The Defense Of The Spanish Empire And The Agency Of Nature: Araucanía, Patagonia And Pampas During The Seventeenth Century, Margarita Gascón

Research Papers

The article analyzes the defense of the Spanish Empire in South America and the agency of nature. Spain was the most powerful Atlantic empire of the seventeenth century on the continent, but in South America only Caracas and Buenos Aires were on the Atlantic rim. Portugal controlled the coast of Brazil, Patagonia was neglected, and Peruvian settlements were Pacific-oriented. Both the defense strategy and natural events will provide us with explanations for some major episodes in the evolution of this segment of the empire in the seventeenth century.

This work is a chapter for a forthcoming book on The Essentials of International Criminal Law to be published by Aspen Publishers as part of its Essentials series. This chapter discusses the contested concept of terrorism under international law, with a focus on efforts to criminalize the phenomenon. In particular, it discusses the major obstacles to achieving an omnibus definition of the crime with a particular emphasis on the intersection of the prohibitions against terrorism and international humanitarian law. The development of "law and economics" over the last half-century has expanded and reinforced a perception among academic lawyers that law itself is a social science. During the same period social science has moved closer to the discipline of natural science and the presuppositions and methods of its thought and work. This essay explores why law is not and cannot be a social science, and why there are grounds for hope in a future for democracy grounded in the rule of law.

James T. Hong’s experimental documentary, The Denazification of MH (2006) is neither an apology for Heidegger’s involvement with National Socialism nor a condemnation of that involvement. Rather, the film is a critical philosophical confrontation (Auseinandersetzung) with Heidegger’s thought and the issue of his involvement with National Socialism. The film addresses the perennial concern as old as philosophy itself: the relationship between the philosopher’s life and his philosophy. While the film does not adopt a definitive position regarding Heidegger, Nazism, and the issue of personal responsibility, it does suggest an affirmative response to the question posed by both Levinas …

Eighteenth-century Anglo-American prize systems were highly organized enterprises for the provision of coerced labour. Offering whites opportunities to participate in a lucrative market, they extended the reach of American slavery beyond the shores of the Americas, reinforced slavery in North America and greatly limited opportunities for freedom for black seamen. Although Americans desired that their new nation provide greater individual liberty, the American prize system applied the same presumption – that captured black mariners were slaves – as had its British predecessor, resulting in the sale of hundreds of black seamen into slavery.

The Role Of Gender In Environmental Justice, Nancy Unger

History

Environmental Justice incorporates an inclusive definition of its subject matter, exploring the environmental burdens impacting all marginalized populations and communities. This expansive definition allows for the possibility that populations conventionally viewed as privileged can nevertheless be marginalized and suffer uniquely from environmental injustices. Employing such a definition can also reveal how an ostensibly powerless group can fight for environmental justice on its own terms—and win. Gender has played an important role in environmental justice (and injustice) throughout the history of the United States. In Part I, I catalog the historical context in which the PCA was passed and describe the military events that are most commonly used to support the case for sharply divided civilian and military authorities. In Part II, I discuss the true purpose and intent of the PCA: to prohibit civilian marshals from calling forth active duty military to enforce domestic law. I also explore the contours of the emergency power doctrine to show that it is not clear that Congress could limit Executive action as a revamped PCA may attempt to do.
