Ultra Wideband Radio: A Novel Method For Measuring Wandering In Persons With Dementia, William D. Kearns, Donna Algase, D. Helen Moore, Sadia Ahmed
Rehabilitation and Mental Health Counseling Faculty Publications
Wandering by persons with dementia is a complex syndrome of locomotive behaviors shaped by environmental, wanderer-specific and caregiver characteristics that vary the risk level for exiting, elopement, getting lost and accidental death. While valid and reliable methods to measure wandering exist, few have been evaluated for measurement of specific geographical patterns of wandering behavior as they occur in space and over time. In this paper we demonstrate how UWB-RFID can be used to unobtrusively and continuously measure two particularly high-risk wandering behaviors over intervals from weeks to months that occur in proximity to care setting exit points: lingering near exit …

The Charter Of Whiteness: Twenty-Five Years Of Maintaining Racial Injustice In The Canadian Criminal Justice System, David M. Tanovich
The Charter Of Whiteness: Twenty-Five Years Of Maintaining Racial Injustice In The Canadian Criminal Justice System, David M. Tanovich
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines the impact of the Canadian Charter of Rights and Freedoms on racial injustice in the Canadian criminal justice system. While there have been modest gains, we have seen very little systemic change over the Charter’s 25-year life. We continue to incarcerate Aboriginals and African Canadians at alarming rates, racial profiling at our borders and in our streets continues to flourish, and the federal government continues to propose legislation that will further entrench the problem. Why is this happening? is there any hope for the future? these are some of the fundamental questions explored. of course, some might …
Expanding Victims’ Rights In The Charter Era And Beyond, Joan Barrett
Expanding Victims’ Rights In The Charter Era And Beyond, Joan Barrett
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines the influence of the Charter over the development of victims’ rights through provincial and federal legislative reform and related jurisprudence. It discusses how the role of the victim has evolved from one of silent observer to one with significant procedural protections, welfare rights and limited rights of standing in criminal proceedings. It the n examines the Charter’s role in this evolution and discusses how the Charter has served as a vehicle by which Parliament and the courts have advanced the procedural, substantive and welfare rights of victims in the criminal justice system. Particular attention is given to …
Accidental Event Compensation: The Differing Philosophies And Objectives Of The Civilian And Martial Sectors, Michael Murphy
Accidental Event Compensation: The Differing Philosophies And Objectives Of The Civilian And Martial Sectors, Michael Murphy
Honors Capstones
As a result of the growing scrutiny of the military in recent times, understanding the philosophy and objectives behind the military sector’s method of disability compensation relative to the civilian sector stands as a relevant topic. There exist many similar types of disability within the civilian and martial sectors, yet the compensation levels can show great variation. This work attempts to understand the reasoning behind the differing levels of benefits by investigating the underlying philosophies and objectives applied in each sector through an extensive review of work from independent organizations such as the GAO and the RAND Corporation. This work …
Taming Crowded Visual Scenes, Saad Ali
Taming Crowded Visual Scenes, Saad Ali
Electronic Theses and Dissertations
Computer vision algorithms have played a pivotal role in commercial video surveillance systems for a number of years. However, a common weakness among these systems is their inability to handle crowded scenes. In this thesis, we have developed algorithms that overcome some of the challenges encountered in videos of crowded environments such as sporting events, religious festivals, parades, concerts, train stations, airports, and malls. We adopt a top-down approach by first performing a global-level analysis that locates dynamically distinct crowd regions within the video. This knowledge is then employed in the detection of abnormal behaviors and tracking of individual targets …
The Effect Of Gender On Health Care Policy In The State Legislature, Ashley Wilson Huth
The Effect Of Gender On Health Care Policy In The State Legislature, Ashley Wilson Huth
Honors Program Theses
This paper examines whether descriptive representation, in terms of gender, affects substantive representation among female legislators in a single state legislature. Data are collected from the 82nd General Assembly of the Iowa state legislature's lower-house. The unit of analysis is the individual bill. Controlling for legislator and district characteristics, I test whether legislator gender has an independent effect on the likelihood of the introduction of healthcare legislation. Utilizing the substantive representation index, and logistic regression with robust-cluster-standard-errors, I find that males introduce more healthcare bills when compared to females. The implications of this finding in terms of legislative representation are …
Artificial Insemination And The Family, Priyasha Saksena
Artificial Insemination And The Family, Priyasha Saksena
National Law School of India Review
The traditional notion of a family involves a group of persons who are linked by blood and affinity, with the adult members responsible for the care of the children. However, the traditional paradigm of a family is fast being eroded, with the discovery of new methods of artificial reproduction and a change in societal mindsets, making other forms of family structures acceptable. Family law however is still based on the traditional notion of a family, and seems unable to adapt to the changing times. This article is an attempt to examine some of the dilemmas that arise due the use …

‘Move On’ Orders As Fourth Amendment Seizures, Stephen E. Henderson
‘Move On’ Orders As Fourth Amendment Seizures, Stephen E. Henderson
Faculty Articles
If a police officer orders one to move on, must the recipient comply? This article analyzes whether there is a federal constitutional right to remain, and in particular whether a police command to move on constitutes a seizure of the person for purposes of the Fourth Amendment. Although it is a close question, I conclude that the Fourth Amendment typically does not restrict a move on (MO) order, and that substantive due process only prohibits the most egregious such orders. It is a question of broad significance given the many legitimate reasons police might order persons to move on, as …

KIP Data Sets and Technical Reports
This guide for planners is based on detailed examination of approximately 50 enacted wetland buffer ordinances and nine model ordinances, and upon several hundred scientific studies and analyses of buffer performance. This guide identifies both the state-of-the-art and the range of current practice in the protection of wetland buffers by local governments. Local governments considering enacting or amending a wetland buffer ordinance will find here what they need to know to manage land use and development in these important areas. The upland area surrounding a wetland -- the wetland buffer -- is essential to its health and survival. Healthy wetlands …
Charter Standards For Investigative Powers: Have The Courts Got The Balance Right?, Don Stuart
Charter Standards For Investigative Powers: Have The Courts Got The Balance Right?, Don Stuart
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper argues that judicial assertion of entrenched Charter standards since 1982 has constituted the only real check against the lure of law-and-order politics by politicians of all stripes and the consequent unremittingly legislative trend to toughen the criminal law. The paper undertakes the daunting task of stating the basic minimum Charter standards under sections 7, 8, 9 and 10 for police powers to stop, detain and question, and the n considering whether the courts have arrived at the proper balance between affording police effective enforcement powers while protecting the civil rights of all Canadians. The paper concludes that the …
Investigative Detention: A Search/Seizure By Any Other Name?, Casey Hill
Investigative Detention: A Search/Seizure By Any Other Name?, Casey Hill
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In the early years of the Charter, the Supreme Court of Canada pledged to interpret the section 8 right to be secure against unreasonable search or seizure restrictively — the Constitution “does not itself confer any powers, even of ‘reasonable’ search and seizure, on … governments” (Hunter v. Southam (1984)). Two decades later, without government advancing statutory authority, the Court recognized, in effect created, an investigative detention power as an integral and necessary aspect of street policing and exception to the arbitrary detention protection of section 9 of the Charter (R. v. Mann (2004)). This police-initiated detention, effectively a warrantless …
The Forgotten Right: Section 9 Of The Charter, Its Purpose And Meaning, James Stribopoulos
The Forgotten Right: Section 9 Of The Charter, Its Purpose And Meaning, James Stribopoulos
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines why section 9 of the Charter, the right not to be arbitrarily detained or imprisoned, has failed to flourish. The paper argues that the right has essentially remained dormant because the Supreme Court of Canada has not yet expressly identified the underlying purpose of this important constitutional guarantee. After briefly canvassing the current state of affairs under section 9, the paper shifts to a purposive analysis of the guarantee. Its historic antecedents, the provision’s drafting history, the international influences that helped shape its framing, the testimony of senior civil servants involved in its drafting, as well as …
The Silence Of Section 15: Searching For Equality At The Supreme Court Of Canada In 2007, Daphne Gilbert
The Silence Of Section 15: Searching For Equality At The Supreme Court Of Canada In 2007, Daphne Gilbert
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper considers the Supreme Court of Canada’s 2007 section 15 jurisprudence, and analyzes the “year that wasn’t”. The Equality Rights provision was only referred to in four cases, and in each instance the Court’s reasoning was very brief, amounting at best to a handful of paragraphs. While the Supreme Court may have been subdued in its equality rights jurisprudence in 2007, equality-seekers should not ignore what did (or did not) happen in the past year. The author reviews Charkaoui v. Canada (Citizenship and Immigration), Canada (Attorney General) v. Hislop, Health Services and Support-Facilities Subsector Bargaining Assn. v. British Columbia …

Drug Treatment Courts In The Twenty-First Century: The Evolution Of The Revolution In Problem-Solving Courts, The Honorable Peggy F. Hora, Theodore Stalcup
Georgia Law Review
Covering developments in the drug treatment court movement in the years since the turn of the millennium, Judge Hora and Mr. Stalcup inform the reader about updates relevant to the subject and address the arguments and concerns of other authors. The Article reviews drug treatment court basics, describes their function, and evaluates legal aspects of drug treatment court practice. The authors' analysis includes the latest in genetic research, penal statistics, and recent court cases that bear on the subject. Beginning with the premise that traditional criminal case processing does not address the underlying causes of much criminal behavior, the authors …

Pfo Law Reform, A Crucial First Step Towards Sentencing Sanity In Kentucky, Robert G. Lawson
Law Faculty Scholarly Articles
The purpose of this article is to engage in some analysis and discussion of the part of this sentencing law that cries out loudest for reform (the state's persistent felony offender law), reform that in short order would begin to deflate the population that has our prisons and jails grossly overcrowded. In this analysis and discussion, there is some brief consideration of the justifications used to support repeat offender laws (Part I), a segment on the history and evolution of Kentucky's law (Part II), an examination of a selection of repeat offender laws from other states (Part III), a report …

Application Of Artificial Neural Networks And Colored Petri Nets On Earthquake Resilient Water Distribution Systems, Nandini Kavanal Balakrishnan
Masters Theses
"Water distribution systems are important lifelines and a critical and complex infrastructure of a country. The performance of this system during unexpected rare events is important as it is one of the lifelines that people directly depend on and other factors indirectly impact the economy of a nation. In this thesis a couple of methods that can be used to predict damage and simulate the restoration process of a water distribution system are presented. Contributing to the effort of applying computational tools to infrastructure systems, Artificial Neural Network (ANN) is used to predict the rate of damage in the pipe …
