Working Toward Fair Treatment For Retail Investors, Barbara Black Jan 2008

Working Toward Fair Treatment For Retail Investors, Barbara Black

Faculty Articles and Other Publications

Twenty years ago, in Shearson/American Express, Inc. v. McMahon, the Supreme Court held that brokerage firms could require their customers to arbitrate all their disputes in industry-sponsored fora - a decision that had great significance for the law of arbitration as well as securities regulation. In 1996, a blue-ribbon task force released its report, assessing the securities arbitration process at National Association of Securities Dealers, Inc. (NASD), the principal securities arbitration forum, and the report led to several symposia on the topic coinciding with the tenth anniversary of McMahon. Since then, arbitration scholars and practitioners have intensified the debate over …

Analysis Of Publishing Patterns In Accounting History Research In Italy, 1990-2004, Lino Cinquini, Alessandro Marelli, Andrea Tenucci

Accounting Historians Journal

In the last decade, an increasing number of analyses of accounting history literature have been undertaken to classify historical research paths and to map the variety of approaches and issues of the discipline in different geographical settings so as to make international comparisons. The paper develops these topics in the Italian context by studying the development of accounting history research (AHR) in the last 15 years. Contributions by Italian authors have been published in international and national specialist journals as well as in more general accounting journals. Other papers have been presented and published in the proceedings of the biannual …

Contributions Of Joseph Hardcastle To Accounting Theory, George C. Romeo, James J. Mckinney Jan 2008

Contributions Of Joseph Hardcastle To Accounting Theory, George C. Romeo, James J. Mckinney

Accounting Historians Journal

Joseph Hardcastle was one of the foremost authorities on subjects connected with the mathematics of finance and other topics in accounting in the late 19th and early 20th centuries. As a teacher, author, and leader in the profession, he figured prominently in the elevation of accountancy. Hardcastle is relatively unknown in the literature except for having the distinction of scoring the highest grades on the first CPA exam in New York in 1896. However, he was well respected during his time as one of the premier theorists in accounting and was awarded an honorary degree of Master of Letters by …

I'M Going To America: Jens Christian Andersen's Travel Diary And Letters From Racine, Wiscon Sin, 1894-96, Pia Viscor Jan 2008

I'M Going To America: Jens Christian Andersen's Travel Diary And Letters From Racine, Wiscon Sin, 1894-96, Pia Viscor

The Bridge

Editor's Introduction. For several years, I have been working on a description and analysis of emigration from the extensive region that made up the large estate of Skjoldesncesholm in central Sjcelland during the second half of the nineteenth century. Of all the many pictures, letters, and accounts that have passed through my hands, one collection in particular stands out: a travel diary and twenty-four letters written by a young man named Jens Christian Andersen, who emigrated in the year 1894. Before he left home, the seventeen-year-oldC hristian, as he was called, promised to keep a travel diary and also to …

Situationist Torts, John D. Hanson, Michael Mccann Jan 2008

Situationist Torts, John D. Hanson, Michael Mccann

Law Faculty Scholarship

This Article calls for a situationist approach to teaching law, particularly tort law. This new approach would begin by rejecting the dominant, common-sense account of human behavior (sometimes called dispositionism) and replacing it with the more accurate account being revealed by the social sciences, such as social psychology, social cognition, cognitive neuroscience, and other mind sciences. At its core, situationism is occupied with identifying and bridging the gap between what actually moves us, on one hand, and what we imagine moves us, on the other. Recognizing that gap is critical for understanding what roles tort law (among other areas of …

Review Essay: Janet Halley, Split Decisions: How And Why To Take A Break From Feminism, Ann Bartow Jan 2008

Review Essay: Janet Halley, Split Decisions: How And Why To Take A Break From Feminism, Ann Bartow

Law Faculty Scholarship

[Excerpt] “My overarching reaction to Janet Halley's recent book, Split Decisions: How and Why to Take a Break from Feminism, can be summarized with a one sentence cliché: The perfect is the enemy of the good.' She holds feminism to a standard of perfection no human endeavor could possibly meet, and then heartily criticizes it for falling short. Though Halley's myriad observations about feminism occasionally resonated with my own views and experiences, ultimately I remain unconvinced that taking a break from feminism would, for me, be either justified or productive. But I did (mostly) enjoy reading it. Halley is well …

The Impact Of Higher Education On The Job Preparedness And Job Performance Of Turkish National Police Officers, Erhan Beyhan

Electronic Theses and Dissertations

The Turkish National Police converted its 9-month Police Training Schools to 2-year college degree programs in 2001 in their pursuit to improve the quality of police officers' job performance, police job preparedness levels, and the police service as a whole. The purpose of this study is to investigate the actual benefits of this higher education policy by empirically measuring and comparing the job preparedness and job performance of police officers with higher education and police officers without higher education. This study consists of two quantitative parts. The first part measured the job performance construct with multiple indicators, including performance evaluation …

The Experience Of Young People Remanded In Custody: A Case For Bail Support And Supervision Schemes, Sinead Freeman

Articles

This article focuses on the potential role and benefits bail support and supervision(BSS) schemes may have for young people in the Irish context. This article is based on a wider Ph.D study examining the issue of coping on remand. The research used court observation and semi-structured interviews conducted with young prisoners aged 16 to 21 years in remand custody. The findings indicate that young people often end up in remand custody as a result of non-compliance with bail. The case is made arising from the research, that the operation of bail support and supervision (BSS) schemes may benefit these young …

Paul And Asceticism In 1 Corinthians 9:27a, Kent L. Yinger Jan 2008

Paul And Asceticism In 1 Corinthians 9:27a, Kent L. Yinger

Faculty Publications - Portland Seminary

Amidst the resurgence of interest in Paul and asceticism relatively little focus has been put upon one Pauline text with seemingly obvious ascetic potential: “I beat my body” (1 Corinthians 9:27a). After a brief introduction to the discussion of asceticism and an ascetic Paul, this article will survey the Wirkungsgeschichte of this text, especially in the patristic era, engage in exegesis of 1 Corinthians 9:27a, and draw conclusions as to the relevance of the text for discussion of Pauline asceticism.

Panaderías En La Ciudad De México De Porfirio Díaz: Los Empresarios Vasco-Navarros Y La Movilización Obrera, Robert Weis Jan 2008

Panaderías En La Ciudad De México De Porfirio Díaz: Los Empresarios Vasco-Navarros Y La Movilización Obrera, Robert Weis

History Faculty Publications

This article examines the insertion of Basque immigrants from the Baztan Valley, in the province of Navarre, into the wheat-flour-bread complex of late-nineteenth century Mexico City. Additionally, it describes labor conditions in the bakeries they owned and analyzes the place of workers in the Mexico of Porfi rio Díaz. In contrast to the historiographical tendency to present immigrant entrepreneurs, and the Porfirian state, as forces of capitalist modernization, the article shows that, with important exceptions, bakeries remained archaic and pre-capitalist in order to permit the integration of the constant stream of nephews that linked Mexico City and the Baztán Valley. …

Cracking The Egg: Which Came First -- Stigma Or Affirmative Action?, Emily Houh, Angela Onwuachi-Willig, Mary Campbell

Faculty Articles and Other Publications

This Article examines the strength of arguments concerning the causal connection between racial stigma and affirmative action. In so doing, this Article reports and analyzes the results of a survey on internal stigma (feelings of dependency, inadequacy, or guilt) and external stigma (the burden of others' resentment or doubt about one's qualifications) for the Class of 2009 at seven public law schools, four of which employed race-based policies when the Class of 2009 was admitted and three of which did not use such policies at that time. Specifically, this Article examines and presents survey findings of 1) minimal, if any, …

The Anatomy Of Grey: A Theory Of Interracial Convergence, Kevin Noble Maillard, Janis L. Mcdonald Jan 2008

The Anatomy Of Grey: A Theory Of Interracial Convergence, Kevin Noble Maillard, Janis L. Mcdonald

College of Law - Faculty Scholarship

This article offers a theory of racial identity divorced from biological considerations. Law fails to recognize the complexity of racial performance and identity, thus categorically simplifying a perceived polarity of black and white. Ground-breaking scholarship addressing racial boundaries, as written by Randall Kennedy, Elizabeth Bartholet, and Angela Onwauchi-Willig, generally focuses on the enduring legacy of race discrimination. We approach these boundaries from a different angle—whites who become “less white.” We bring together the challenges of passing and adoption to offer a theory of fluid racial boundaries.

Transracial adoption provides one viable channel to discuss the possibilities of white-to-black racial identity …

Exploring Permanent Property: An Exploration Of The Tattoo Acquisition In The Midwest, Tiffany Cross Jan 2008

Exploring Permanent Property: An Exploration Of The Tattoo Acquisition In The Midwest, Tiffany Cross

McNair Scholars Journal

America has become a society in which almost anything can be bought or sold. This study, through both the ethnological comparison of contemporary tattoo acquisition research and ethnographic fieldwork in Graylin, Michigan, analyzes the increase in the acquisition of tattoos within the past two decades. Specifically, this study focuses on tattoo acquisition in the Midwest and tests whether the expectations gained from the literature are significantly relevant to this region of the United States. Through interview, survey, and participant observation, the goal of research ultimately is to analyze cultural transmission and trends. In past studies, the focus has been on …

This essay provides an overview of business ethics. I describe important issues, identify some of the normative considerations animating them, and offer a roadmap of references for those wishing to learn more. I focus on issues in normative business ethics, but discuss briefly the growing body of work in descriptive business ethics. I conclude with a comment on the changing nature of the field.
