, Laura Nyantung Beny, Lisa D. Cook
Metals Or Management? Explaining Africa's Recent Economic Growth Spurt, Laura Nyantung Beny, Lisa D. Cook
Articles
Explanations for Africa's poor long-run growth performance have varied over time. The theories examined include geography (Jeffrey D. Sachs and Andrew Warner 1997); institutions (William Easterly and Ross Levine 1997; Daron Acemoglu, Simon Johnson, and James Robinson 2001, 2002; Nathan Nunn 2007, 2008); health (David Bloom and Sachs 1998; Gregory N. Price 2003); and economic dependency (William Darity 1982). More recently, economists have attempted to explain what The Economist has called Africa's new "period of unparalleled economic success" (The Economist 2008a, 33). Average annual real GDP growth was 1.8 percent between 1980 and 1989 and increased to 4.4 percent between …
Getting Real About Race And Prisoner Rights, Michael B. Mushlin, Naomi Roslyn Galtz
Getting Real About Race And Prisoner Rights, Michael B. Mushlin, Naomi Roslyn Galtz
Fordham Urban Law Journal
This Article explores the connection between the dramatic increases in the incarceration of non-whites and the parallel decline in the legal protections for prisoners over the same period. Using the social sciences, the Article suggests that racial tensions play a role in the decisions made by both guards and prison administrators. Further, the authors argue that the communities of these non-white prisoners are the least well equipped to advocate for their well-being. Ultimately, the Article concludes that the law is not currently equipped to confront the possibility of dealing with race-based tensions and structural inequities that are present in the …
Global Cities And The Governance Of Climate Change: What Is The Role Of Law In Cities?, Heike Schroeder, Harriet Bulkeley
Global Cities And The Governance Of Climate Change: What Is The Role Of Law In Cities?, Heike Schroeder, Harriet Bulkeley
Fordham Urban Law Journal
This Article examines how global cities are governing climate change. Part I of this Article provides an overview of the national and international contexts of urban climate governance focusing on the United Kingdom and the United States. Parts II and III analyze London and Los Angeles, respectively, as examples of global cities. They provide a thorough examination of climate change policies and actions in these two cities, based on approximately thirty in-depth interviews with government, business and civil society representatives during 2007-08, as well as official documents and grey literature. Part IV then examines the modes of governance to understand …
Cities And Accessibility: The Potential For Carbon Reductions And The Need For National Leadership, Keith Bartholomew
Cities And Accessibility: The Potential For Carbon Reductions And The Need For National Leadership, Keith Bartholomew
Fordham Urban Law Journal
This article begins by outlining the elements that should be included in the framework for understanding how people interact with their built environments. Part II describes how the framework might be made operational through the use of an emerging technique called land-use transportation scenario planning. Part III assesses how well land-use transportation scenario planning fits within the dictates and limits of U.S. transportation law. The analysis ultimately reveals that it holds substantial promise as a tool that could lead to meaningful cuts in carbon emissions.
The High Cost Of Segregation: Exploring Racial Disparities In High-Cost Lending, Vicki Been, Ingrid Ellen, Josiah Madar
The High Cost Of Segregation: Exploring Racial Disparities In High-Cost Lending, Vicki Been, Ingrid Ellen, Josiah Madar
Fordham Urban Law Journal
This article argues that policy makers addressing racial disparities in the share of subprime mortgages must take into account the relationship between existing levels of racial segregation and the racial disparities in the types of mortgages homeowners received. The authors examine approximately 200 metropolitan areas across the country and note the significant racial disparities in the percentage of subprime mortgages received by different racial groups. Various mechanisms that explain these racial disparities are also explored. The authors ultimately conclude that residential segregation plays a significant role in shaping lending patterns.
The City And International Law: In Pursuit Of Sustainable Development, Ileana M. Porras
The City And International Law: In Pursuit Of Sustainable Development, Ileana M. Porras
Fordham Urban Law Journal
This article argues that the internationalization of cities and the localization of sustainable development have combined to turn cities into the international loci of sustainable development. The author contends that while it is positive that cities are willing to engage in addressing sustainable development and climate change, there are dangers in allowing cities to take on the primary function of defining sustainable development. Problems caused by privatization of city services and the tendency of cities to consider local interests primary in engaging in the trade-offs required by sustainable development are discussed. Finally, the author concludes that sustainable development requires a …
The Odyssey Of Palazzolo: Public Rights Litigation And Coastal Change, Laura J. Hatcher, Ph.D.
The Odyssey Of Palazzolo: Public Rights Litigation And Coastal Change, Laura J. Hatcher, Ph.D.
Fordham Urban Law Journal
The question of whether the state has the right to “take” (in the form of regulation) land in its coastal zones is a much more complex question that the courts, to date, have not been able to manage adequately. The problems faced along the coasts are difficult problems, and will likely not be settled by asking judges to determine the “rightness” of claims made through an adversarial process that tends to oversimplify situations in the process of constructing winnable legal arguments. Nor can we rely simply on administrative agencies or legislatures to protect the rights of individuals or protect them …
‘Dis Poem Is Vex Bout Apartheid’: Representations Of South Africa In Three West Indian Poems, David Álvarez
‘Dis Poem Is Vex Bout Apartheid’: Representations Of South Africa In Three West Indian Poems, David Álvarez
Peer Reviewed Articles
This article examines the ways in which three West Indian poems written between 1979 and 1992 – “Soweto” by Kamau Brathwaite, “Bedspread” by Lorna Goodison and “We Are Formed from Volcanoes” by Opal Palmer Adisa – engage the history of South Africa under apartheid. I argue that while Africa as a place with its own historical destiny is rarely encountered in West Indian literature, the texts that I probe constitute a minor yet important exception to this rule. At the same time, however, it is clear that the three poets and others who have written or sung about Africa and …
Rural Life Census Data Center Newsletter: South Dakota Net Migration Estimates, Trevor Brooks, Joel Vargas, Michael Mccurry
Rural Life Census Data Center Newsletter: South Dakota Net Migration Estimates, Trevor Brooks, Joel Vargas, Michael Mccurry
Census Data Center Newsletter Archive: 2007-2010
Migration brings important changes for both migrants and communities. Migration into a community can mean a new community dynamic: individuals who migrate bring their views of the world with them, and sometimes these ideas, values, and beliefs breed conflict (Blau 1994). And migration out of a community also can bring change: rural counties with high out-migration rates may also experience long-term economic hardships (Johnson 2006). South Dakota is affected by both in-migration and out-migration.
Fast-Fish, Loose-Fish: How Whalemen, Lawyers, And Judges Created The British Property Law Of Whaling, Robert Deal
Fast-Fish, Loose-Fish: How Whalemen, Lawyers, And Judges Created The British Property Law Of Whaling, Robert Deal
Studio for Law and Culture
Anglo-American whalemen in the eighteenth and nineteenth centuries used customs largely of their own creation to resolve disputes at sea over contested whales. These customs were remarkably effective as litigation was rare and violence even rarer. Legal scholars such as Robert Ellickson have correctly pointed to these customs as an example of how close knit communities settle disputes without recourse to formal legal institutions or even knowledge of the applicable law. Ellickson’s belief, however, that these whaling customs were universally followed at sea and were – in turn – adopted by courts, is not entirely accurate. While courts often deferred, …

Post-Traumatic Stress In Flight Attendant's Labor, Filipieva Tatiana Phd
International Symposium on Aviation Psychology - 2009
Airline crashes, hijackings, turbulence incidents and other emergencies have the potential for inflicting severe emotional trauma in flight attendants involved either directly or indirectly. A critical incident is a part of the extreme professions in aviation. Although the aviation industry attempted to bring help following an air disaster, post-traumatic stress is still one of the most misdiagnosed and ignored illnesses that can beset an individual. In the article, which is based on the results of Russian and American aviation psychologists’ research, we try to answer the questions: How post-traumatic stress affects cabin crew’s work performance and flight attendants’ life? How …
Risk Assessment In Aviation, Robert Mauro, Immanuel Barshi
Risk Assessment In Aviation, Robert Mauro, Immanuel Barshi
International Symposium on Aviation Psychology - 2009
In aviation, many actions are taken to reduce risk. However, not all risks can be avoided. To effectively manage risk, managers and regulators must evaluate and compare risks associated with different threats. Yet, it is frequently difficult to obtain reasonable assessments of these risks. Traditional approaches often produce unsatisfactory results when the probability of failure is low but the costs of failure are high -- as is often the case in modern civil aviation. Attempts to use a single dimension to evaluate threats often lead to unreliable and contentious assessments. Many risk assessment heuristics and displays can yield misleading and …
