Getting Real About Race And Prisoner Rights, Michael B. Mushlin
Getting Real About Race And Prisoner Rights, Michael B. Mushlin
Elisabeth Haub School of Law Faculty Publications
This Article explores the nexus of two stories central to contemporary American jurisprudence and--for tens of millions of citizens--central to the American experience: the rise of the “carceral state” through steep increases in the incarceration of non-whites, and the decline, over the very same period, in legal protections for prisoners. The Article suggests that these two stories cannot be considered in isolation from one another. Nearly everything we know about race from the social sciences suggests that, in the highly pressured context of prison life, racial tensions will play a role in the decisions that guards and administrators make concerning …

The History Of The Potato In Irish Cuisine And Culture, Mairtin Mac Con Iomaire, Pádraic Óg Gallagher
The History Of The Potato In Irish Cuisine And Culture, Mairtin Mac Con Iomaire, Pádraic Óg Gallagher
Conference papers
Few plants have been as central to the destiny of the nation as the potato (Solanum tuberosum) has been to Ireland. Ireland was the first European country to accept the potato as a serious food crop. From its introduction in the 16th Century, the potato has held a central place in the Irish diet, and by extension, in the culture of Ireland (Choiseul, Doherty et al. 2008:3). Potato growing is very suited to the Irish climate and soils, although both excessive and insufficient rainfall at certain times of the growing season can pose disease risks, the biggest of which is …

Recruiting Urban Latina Adolescents And Their Families: Challenges And Lessons Learned In Suicide Attempts Research, Luis H. Zayas, Carolina Hausmann-Stabile, Allyson M. Pilat
Graduate School of Social Work and Social Research Faculty Research and Scholarship
Recruiting samples with unique characteristics dispersed across services and geography is hard to identify because of legal status and stigma create research challenges. Public health, however, requires sustained recruitment efforts. We describe challenges and solutions in recruiting urban adolescent Latinas who had attempted suicide. Procedures for recruitment and human subject protections were established, yet logistic obstacles emerged. Program directors failed to support the research; therapists were slow to identify subjects and to meet inclusionary criteria; numbers of prospective participants were lower than originally calculated; girls and parents were hard to reach; and interview appointments were missed. From challenges came solutions: …

The Future Of Fair Housing And Fair Credit: From Crisis To Opportunity, Symposium: New Strategies In Fair Housing, John A. Powell, Jason Reece
Cleveland State Law Review
The following paper provides an assessment of the current housing and credit crisis from a racial justice lens. The paper explores how race was interwoven into the current crisis and demonstrates the racialized impacts of the housing and credit crisis. We also explore some of the current challenges facing fair housing in our society, presenting concepts and models of reform to promote true integration with opportunity. We close with a new paradigm for addressing fair housing in the future and utilizing the opportunities presented by this crisis to produce a fair housing opportunity and a just society for all.

This Note will examine commodity theory as a system for assigning punishment for sexual offenses in the context of the 2007 circuit split over defining “crime of violence” under § 2L1.2 of the Sentencing Guidelines. Part II will discuss the problem of punishing sex offenses and describe Donald Dripps' proposed commodity theory solution. Part III will discuss criticisms of using commodity theory as a basis for punishing sexual offenses. Part IV will provide background information on the U.S. Sentencing Guidelines generally and § 2L1.2 of the Guidelines specifically and explain why the circuit split serves as an ideal opportunity to …
Rankings And The Battle For World-Class Excellence: Institutional Strategies And Policy Choices, Ellen Hazelkorn
Rankings And The Battle For World-Class Excellence: Institutional Strategies And Policy Choices, Ellen Hazelkorn
Articles
Global rankings are creating a furore wherever or whenever they are published or mentioned. They have become a barometer of global competition measuring the knowledge-producing and talent-catching capacity of higher education institutions. These developments are injecting a new competitive dynamic into higher education, nationally and globally, and encouraging a debate about its role and purpose. As such, politicians regularly refer to them as a measure of their nation’s economic strength and aspirations, universities use them to help set or define targets mapping their performance against the various metrics, while academics use rankings to bolster their own professional reputation and status. …

Animals In The Classroom: Implications And Implementation, Christen Lynn Robinson
All Graduate Projects
The role of animals in the classroom through Animal Assisted Therapy is examined. The benefits and risks are outlined and discussed. Specific measures to decrease related risks are given. A look at Animal Assisted Therapy from the perspective of the animal itself is also explored. Does the practice exploit animals? The research suggests that it depends upon the type of animal used. A Power Point presentation explaining the benefits of Animal Assisted Therapy is provided. The target audience for the presentation is educators interested in implementing an Animal Assisted Therapy program within the school setting. The presentation clearly outlines the …

Challenging Monohumanism: An Argument For Changing The Way We Think About Intercountry Adoption, Shani King
Michigan Journal of International Law
In Part I, this Article provides a brief history of ICA. In Part II, using a post-colonialist theoretical framework, the work of legal scholars from the past twenty years on the subject of ICA is explored. This analysis exposes the centrality of MonoHumanism to our discourse on ICA. In Part III, this Article illustrates how our discourse regarding intercountry adoption contributes to our violating the rights of children (and families) as they are defined in the CRC. Lastly, in Part IV, this Article explores how this argument fits into the current and somewhat polarized debate on ICA and how the …

Social Movements And Judging: An Essay On Institutional Reform Litigation And Desgregation In Dallas, Texas, Darren Lenard Hutchinson
UF Law Faculty Publications
This Article discusses the political and legal barriers that have surfaced to undermine the ability of courts to fashion remedies that offer justice to aggrieved individuals and to render rights-based institutional reform litigation a judicial relic. Part II examines the historical development of institutional reform litigation and examines the political factors that created the opportunity for dramatic changes in legal approaches to the issue of racial inequality. Part III examines litigation challenging segregation in Dallas public schools. It also discusses cases filed in the immediate post-Brown v. Board of Education era and contrasts those cases with Judge Sanders's rulings on …

Challenging Monohumanism: An Argument For Changing The Way We Think About Intercountry Adoption, Shani M. King
UF Law Faculty Publications
The Convention on the Rights of the Child' (CRC) provides a legal framework that establishes a child's right to be raised in the context of her family and her culture. We regularly violate this most fundamental right of children because we fail to come to terms with our imperialist orientation toward the world. This failure has been caused, in part, by how we have constructed our way of thinking about intercountry adoption. We now have a conception of intercountry adoption that I refer to in this Article as MonoHumanism. In the context of intercountry adoption, MonoHumanism means that children …

Detecting Bedform Migration From High-Resolution Multibeam Bathymetry In Portsmouth Harbor, New Hampshire, Usa, Janice A. Felzenberg
Detecting Bedform Migration From High-Resolution Multibeam Bathymetry In Portsmouth Harbor, New Hampshire, Usa, Janice A. Felzenberg
Master's Theses and Capstones
A study was undertaken to quantify dune migration in Portsmouth Harbor, New Hampshire, USA from repeat high-resolution multibeam echosounder (MBES) surveys. Repeat MBES surveys were conducted in June 2007 and July 2008 over periods ranging from 6 hours to 7 days in order to capture the response of dune morphology to ebb-flood and spring-neap tidal cycles. A new technique was developed for detecting bedform migration. This approach utilizes a fingerprint-detection algorithm (Bishnu et al., 2002) to convert the bathymetric surface to a binary map of bedform crests, which are subsequently tracked using a spatial cross-correlation technique (Duffy and Hughes-Clarke, 2005). …

Spatial And Temporal Trends Of Dissolved Nitrous Oxide In The Lamprey River Watershed And Controls On The End-Products Of Denitrification, Emily Difranco
Master's Theses and Capstones
An understanding of the controls on the production of the greenhouse gas N2O is important to assess the atmospheric contribution of N2O from freshwater streams. Concentration and percent saturation of dissolved N2O were measured from March 2008 to February 2009 and were used as to measure the potential for streams in the Lamprey River Watershed to lose N2O to the atmosphere. Almost all streams were oversaturated most of the year, and though field concentrations of dissolved N2O did show trends with stream chemistry, it is possible that N2O is not only being produced within the streams themselves, but is entering …
