New Trends In Procedural Law: New Technologies And The Civil Litigation Process, Janet Walker, Garry D. Watson

UC Law SF International Law Review

This report for the International Association of Procedural Law examines the impact of new technologies on the litigation process in six countries: The United States, Australia, Israel, Singapore, England and Wales, and Canada. Drawing on national reports from each of these countries, it considers: how new technologies are re-shaping the ways that we record and store information in the litigation process; the ways that the participants in the process communicate with one another; and the ways in which the case record or file is developed. It also considers whether new technologies are making the litigation process more efficient, more accessible …

Implementing The Prohibition Of Torture On Three Levels: The United Nations, The Council Of Europe, And Germany, Joachim Herrmann Jan 2008

Implementing The Prohibition Of Torture On Three Levels: The United Nations, The Council Of Europe, And Germany, Joachim Herrmann

UC Law SF International Law Review

In the fight against terrorism the United States government has tried to draw a line between proper and improper methods of interrogation and treatment of detainees. The question whether and to what extent torture and other kinds of ill-treatment might be justified is widely discussed in the United States today. To date, no satisfying answer has been found. There is doubt that a generally accepted answer could ever be found. In view of this dilemma it might be helpful to look beyond the borders of the United States to see what answers have been given elsewhere. This paper will explain …

Throwing Black Babies Out With The Bathwater: A Child-Centered Challenge To Same-Sex Adoption Bans, Tanya M. Washington Jan 2008

Throwing Black Babies Out With The Bathwater: A Child-Centered Challenge To Same-Sex Adoption Bans, Tanya M. Washington

UC Law Journal of Race and Economic Justice

This article advances an orphan-centered constitutional challenge to placement bans that highlights the impact of these bans on Black orphans. It asserts permanency, and the stability and security that permanent placement provides, as interests embraced by the best interests of the child standard and protected against state infringement by Substantive Due Process guarantees. It also argues that orphans possess a negative liberty interest in freedom from state action that categorically forecloses adoption without conducting an individualized review of the orphan's needs or the competencies of the potential parents. This article's challenge to the constitutionality of these bans is situated within …

Civic Lessons: Public Schools And The Civic Development Of Undocumented Students And Parents, John Rogers, Marisa Saunders, Veronica Terriquez, Veronica Valez Jan 2008

Civic Lessons: Public Schools And The Civic Development Of Undocumented Students And Parents, John Rogers, Marisa Saunders, Veronica Terriquez, Veronica Valez

Northwestern Journal of Law & Social Policy

In the Court reasoned that by providing undocumented students with core academic instruction, public schools could contribute to their participation in democratic institutions and thus enhance civic life. This article assesses this and a set of related claims. Drawing on three data sets, the authors consider how access to public schools shapes the civic development and civic engagement of undocumented students and their parents. They first introduce data from a longitudinal study tracking the civic development of youth through high school and into adulthood. They then share survey data that indicates the relatively high levels of school participation among undocumented …

The Attorney-Client Privilege Protection Act: The Prospect Of Congressional Intervention Into The Department Of Justice's Corporate Charging Policy, Andrew Gilman Jan 2008

The Attorney-Client Privilege Protection Act: The Prospect Of Congressional Intervention Into The Department Of Justice's Corporate Charging Policy, Andrew Gilman

Fordham Urban Law Journal

This Note analyzes the Privilege Protection Act, focusing on how it might change corporate white-collar prosecutions. Part I of this Note explores the mechanics of the corporate privilege, the development of the DOJ's waiver policy, and the structure of the Privilege Protection Act. Part II addresses the conflicting views on whether the Privilege Protection Act will bolster corporate attorney-client privilege, provide for the effective and efficient prosecution of white-collar crime, and promote ethical prosecutorial practices. Finally, Part III argues that the Privilege Protection Act is a misguided attempt to correct a greater systemic problem with the corporate attorney-client privilege and …

Sentencing Guidelines For The Court Of Public Opinion: An Analysis Of The National Football League's Revised Personal Conduct Policy, Michael A. Mahone Jr. Jan 2008

Sentencing Guidelines For The Court Of Public Opinion: An Analysis Of The National Football League's Revised Personal Conduct Policy, Michael A. Mahone Jr.

Vanderbilt Journal of Entertainment & Technology Law

The National Football League (NFL) is considered to be the premier professional sports league in the United States, if not the world. In order to maintain that prominence, it is necessary for the NFL to address circumstances that may arise periodically that could have a deleterious effect on league revenues. Throughout the history of the NFL, initiatives taken to safeguard its continued prosperity have been within the province of the NFL Commissioner. The behavior of NFL players, whether on the playing field or in their personal lives, presents one such threat to the league's financial success. In the area of …

Revisiting The Rules Of Evidence And Procedure In Adversarial Immigration Proceedings, Won Kidane Jan 2008

Revisiting The Rules Of Evidence And Procedure In Adversarial Immigration Proceedings, Won Kidane

Faculty Articles

This article addresses the concern over the state of deportation proceedings in the United States. Professor Kidane argues that a lack of formal rules of procedure and evidence is the main factor contributing to the unpredictability, and inconsistency inherent in our system of immigration law. The argument is placed in context by reviewing the growth of the administrative agencies up through the adoption of the Administrative Procedure Act (APA). Kidane notes that the APA embodies one approach as a compromise between those advocating strict formal rules of procedure and evidence and those supporting a more relaxed system for administrative proceedings. …

A Reader's Companion To Against Prediction: A Reply To Ariela Gross, Yoram Margalioth, And Yoav Sapir On Economic Modeling, Selective Incapacitation, Governmentality, And Race, Bernard E. Harcourt

Articles

From parole prediction instruments and violent sexual predator scores to racial profiling on the highways, instruments to predict future dangerousness, drug-courier profiles, and IRS computer algorithms to detect tax evaders, the rise of actuarial methods in the field of crime and punishment presents a number of challenging issues at the intersection of economic theory, sociology, history, race studies, criminology, social theory, and law. The three review articles of Against Prediction: Profiling, Policing, and Punishing in an Actuarial Age by Ariela Gross, Yoram Margalioth, and Yoav Sapir, raise these challenges in their very best light. Ranging from the heights of poststructuralist …

Transitional Justice In Postconflict Contexts: The Case Of Sierra Leone's Dual Accountability Mechanisms, Lydia Apori-Nkansah Jan 2008

Transitional Justice In Postconflict Contexts: The Case Of Sierra Leone's Dual Accountability Mechanisms, Lydia Apori-Nkansah

Harold L. Hodgkinson Award for Outstanding Dissertation

Literature on in-depth studies of dual transitional justice mechanisms in postconflict settings is inadequate. This qualitative case study sought to understand the practice of dual transitional justice by examining the Truth and Reconciliation Commission (TRC) and the Special Court engaged for transitional justice in postconflict Sierra Leone. Data consisted of documentary sources, observational field notes and 31 individual semi-structured interviews with open-ended questions of Sierra Leonean public officials, United Nations officials, and TRC and Special Court officials, as well as civil society actors. Data were analyzed through detailed "description", "categorical aggregation", "direct interpretation", establishment of "correspondence and patterns", and development …

Fair Circumvention, Timothy K. Armstrong Jan 2008

Fair Circumvention, Timothy K. Armstrong

Faculty Articles and Other Publications

Judicial decisions construing the key liability provisions of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. - 1201, cluster around two incompatible poles. One set of decisions construes the DMCA's liability provisions broadly, emphasizing the need to prevent possible copyright infringement and limit the public availability of tools that may be used to infringe. Other cases construe the same language narrowly, stressing the avoidance of anticompetitive market distortions. Both sets of decisions insist that their interpretation is commanded by the literal text of the DMCA. A closer look, however, reveals that both sides have overstated the support they may plausibly …

Ignoring The Golden Principle Of Charter Interpretation?, David M. Tanovich Jan 2008

Ignoring The Golden Principle Of Charter Interpretation?, David M. Tanovich

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

One consistent and disturbing trend since the birth of the Charter in 1982 is that race has been and continues to be, with a few notable exceptions, erased from the factual narratives presented to the Supreme Court of Canada and from the constitutional legal rules established by the Court in criminal procedure cases. Understanding the etiology of this erasing is not easy. In earlier pieces, the author has explored the role of trial and appellate lawyers. This paper focuses on principles of judicial review and the failure of the Supreme Court to consistently consider the impact of the constitutional rules …
