Childhood Predictors Of Adult Criminality: A Meta-Analysis Drawn From The Prospective Longitudinal Literature, Alan W. Leschied Dr., Debbie Chiodo, Elizabeth Nowicki, Susan Rodger
Education Publications
Sufficient research now exists in the psychology of criminal conduct literature to address the long-term impact of early childhood and adolescent experiences on later adult outcomes. In the present meta-analysis, selected studies were prospective and longitudinal, tracking a variety of early childhood and family factors that could potentially predict later involvement in the adult criminal justice system. Thirty-eight studies met the selection criteria. Major findings indicate that dynamic versus static predictors are related to later adult criminal justice involvement. The older the child was at the time the predictor was measured, the stronger was the relationship to adult offending. Within …

It is the case that civil justice problems constitute the bulk of courts’ work in both the state and federal legal systems (see, e.g., Court Statistics Project, 2006; U.S. Courts, 2007). Nevertheless, a decision rendered by a jury (or a judge) takes place in only a relatively small percentage of civil disputes. There are exponentially more civil disputes resolved outside of court than are resolved via jury verdicts (see, e.g., Galanter, 1983, 1993, 1996; Miller & Sarat, 1980–1981; Trubek, Grossman, Felstiner, Kritzer, & Sarat, 1983), a state of affairs true for the UK as well as the US (Pleasence, 2006). …

Just Don't Say You Heard It From Me: Bridging The Davis V. Washington Divide Of Indistinguishable Primary-Purpose Statements, Thomas M. Forsyth Iii
UC Law Constitutional Quarterly
In Davis v. Washington, the Supreme Court sought to clarify its Crawford v. Washington holding, which restored the Constitution's Confrontation Clause to its original procedural function-to test the reliability of testimonial witness statements "in the crucible of cross-examination." Under Davis, the testimonial/non-testimonial categorization of witness hearsay statements is based on the primary purpose for which those statements were made to law enforcement agents. Despite the Court's two-pronged standard, Davis left a gaping hole between the extreme ends of the testimonial/nontestimonial spectrum where witness statements have a mixed or dual purpose and the primary purpose is indiscernible.

Who Says So - Defining Cruel And Unusual Punishment By Science, Sentiment, And Consensus, Aimee Logan
UC Law Constitutional Quarterly
The 2003 United States Supreme Court decision Atkins v. Virginia provides a unique opportunity to discuss how the Court integrates science into its constitutional philosophy. In Atkins, a majority of the Court concluded that executing criminals with mental retardation violates the Eighth Amendments prohibition against cruel and unusual punishment. Psychologists, psychiatrists and others in the scientific community have studied mental retardation for some time. However, the tests they use, and the criteria they look at, do not necessarily translate to the criminal justice system. Thus, in order to give legal significance to mental retardation, the Supreme Court must operationally define …

Collateral Damage: Examining The Impact Of Maternal Incarceration On The Social, Emotional, Behavioral And Educational Functioning Of Children : Released Mothers' Perspectives, Roberta Treadway Gaston

The United States Bureau of Justice Statistics reports that women continue to be incarcerated at record numbers. The majority of these women are mothers to children under the age of 18. Consequently more and more children are being negatively effected as a result of this forced separation from their mothers. The research on children with an incarcerated mother documents the adverse impact on the well-being of the children left behind. The children experience a range of difficulties including emotional and psychological difficulties, educational problems and behavioral difficulties. Children who have a mother in prison or jail have been labeled as …

Street outreach workers are an important part of the Senator Charles E. Shannon Jr. Community Safety Initiative (CSI) comprehensive gang and youth violence reduction strategy in Massachusetts1. Street outreach involves the use of individuals to “work the streets,” making contact with youth in neighborhoods with high levels of gang activity. These individuals are generally not employed by the criminal justice system agencies but rather are based in community service organizations or other non- governmental agencies. Street outreach workers provide an important bridge between the community, gang-involved youth, and the agencies (whether social service or law enforcement) that respond to the …
Police Criminal Charging Decisions: An Examination Of Post-Arrest Decision-Making, Scott W. Phillips, Sean P. Varano
Police Criminal Charging Decisions: An Examination Of Post-Arrest Decision-Making, Scott W. Phillips, Sean P. Varano
Justice Studies Faculty Publications
Scholars have encouraged studies of police decision-making to move beyond the arrest decision into research that broadens the understanding of police behavior. The criminal charge placed by officers against offenders is largely an untouched area of study. Examining criminal charging decisions goes beyond simple dichotomous decisions, such as arrest, but instead explores the area of police leniency or punitiveness. Randomly constructed vignettes describing a domestic violence incident were given to officers from four agencies. Officers indicated the criminal charges they would likely list against an offender if they were to make an arrest. Serious criminal charges were often supported by …

The Public Health Implications Of Trafficking, Tami Ashbridge
Master of Public Health Program Student Publications
Trafficking in human beings is a serious and complex human rights issue. Trafficking for the purpose of sexual exploitation has grave public health implications. The vulnerability of women and children increases their risk of becoming victims of trafficking for the purposes of sexual exploitation. Review of the literature on this subject demonstrates a direct link between the trafficking of women and children for sexual exploitation and the prevalence of HIV/AIDS, STIs and Reproductive/Gynecological Issues, Mental Health, Violence, Abuse and Social Issues. This review supports the concept of human trafficking as a serious public health issue and the need for improved …

Assessment Practices In Residential Treatment Facilities For Juvenile Offenders, Liz Marciniak, Diane T. Marsh
Contemporary Issues in Juvenile Justice
Given the high prevalence of mental disorders among juvenile offenders, as well as the link between untreated disorders and delinquent behavior, there is a critical need for standardized, cost-effective, and clinically effective procedures to identify youth with mental health problems. Surveys were sent to staff in juvenile residential facilities throughout Pennsylvania to examine statewide assessment practices, including the background and training of staff, the standard intake procedures used in these facilities, and the role of assessment in treatment planning. Although results provide evidence of some common statewide assess-ment practices, there was significant variability in the use of specific procedures. Suggestions …

Ditching The Disposal Plan: Revisiting Miranda In An Age Of Terror, Kim D. Chanbonpin
Ditching The Disposal Plan: Revisiting Miranda In An Age Of Terror, Kim D. Chanbonpin
St. Thomas Law Review
This Essay will show that the creation of an exceptional ad hoc court for the purpose of trying suspected terrorists in the United States would be a misguided approach to solving the problem of the military commissions. It will also demonstrate that, in a society based on the rule of law, the justice which President Bush seeks for terrorists must include proper treatment in detention and fair trials. The regular criminal justice process in the federal courts has served and can continue to serve as an adequate, efficient, and fair method to bring terrorists to justice. Moreover, the exclusionary rule …

Of Inferior Stock: The Two-Pronged Repression Of Radical Immigrant Birth Control Advocates At The Turn-Of-The Twentieth Century, Cesar Cuahtemoc Garcia Hernandez
St. Thomas Law Review
This article addresses law's coercive function to quash birth control advocacy at the turn-of-the-twentieth century. Part II addresses the development of anti-obscenity legislation, especially at the federal level, to slow quelling support for birth control availability and usage. In particular, the article addresses the trend during the late 1800s in which the states and federal government prohibited sending birth control information or products through the mail. This section also explores the significant harassment, and both actual and threatened prosecution of birth control advocates that resulted from criminal prohibitions. Part III surveys the rampant nativism that swept policymaking circles during this …
