Investigating Racial Disparity At The Detention Decision: The Role Of Respectability, Don L. Kurtz, Tavis Linnemann, Ryan Spohn

Center on Children, Families, and the Law: Faculty Publications

A concern over inequity and the existence of racial disparity of youth served by the juvenile justice system has long been a topic of considerable interest among scholars, policymakers, and court officials. Numerous empirical studies undertaken by academics and various public and private organizations have attempted to shed some light on this phenomenon. Research findings on disproportionate minority contact have hardly been uniform, leaving much of this practice unexplained. This study uses data obtained at the detention decision point over a three-year period examining variance in juvenile case processing related to race. Findings suggest that extra-legal factors influencing the decision …

Department of Psychology: Faculty Publications

As courts often rely on clinicians when differentiating between sexually abusive youth at a low versus high risk of reoffense, understanding factors that contribute to accuracy in assessment of risk is imperative. The present study built on existing research by examining (1) the accuracy of clinical judgments of risk made after completing risk assessment instruments, (2) whether instrument- informed clinical judgments made with a high degree of confidence are associated with greater accuracy, and (3) the risk assessment instruments and subscales most predictive of clinical judgments. Raters assessed each youth’s (n = 166) risk of reoffending after completing the SAVRY …

Informing The Enemy: Feeding The Counter-Intelligence Needs Of Our Adversaries, 25 J. Marshall J. Computer & Info. L. 681 (2008), Kenneth J. Ryan

UIC John Marshall Journal of Information Technology & Privacy Law

The author demonstrates how the convergences of technology, national security and an ever expanding media pose critical problems for the protection, dissemination and employment of information for national security purposes. Focusing on the methods and harms posed by the inadvertent and intentional disclosure of operational information, he proposes a three-part remedy that balances transparency with national security concerns and underscores the critical role that any information may hold in these days of heightened security.

The Immigrant Health Care Narrative And What It Tells Us About The U.S. Health Care System, Brietta R. Clark Jan 2008

The Immigrant Health Care Narrative And What It Tells Us About The U.S. Health Care System, Brietta R. Clark

Annals of Health Law and Life Sciences

This article examines the political, legal, and popular discourse in favor of and against healthcare benefit restrictions for immigrants. The author explains how this discourse creates narratives of immigrants' character and relationship to the rest of society. These narratives influence our perception of immigrants and their effect on society, and this perception, in turn, seems to influence the policies enacted to regulate immigrants and immigration. However, the author points out that immigrant-specific discourse or advocacy will not solve the fundamental problems of immigrant access to care and can serve to reinforce, rather than challenge, the fundamental defects of our health …

Emergency Department Utilization Among Victims And Offenders Involved In Non-Lethal Violence, Jerry Daday, Lisa M. Broidy, Cameron S. Crandall

Sociology Faculty Publications

The medical literature has focused on violent victimization as a public health concern, examining its correlates and evaluating intervention models. However, the emphasis on victimization in this literature overlooks the strong ties between victimization and offending risks outlined in the criminological literature, which may unnecessarily limit the scope of public health efforts to influence violence in our communities. This study examines whether the similarities observed in the criminological literature are evident in a health care setting. More specifically, do victims and offenders exhibit similar health care utilization patterns? We address this question by comparing the emergency department utilization records, criminal …
