Riding The Borderlands: The Negotiation Of Social And Cultural Boundaries For Rio Grande Valley And Southwestern Motorcycling Groups, 1900-2000, Gary L. Kieffner

Open Access Theses & Dissertations

This Dissertation presents an analysis and interpretation of particular aspects of the social, cultural, and ideological history of motorcycling in the US-Mexican Borderlands from 1900 to 2000. It is based on interviews with historical correspondents, archival and other documents as well as thirty years of participant reflection during which the author was immersed in biker culture. The motorcycle served as a vehicle for personal and group identity, resistance, and liberation. Issues related to identity, gender, race, marginalization and resistance, imagery, and rhetoric become clearer when considering the perspective of riders. This study surveys interactive processes that occurred between historic motorcyclists, …

Un/Commonplaces: Redirecting Research And Curricula In Rhetoric And Writing Studies, Brian J. Mcnely Jan 2009

Un/Commonplaces: Redirecting Research And Curricula In Rhetoric And Writing Studies, Brian J. Mcnely

Open Access Theses & Dissertations

Un/Commonplaces is guided by a broad and fundamental question of inquiry regarding writing and disciplinary research: how can some of the predominant ways that our discipline has approached writing be retheorized to better approximate the complexity of contemporary rhetorical knowledge work? A corollary inquiry explores the resonances with English Studies that persist--and seeks to uncover how they persist--in our field. I argue that we can negotiate such issues by tracing and troubling some of our core disciplinary commonplaces, those commonsense notions and practices too frequently and easily adopted from English Studies and perpetuated within the often tumultuous and hegemonic relationship …

Claiming The Discursive Self: Mestiza Rhetoric Of Mexican Women Jouranlists, 1876-1924, Cristina Devereaux Ramirez

Open Access Theses & Dissertations

In the last two decades, scholars in Rhetoric and Writing Studies have been calling for a greater representation of voices of those from other cultures who participated in rhetorical practices. As Jacqueline Jones Royster contends, rhetoric has been framed as mostly white, male, and elite, and that these positions distort the democratic perspective of our discipline. Claiming the Discursive Self: Mestiza Rhetoric of Mexican Women Journalists, 1876-1924 presents women rhetors who were participating in not only creating a national identity, but also in constructing a public identity that would insure women's contribution and participation for future generations. It closely examines …

Image-Of-God Motif In The Writings Of Ellen G. White : A Search For A Distinct Voice In Educational Philosophy, Kevin D. Grams

Dissertations

Problem. Ellen White’s image-of-God motif and its influence on Seventh-day Adventist educational philosophy has not been examined thoroughly by thesis, dissertation, or other academic research. This dissertation is a significant effort toward fulfilling this need by examining and contextualizing White’s writings on the image of God as well as examining the educational ramifications of the motif.

Method. This is a historical/analytical investigation involving a search of Ellen White's writings to locate, identify, and examine passages that refer to the image of God, especially as it relates to education. These passages were then contextualized and studied to determine how White used …

Scott V. Harris And The Role Of The Jury In Constitutional Litigation, Michael Wells Jan 2009

Scott V. Harris And The Role Of The Jury In Constitutional Litigation, Michael Wells

Scholarly Works

Suits brought under 42 U.S.C. section 1983 to recover damages for excessive force by the police bear some resemblance to common law tort litigation, since the key Fourth Amendment issue is whether the force was 'unreasonable.' In ordinary negligence law the jury typically decides whether an actor has exercised reasonable care, even when there is no dispute as to the facts. In section 1983 litigation the federal courts are badly split on the allocation of decision making between judge and jury, sometimes even within a particular circuit. The Supreme Court recently faced the judge-jury issue in Scott v. Harris, where …

International Common Law: The Soft Law Of International Tribunals, Timothy L. Meyer, Andrew T. Guzman Jan 2009

International Common Law: The Soft Law Of International Tribunals, Timothy L. Meyer, Andrew T. Guzman

Scholarly Works

Rising legalization in the international community has lead to greater use of international tribunals and soft law. This paper explores the intersection of these instruments. The decision of an international tribunal interprets binding legal obligations but is not itself legally binding except, in some instances, as between the parties. The broader, and often more important function of a tribunal's decision - its influence on state behavior beyond the particular case and its impact on perceptions regarding legal obligations - is best characterized as a form of soft law.

Despite its inability to bind states, a tribunal can influence state behavior …

Baruch The Scribe: Preserver Of Knowledge And Model For Librarians, Roger White Ed.D.

The Christian Librarian

This article discusses how the Old Testament character Baruch serves as an inspiration for contemporary Christian librarians. Events from his scribal career parallel several common experiences of library professionals including archiving materials, maintaining and promoting a collection, dealing with criticisms from administrators and community leaders, and becoming weary from overwork. How he handled himself in the midst of these activities is noteworthy as is God’s response to his service. The life and legacy of Baruch provide several parallels and encouraging lessons applicable to all those called to serve in libraries.

Retooling The Profession: Librarianship In An Era Of Accountability And Competition, Gregory A. Smith Jan 2009

Retooling The Profession: Librarianship In An Era Of Accountability And Competition, Gregory A. Smith

The Christian Librarian

Librarianship has changed substantially in recent years. We who work in libraries must continually acquire new knowledge and skills. We must adapt to the reality that academic libraries, along with their parent institutions, face increased accountability. The functions that many of us have thought to be at the core of our profession are slipping from our grasp and will leave behind a mere managerial role. Nevertheless, many academic libraries will find a viable future by adopting and taking seriously the role of supporting learning. As we look at disruptive innovators in the information and learning scene, we should consider carefully …

The Federal Common Law Of Nations, Bradford R. Clark Jan 2009

The Federal Common Law Of Nations, Bradford R. Clark

GW Law Faculty Publications & Other Works

Courts and scholars have vigorously debated the proper role of customary international law in American courts: To what extent should it be considered federal common law, state law, or general law? The debate has reached something of an impasse, in part because various positions rely on, but also are in tension with, historical practice and constitutional structure. This Article describes the role that the law of nations actually has played throughout American history. In keeping with the original constitutional design, federal courts for much of that history enforced certain rules respecting other nations' "perfect rights" (or close analogues) under the …

Contraception: Securing Feminism’S Promise, Naomi R. Cahn, June Carbone Jan 2009

Contraception: Securing Feminism’S Promise, Naomi R. Cahn, June Carbone

GW Law Faculty Publications & Other Works

This paper traces the history of attempts to restrict contraception, the legal events securing widespread access to contraception and their importance to a generation of college-aged women, the short-lived nature of the consensus that produced them, and the potential of the issue to serve as a rallying point for a revitalized feminism. It explores the hypocrisy of a system that, whatever its values, makes reproductive autonomy readily available for the affluent and the sophisticated and increasingly beyond the reach of the most vulnerable. Finally, it considers the potential of contraception as a reframing device, capable of exposing the hypocrisy of …

Role Of Thyroid Hormone In The Intestinal Development Of Eleutherodactylus Coqui, Srikanth Singamsetty

Electronic Theses and Dissertations

Thyroid hormone (TH) is required for the metamorphosis of the long, coiled tadpole gut in Xenopus laevis into a shorter mature adult gut. Eleutherodactylus coqui, a direct developing frog, lacks a tadpole. Its embryonic gut is a miniature adult form with a mass of yolky endodermal cells attached to the small intestine to provide nutrition. The requirement of TH for the gut development in E. coqui was tested in this study. Inhibition of TH synthesis with methimazole arrested gut development in its embryonic form. T3, the active form of TH, induced gut development. Embryos treated with methimazole failed to utilize …
