Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State

The 14th century Caddo Leaning Rock site was initially discovered in the Fall of 2004. It was located during reconnaissance to search out a location for the survey portion of the Texas Archeologica! Society's Academy IO I held in Tyler in February 2005. This was not a formal survey with transect lines. nor one using regularly spaced shovel tests. but was rather more of a "windshield"' type survey, consisting of driving across pasture lands looking at gopher mounds and checking fore, evidence of archeological deposits on likely looking landforms.

The deployment of active sonar by the U.S. Navy and its potential impacts on marine mammals has been an ongoing issue of intense debate; regulatory, legislative, and judicial activity; and international concern. Some peacetime use of military sonar has been regulated under the Marine Mammal Protection Act (MMPA) and other statutes due to concerns that active military sonars are operated at frequencies used by some cetaceans (i.e., whales, porpoises, and dolphins), and their highintensity sound pulses may travel long distances in the ocean. There is also concern that sonar transmissions of sufficiently high intensity might physically damage the hearing in …

This chapter discusses insurance case law arising from acts of terrorism, including those arising from the September 11 attacks. It analyzes the Terrorism Risk Insurance Act of 2002 (TRIA), as amended by the Terrorism Risk Insurance Act of 2005 and the Terrorism Risk Insurance Program Reauthorization Act of 2007, as well as the administrative program created by the legislation. Examples are provided and NAIC Policyholder Disclosure Notice forms are included. Policy considerations surrounding TRIA are also discussed including insurance industry strategies, the difficulties of assessing terrorism risks, the effect of TRIA subsidized insurance on the market, and the benefits and …

As both houses of the Russian parliament call upon President Medvedev to support Abkhazia and South Ossetia’s right to self determination, Russian military commanders would appear to be consolidating a so-called ‘buffer zone’ within Georgia proper. According to Moscow, a battalion of 272 Russian troops will occupy eight ‘forward’ positions up to 15km within Georgia proper along its borders with Abkhazia and South Ossetia. A further 250 Russian troops are set to be deployed to the rear of these positions to perform ‘logistics, engineering and support’ functions. Societies create their own worlds and, once created, these worlds have to be maintained. In particular, the plausibility of these worlds has to be legitimized for each new generation. The purpose of this thesis is to develop an instrument that will measure how Christians maintain the plausibility of their religious world. I have constructed a survey that will explore the social matrix encompassing a person’s religious beliefs, the actual beliefs themselves, and the extent to which they are certain of these beliefs. Judith F. Baca, artist, educator, scholar/activist, and community arts pioneer, University of California, Los Angeles, explores an idea that is deceptively simple: the land has memory. She articulates this idea as much through images as words; indeed, images form the spine of the argument, specifically photographs of a mural along a flood control channel in the San Fernando Valley. Baca created this Great Wall of Los Angeles with people hungry to know forgotten histories of their land and inscribe them for the future. Each of these images excavates another layer of a complex story. Baca gives form to monuments that …

This synthesis provides an overview of hazardous fuels management in loblolly pine (Pinus taeda) forests, as well as a reference guide on prescribed burning and alternative fuel management treatments. Available information is presented on treatment feasibility, approximate costs, and effects on soil, water quality, and wildlife. The objectives of fuel management in loblolly pine forests are to reduce the density of some targeted plant vegetation and change the structural condition of the forest, or both. Prescribed burning is the most common tool for managing fuels in the South due to the relatively low cost per acre and the ability to …

Francaviglia looks anew at the geographical-historical context of the driving of the golden spike in May 1869. He gazes outward from the site of the transcontinental railroad's completion—the summit of a remote mountain range that extends south into the Great Salt Lake. The transportation corridor that for the first time linked America's coasts gave this distinctive region significance, but it anchored two centuries of human activity linked to the area's landscape. A new breed of political activist has begun to appear on the streets and in the news. They are no longer trying to out-shout their opponents, but are agreeing with them instead, enthusiastically taking their adversary’s position to exaggerated extremes. It is a practice here termed “identity-nabbing,” in which participants pretend to be someone they are not, appearing in public as exaggerated caricatures of their opponents or ambiguously co-opting some of their power. In this essay, I offer a sympathetic reading of the rhetoric(s) of Augustine’s Confessions. First, as a historian of rhetoric I am interested in what Augustine’s narrative can tell us about the theory and practice of rhetoric in the late classical period and the early Christian era. From this perspective, I am interested in exploring what Augustine discloses about the rhetoric he learned in the provincial Roman schools, and taught at Carthage, Rome, and Milan. Part of an Ohio State Law Journal symposium on the Supreme Court's decision finding an individual right to arms in District of Columbia v. Heller, this article offers five takes on what the Heller decision might mean, and how it may play out in lower courts. First, we argue that Heller essentially followed the prevailing national consensus on the meaning of the Second Amendment. Second, we argue that this fact furnishes an important data point for those who argue that the Court usually follows, rather than leads, public opinion on disputed matters; and that, when it invalidates laws, it does …

This essay explores why some groups of women in nineteenth–century Colombia were able to engage in public, political action but others were not. Elite conservative women (mostly white) and popular liberal women (mostly black and mulatta) found ways to participate publicly in republican politics, but elite liberal women (mostly white) and some popular conservative women (mostly Indian) were largely absent from the public sphere. I argue that colonial gender roles, elite and popular visions of citizenship, the contest between the Liberal and Conservative Parties, the structure of indigenous communities, and popular liberal women's access to independent economic resources all helped …

The thirteenth century was witness to a revolution in personal piety and the Camino de Santiago represented this new age. Pilgrimage in the Middle Ages became not only a symbol of devotion, but also a powerful method of active participation in one’s own salvation.¹ The importance of this burgeoning individualism is reflected by the miracle tales of a saint who is connected both spiritually and geographically to Santiago and his trail. The renewed embrace of historicism in recent decades has helped revive the reputation of Statius’ Silvae. As remnants of the relationship between poet and patron in Flavian Rome, for example, the Silvae can exemplify the careful navigation required in the imperial court and high society of the time. Yet appreciation of their literary qualities has lagged behind this increased interest in the cultural context of the Silvae, and analysis of the poems’ exuberant strategies of praise too often seems to involve a degree of defensiveness. Commercial Speech, First Amendment Intuitionism And The Twilight Zone Of Viewpoint Discrimination, Martin H. Redish

In this article, I seek to demonstrate that arguments made by scholars against First Amendment protection for commercial speech may be divided into three categories: (1) rationalist, (2) intuitionist, and (3) ideological. I argue that all three forms of opposition to commercial speech protection suffer, either directly or indirectly, from the same fundamental flaw: each constitutes or at the very least facilitates creation of a constitutionally destructive form of viewpoint discrimination. I show that all of the specific rationales for opposing First Amendment protection for commercial speech are fatally and illogically underinclusive: In each case the justification asserted to support …
