Publications from the Center for Applied Rural Innovation (CARI)
Most of the smaller communities in rural Nebraska have experienced population decline since 2000 while most of the larger communities have experienced population growth. Given these conditions, how do rural Nebraskans feel about their community? Are they satisfied with the services provided? Are they planning to move from their community next year? How do they view the quality of life in their community? What factors are important in contributing to the quality of life in their community? Do their perceptions differ by community size, the region in which they live, or their occupation? This report details 2,496 responses to the …

Perceptions Of Well-Being And Personal Finances Among Rural Nebraskans, Rebecca J. Vogt, Randolph L. Cantrell, Miguel A. Carranza, Bruce B. Johnson, David J. Peters
Publications from the Center for Applied Rural Innovation (CARI)
Nebraska has experienced slow economic growth recently. However, the state has also seen higher farm income this past year. How do rural Nebraskans perceive their quality of life? Do their perceptions differ by community size, the region in which they live, or their occupation? How concerned are rural Nebraskans about their personal finances? This report provides a detailed analysis of these questions.
This report details 2,496 responses to the 2008 Nebraska Rural Poll, the thirteenth annual effort to understand rural Nebraskans’ perceptions. Respondents were asked a series of questions about their individual well-being. Trends for some of these questions are …

Three's Company - How American Law Can Recognize A Third Social Parent In Same-Sex Headed Families, Laura Nicole Althouse
Three's Company - How American Law Can Recognize A Third Social Parent In Same-Sex Headed Families, Laura Nicole Althouse
UC Law SF Journal on Gender and Justice
In light of recent American and Canadian case law granting legal parenting rights to three parents in same-sex headed families, this Article explores how the Uniform Parentage Act can be modified to accommodate multiple parenthood within this population subset. The author draws from Professor Nancy Dowd's scholarship on unbundling social and economic parenting rights to support social fatherhood. The author also analyzes existing methods by which same-sex couples may obtain parenting rights under American law and recent California precedents applying the Uniform Parentage Act to recognize two legal mothers. The Article proposes that Nancy Dowd's revisions to the Act, coupled …
The Federal Communications Commission And The Nsa Call Database: The Duty To Investigate, Alan J. Chang
The Federal Communications Commission And The Nsa Call Database: The Duty To Investigate, Alan J. Chang
UC Law SF Communications and Entertainment Journal
In May of 2006, news broke out across the United States that the National Security Agency had compiled a call record database that consisted of numerous American consumers' private phone records. The NSA apparently obtained this data directly from four of the nation's largest phone providers at the time: AT&T, BellSouth, Verizon, and SBC. Although Congress called for an FCC investigation as to whether or not these phone companies broke the law, the Commission ultimately refused to involve itself in the matter despite the potentially immense breach of consumer privacy involved. Based on the minimal precedent to have covered this …

Settling The Matter: Does Title I Of The Ada Work?, Sharona Hoffman
Settling The Matter: Does Title I Of The Ada Work?, Sharona Hoffman
Faculty Publications
Analysis of cases decided under Title I of the Americans with Disabilities Act (ADA), which addresses employment discrimination, reveals that defendants have consistently prevailed in well over 90% of cases since the ADA's inception. This empirical evidence has led many commentators to conclude that the ADA's Title I has failed to improve workplace conditions for individuals with disabilities.
This article attempts to assess the efficacy of Title I through a different lens. It focuses on several data sets that have previously received little attention. It examines Equal Employment Opportunity Commission merit resolutions, lawsuit settlement statistics, and reports concerning reasonable accommodation …
From The Fringes Of Copyright Law: Examining California's True Name And Address Internet Piracy Statute, Brian Mcfarlin
From The Fringes Of Copyright Law: Examining California's True Name And Address Internet Piracy Statute, Brian Mcfarlin
UC Law Constitutional Quarterly
In 2004, California Governor Schwarzenegger signed into law California Penal Code section 653aa. Under the statute, anyone located in California who, "knowing that a particular recording or audiovisual work is commercial, knowingly electronically disseminates all or substantially all of that commercial recording or audiovisual work to more than 10 other people without disclosing his or her email address, and the title of the recording or audiovisual work" is guilty of a misdemeanor. While this statute allows copyright holders, such as music companies, to easily identify copyright infringers online, it accomplishes this goal by going outside of federal copyright law entirely …

Predicting Public Opinion About Juvenile Waivers, I-Fang Jan, Jeremy Ball, Anthony Walsh
Predicting Public Opinion About Juvenile Waivers, I-Fang Jan, Jeremy Ball, Anthony Walsh
Criminal Justice Faculty Publications and Presentations
The accountability movement of the juvenile justice system in the late 1980s and early 1990s encouraged more punitive practices by juvenile justice professionals. Public opinion was strong during this time. The attitudes about the juvenile justice system are a product of individual demographic, cultural, and political characteristics. This study addresses opinions about juvenile waivers–a punitive sanction–examining data from the National Opinion Survey of Crime and Justice in the 1990s (see Flanagan, 1996). This study analyzes attitudes about juvenile waivers, using multivariate quantitative methods. The results indicate a consistent relationship between the perception of the sentencing goals of the juvenile court …

Agency-Sponsored Treasure Hunts: Providing Alternatives To Traditional Geocaching, Virginia Reams, Stuart West
United States National Park Service: Publications
Geocaching, a sort of modern-day treasure hunt using Global Positioning System (GPS) units, has been prohibited in most national parks largely due to federal regulations prohibiting disturbance or damage of natural features and leaving behind unattended property. National parks, including Acadia National Park in Bar Harbor, Maine, are continually challenged by unauthorized geocache sites within their borders. The National Park Service (NPS) must take enforcement action when necessary to prevent resource damage and ensure visitor safety. However, it has become clear that geocaching is a well-established, popular pastime that is more than just a trend, and some parks perceive positive …
