Eight Perspectives On Yvon Neptune V. Haiti, Jens Iverson Jan 2009

Eight Perspectives On Yvon Neptune V. Haiti, Jens Iverson

UC Law SF International Law Review

Yvon Neptune v. Haiti is a noteworthy decision of the Inter- American Court of Human Rights, with potentially wide-ranging impacts. The Court ordered a wholesale change in the Haitian prison system in order to prevent Haiti from violating former Haitian Prime Minister Yvon Neptune's rights again. Haiti violated Articles 1 (obligation to respect rights), 5 (humane treatment), 7 (personal liberty), 8 (fair trial) and 25 (the right to judicial protection) of the American Convention on Human Rights. Haitian and U.S. human rights groups worked together with a "virtual" human rights clinic to trigger the decision by filing a petition with …

It's Just Business, Or Is It: How Business And Politics Collide With Sovereign Wealth Funds, Matthew Saxon Jan 2009

It's Just Business, Or Is It: How Business And Politics Collide With Sovereign Wealth Funds, Matthew Saxon

UC Law SF International Law Review

Over the past few years, sovereign wealth funds have played an increasingly important role in the global financial system. This note seeks to shed light on the foreign investment vehicles known as sovereign wealth funds (SWF's). In the first section I will explain what a sovereign wealth fund is; why regulators in the U.S. and European have recently become concerned with them; and how SWF's have reacted to these concerns. In the second section, I will compare and contrast the strategies that U.S. and European regulators have employed in adjusting to these funds. Finally, I will argue that lawmakers in …

Deliberative Democracy In Severely Fractured Societies, Adeno Addis Jan 2009

Deliberative Democracy In Severely Fractured Societies, Adeno Addis

Indiana Journal of Global Legal Studies

The world is full of boundaries. Whatever their nature, boundaries provide the conditions for communal or individual identity and agency, and they make collective action possible. That very capacity to define and contain, however, allows boundaries to "close off possibilities of being that might otherwise flourish." Paradoxically, boundaries "both foster and inhibit freedom." This article explores how one particular boundary-ethnicity- has served both as an important source of identity and a cause of deep fracture in societies that this article calls "severely fractured." The purpose of the article is to explore what institutional structures and processes might be appropriate to …

A Framework For Understanding Accountability Of International Ngos And Global Good Governance, Michael Szporluk Jan 2009

A Framework For Understanding Accountability Of International Ngos And Global Good Governance, Michael Szporluk

Indiana Journal of Global Legal Studies

International non-governmental organizations (INGOs) promote good governance through global advocacy and through relief and development work. This article focuses on the latter role. While there are legitimate criticisms of INGOs' lack of accountability, this article argues that a review of the different stakeholders in the relief and development sector and their relationships with one another reveals valuable information about what accountability means and to whom stakeholders should be accountable. The article posits that INGOs should be accountable, above all, to the communities where they are implementing projects. Finally, the article points to many efforts being undertaken by INGOs to improve …

The Public Land Manager In Collaborative Conservation Planing: A Comparative Analysis Of Three Case Studies In Montana, Lawrence Allen Byrd Jan 2009

The Public Land Manager In Collaborative Conservation Planing: A Comparative Analysis Of Three Case Studies In Montana, Lawrence Allen Byrd

Graduate Student Theses, Dissertations, & Professional Papers

Collaborative Conservation Planning (CCP) has proven to create solutions to challenges many Montana and Americans face with protecting or restoring their natural resources and rural lifestyles from previous non-sustainable land use practices and rural land development. This planning model has proven to be successful when organized groups consisting of multiple stakeholders come together to find common ground and address decreased biodiversity, fragmented habitat, threatened traditional farming, timber, and ranching rural lifestyles through open space protection and restoration efforts. The Public Land Manager’s (PLM) part in the CCP process is seemingly important because of their influence and the unique and diverse …

Summer Burrows Of Ord's Kangaroo Rats (Dipodomys Ordii) In Western Nebraska: Food Content And Structure, Jeremy A. White Jan 2009

Summer Burrows Of Ord's Kangaroo Rats (Dipodomys Ordii) In Western Nebraska: Food Content And Structure, Jeremy A. White

Biology Faculty Publications

Extent of larder hoarding differs among species of kangaroo rats, and limited information is available for food stored in burrows by Ord's kangaroo rat (Dipodomys ordii)—the most widespread species of Dipodomys. I excavated 9 burrows recently used by adult D. ordii during summer in the Sandhill Region of Nebraska. I observed only small quantities of food stored in burrows. Eight of 9 burrows contained segments of sand dropseed (Sporobolus cryptandrus) in limited quantities. These segments consisted of upper leaves with fruits (containing seeds) housed in sheaths. My observations represent the first documentation of D. ordii storing food in burrows under …

The Margins Of Us Trade, Andrew B. Bernard, J. Bradford Jensen, Stephen J. Redding, Peter K. Schott Jan 2009

The Margins Of Us Trade, Andrew B. Bernard, J. Bradford Jensen, Stephen J. Redding, Peter K. Schott

Dartmouth Scholarship

Recent research in international trade emphasizes the importance of firms’ extensive margins for understanding overall patterns of trade as well as how firms respond to specific events such as trade liberalization. In this paper, we use detailed U.S. trade statistics to provide a broad overview of how the margins of trade contribute to variation in U.S. imports and exports across trading partners, types of trade (i.e. arm’s-length versus related-party) and both short and long time horizons. Among other results, we highlight the differential behaviour of related-party and arm’s-length trade in response to the 1997 Asian financial crisis.

The goal of this project was to perform plant inventories for silvery phacelia and kinnikinnick that will be used to establish a functional management plan for the Preserve. Other resources of interest to the Preserve have been included in the …

The Invention Of Legal Primitivism, Steven Wilf Jan 2009

The Invention Of Legal Primitivism, Steven Wilf

Faculty Articles and Papers

This Article addresses a different sort of legal transplant - one in which outside legal doctrines are imported in order to be cabined, treated as normative counterpoints, and identified as the legal other. Legal primitivism is a kind of anti-transplant. It heightens the persistent differences between a dominant legal system and its understanding of primitive rules. An often ignored legal literature depicting legal primitivism emerged in the second half of the nineteenth century and in the early twentieth century. Mapping the differences between America’s modern legal system and its antecedents, this immense literature, which included works by Oliver Wendell Holmes, …

A Natural History Of The Mind : Edwards, Emerson, Thoreau, Melville, Michael Edmund Jonik Jan 2009

A Natural History Of The Mind : Edwards, Emerson, Thoreau, Melville, Michael Edmund Jonik

Legacy Theses & Dissertations (2009 - 2024)

This project examines how eighteenth- and nineteenth-century American writers drew on European natural science and philosophy - specifically in terms of concepts of form, perception, and experience - to open new possibilities for thinking the relationship between the mind and the physical world. In each of the moments of American intellectual history here considered - the natural theology of Calvinism, the idealistic natural history of Transcendentalism, and the movement towards an evolutionary process-philosophy of Pragmatism - "place" becomes not only geographical location, but a dynamic field of interactions of natural historical, literary, theological, and philosophical knowledge. I trace this through …

White Institutional Presence : The Impact Of Whiteness On Campus Climate & The Relational Context Of White Institutional Presence, Diane Lynn Gusa

Legacy Theses & Dissertations (2009 - 2024)

This dissertation purports to offer a new lens on the retention puzzle of African-Americans in Predominately White Institutions. The purpose of this paper is to notice the properties of a PWI and analyzes the relational context these properties create for its African-American undergraduates. This dissertation is formatted into two sections. The first section frames, examines, and theorizes the "racism effect" in higher education - the "ways in which race and racism explicitly and implicitly impact on the educational structures, processes, and discourses that affect people of color" (LatCrit Primer, 2000, p. xx). I maintain that African-Americans' experiences of marginalization and …

The Effects Of Leadership And Authority On Cross-Boundary Information Sharing In Response To Public Health Crises : A Comparative Study Between The United States And Jordan, Fawzi H. Mulki Jan 2009

The Effects Of Leadership And Authority On Cross-Boundary Information Sharing In Response To Public Health Crises : A Comparative Study Between The United States And Jordan, Fawzi H. Mulki

Legacy Theses & Dissertations (2009 - 2024)

Regardless of national context, cross-boundary information sharing is inevitably entangled with issues of jurisdiction, leadership, and authority. This study answers the question: "to what extent do officials in the United States and Jordan share key leadership characteristics and how are officials' uses of authority similar or different?"

The Effect Of Vegetated Roofs On Acid Precipitation Runoff, Jennifer Gillen Jan 2009

The Effect Of Vegetated Roofs On Acid Precipitation Runoff, Jennifer Gillen

Geology Theses and Dissertations

Vegetated, or “green” roofs are used in urban architecture and sustainable building to capture stormwater and enhance urban wildlife. Most research to date has focused on their water retention capabilities, but green roofs also have the potential to treat anthropogenic acid precipitation in urban environments. More specifically, green roofs could reduce sulfate, nitrate and hydrogen ion concentrations in runoff. One previous study has demonstrated that nitrate was reduced in water draining from a green roof (Berndtsson, et al. 2006), but this unpublished thesis appears to be the first comprehensive study of the effects of vegetated roof materials on major ions …

Combining historical analysis, secondary source material, and extensive interviews with police officials and officers, it seeks to examine the underlying structural constraints and resources that lead these cities to internationalize their counterterrorism efforts.

The Cultural And Literary Discourse Of War In 20th Century America, Robert Michael Ficociello Jan 2009

The Cultural And Literary Discourse Of War In 20th Century America, Robert Michael Ficociello

Legacy Theses & Dissertations (2009 - 2024)

In The Cultural and Literary Discourse of War in 2oth-century America, war is re-examined and re-historicized from an American perspective. First, war is contextualized in relation to urban studies, anthropology and literature. The dominant model, war is an extension of politics, for the analysis of war is decentered, and politics becomes the extension of war. In respect to America since the Revolutionary War, the nation is literally birthed from war, and the nation becomes an extension of that war. The perpetual re-writing of that war is seen through the discourses of history, politics, and literature. Therefore, the Cold War can …

Surrogate Freedom: Transmitting Democracy To The Soviet Union And Eastern Bloc, Lauren Nelson, '09 Jan 2009

Surrogate Freedom: Transmitting Democracy To The Soviet Union And Eastern Bloc, Lauren Nelson, '09

Honors Projects

While currently relocating to a building away from the center of Prague, since 1995, Radio Free Europe/Radio Liberty (RFE/RL) has been headquartered in the former Czechoslovakian parliament building. The former President of Czechoslovakia, Vaclav Havel, invited the radios to move from Munich to Prague and occupy the parliament building for a symbolic dollar a year rent. This gesture of historical irony is especially appropriate in considering the history of international radio broadcasting: a building representative of Communism was converted into the headquarters for radio stations extolling the benefits of democratic media. This symbolic move signifies one of the paradoxes of …

Explaining Human Influences On Carbon Dioxide Emissions Across Countries, Karin Peterson, '09 Jan 2009

Explaining Human Influences On Carbon Dioxide Emissions Across Countries, Karin Peterson, '09

Honors Projects

Global climate change is a vital issue facing the planet today, posing significant risks to both humans and the natural environment. This dangerous phenomenon is largely caused by the release of carbon dioxide into the atmosphere, resulting from such activities as energy production and vehicle travel This paper examines the factors leading to differences in carbon dioxide emissions among countries, including income, energy use, and government institutions. A crosssectional regression indicates that an inverted-U relationship exists between per capita income and carbon dioxide emissions, but that the turning point at which pollution begins to decrease occurs at a very high …

Information In Isolation: Gossip And Rumor During The Uk 2001 Foot And Mouth Crisis – Lessons Learned, Christine Hagar

Faculty Publications

The 2001 foot and mouth disease (FMD) outbreak con stituted the biggest crisis ever to affect the UK farming system; it was one of the worst epidemics of its kind in the world. Farmers and rural communities were disrupted and traumatized as FMD spread rapidly through the whole of the country. The crisis unfolded as a series of information and communication problems, primarily from government to farmers, with consequences for action in a time of crisis. Farmers needed information at the different stages of the crisis to inform them about the various processes and procedures that had to be carried …

Supporting Youth Boundary Crossing: Intertextuality As A Component Of Design For Information And Visual Literacy, Kristen Rebmann (Clark) Jan 2009

Supporting Youth Boundary Crossing: Intertextuality As A Component Of Design For Information And Visual Literacy, Kristen Rebmann (Clark)

Faculty Publications

This article charts attempts to derive a theoretically guided approach to engaging children in boundary crossing toward literacies and practices associated with the Age of Information. Using Fifth Dimension (5D) afterschool programs as laboratories for informal learning design, interventions were designed to explore the extent to which youth cultures and literacies can be used as intertextual gateways to more educative practices associated with visual and information literacy. Intertextuality is introduced as a concept to consider the relevance of using semantic relationships between popular and educative texts to inform learning design for afterschool programming.

Demographic Data For Development In Sub-Saharan Africa, Wendy Baldwin, Judith A. Diers Jan 2009

Demographic Data For Development In Sub-Saharan Africa, Wendy Baldwin, Judith A. Diers

Poverty, Gender, and Youth

More demographic data are being collected throughout the developing world than ever before, but the effective use of that data to further development goals is often lacking. This working paper summarizes case studies on the demand for data in four sub-Saharan African countries, namely Ethiopia, Ghana, Senegal, and Uganda. The project’s objective was to create a detailed portrait of access and demand at the country level, and to determine whether policymakers are getting the data they need to develop sound policies. Common findings across the four countries include an increased external demand from international initiatives that has not necessarily translated …

Demographic Data For Development: Overview Report, Wendy Baldwin, Judith A. Diers Jan 2009

Demographic Data For Development: Overview Report, Wendy Baldwin, Judith A. Diers

Poverty, Gender, and Youth

The Data for Demographic Development case studies examined the demand for data in four sub-Saharan African countries. The project focused on the views of policymakers, the data they use, the data they want but do not receive, and what they might use but do not request. The underutilization of existing data was explored as was factors that limit the collection, use, and sharing of data. Case studies explored how access to data might be improved. The project’s objective was to create an intimate portrait of access and demand at the country level, thereby complementing the wide array of international initiatives …

The Church And Convento Of Santo Domingo Yanhuitlan, Oaxaca: Art, Politics, And Religion In A Mixtec Village, Sixteenth Through Eighteenth Centuries, Alessia Frassani

Dissertations, Theses, and Capstone Projects

The mission-building campaign undertaken in the Americas in the years following the Spanish conquest (1521-1546) is the largest and most ambitious evangelical and artistic enterprise in the history of the Catholic Church. In the span of just a few decades, Spanish mendicant friars, at the head of the missionary efforts, established hundreds of conventos (missions) in both colonial cities and provinces. These institutions did not merely accommodate friars. Planned to carry out doctrinal, educational, and liturgical activities, they soon became booming economic and cultural centers.

This dissertation focuses on the convento in the Mixtec town of Yanhuitlan in Oaxaca, southwestern …
