The Economic Value Of Water Quality, W. Kip Viscusi, Joel Huber, Jason Bell
The Economic Value Of Water Quality, W. Kip Viscusi, Joel Huber, Jason Bell
Vanderbilt Law School Faculty Publications
Stated preference values for water quality ratings based on the US Environmental Protection Agency National Water Quality Inventory ratings provide an operational basis for benefit assessment. Iterative choice survey results for a very large, nationally representative, Web-based panel imply an average valuation of $32 for each percent increase in lakes and rivers in the region for which water quality is rated “Good.” Valuations are skewed, with the mean value more than double the median. Sources of heterogeneity in benefit values include differences in responses to average water quality information and the base level of water quality. Conjoint estimates are somewhat …

Heightened Enablement In The Unpredictable Arts, Sean B. Seymore
Vanderbilt Law School Faculty Publications
A bedrock principle of patent law is that an applicant must sufficiently disclose the invention in exchange for the right to exclude. The essential facet of the disclosure requirement is enablement, which compels a patent applicant to enable a person having ordinary skill in the art (PHOSITA) how to make and use the full scope of the claimed invention without undue experimentation. Enablement problems may arise when the applicant claims an invention broadly with a dearth of supporting data or examples. This is problematic in unpredictable fields like chemistry because a PHOSITA often needs a specific and detailed teaching in …

Among the many cutting edge technologies law enforcement agencies increasingly covet is radio frequency identification ("RFID"). Researchers predict RFID will become the most pervasive computer technology in history. Among the more extraordinary and controversial government uses of RFID-and the focus of this Paper-include implantation of subdermal RFID transmitters. Privacy concerns abound. Not surprisingly, critics and privacy advocates are wary of subdermal RFID implants, fearful that only afine line separates relatively innocuous, voluntary implantation from arbitrary government-mandated implantation. But for involuntary implantation of RFID chips to take root, government implantation programs would have to start on the small scale, targeting the …

States, Markets, And Gatekeepers: Public-Private Regulatory Regimes In An Era Of Economic Globalization, Christopher M. Bruner
Scholarly Works
This paper illuminates the spectrum of international economic regimes through discussion of an under-theorized regulatory structure in which traditional distinctions between state and market, public and private power, hard and soft law, and international and domestic policy realms, essentially collapse - the public-private gatekeeper.
Specifically, I examine striking similarities between global bond markets and e-commerce markets through comparison of entities regulating admission to them - the dominant credit rating agencies (Standard & Poor's and Moody's), and the Internet Corporation for Assigned Names and Numbers (ICANN). Following anexamination of the development of these markets and the global regulatory power exercised by …
The Case Against Tax Incentives For Organ Transfers, Lisa Milot
The Case Against Tax Incentives For Organ Transfers, Lisa Milot
Scholarly Works
Each year some 6,700 Americans die while awaiting an organ transplant. On its face, this fact seems almost inconsequential, representing less than 3% of American deaths annually. However, for the nearly 100,000 patients on the transplant wait list (and their families), nothing could be more consequential. What is more, the demand for transplantable organs is sure to rise as (1) more diseases become subject to prevention or cure, making organ failure the first sign of medical problems; (2) the success rate for transplants increases, leading to wider use; and (3) barriers to inclusion on the wait list are removed.

From Medals To Morality: Sportive Nationalism And The Problem Of Doping In Sports, Dionne L. Koller
From Medals To Morality: Sportive Nationalism And The Problem Of Doping In Sports, Dionne L. Koller
All Faculty Scholarship
The conventional wisdom is that in the fight against doping, the government is in the best position to clean up sport and protect the integrity of competition. The premise underlying this assumption is that in the United States, sport is private, so that the government typically has no role in its regulation. It is now, advocates suggest, with the integrity of sport on the line, the government should move off the sidelines and take action. This essay challenges that premise by arguing that with respect to doping in sports the government has not merely been a sidelines observer, but was …
Being True To The Text: From Genesis To Harry Potter, Paul Flesher
Being True To The Text: From Genesis To Harry Potter, Paul Flesher
Journal of Religion & Film
When a book is made into a film, journalists often ask experts, “How accurate is it?” This usually generates a list of “errors” and ends in a negative judgment on the film’s quality. This is the wrong question. Instead, one should explore what the changes to the story mean, or, even more significantly, they should ask, how are a film’s additions, deletions, and other narrative changes combined with its accurate portrayals?
This essay begins by presenting an ancient mode of translation that interwove accurate, literal translation with additions and alterations to create a new rendering in which the changes were …
To “Elevate Unfortunate Humanity” On-Screen: Linking World War I And Protestant Missions Through Silent Film, Christopher J. Anderson
To “Elevate Unfortunate Humanity” On-Screen: Linking World War I And Protestant Missions Through Silent Film, Christopher J. Anderson
Journal of Religion & Film
The purpose of this essay is to examine how post-World War I American Methodists used silent film to link the progress of the U.S. military with the advances of denominational missionaries overseas. Both the American army and the largest Protestant denomination in the U.S. were on separate yet intricately intertwined missions – one to promote the extension of American “democracy” and “civilization” by rescuing foreigners from the clutches of menacing dictators, the other to promote a version of U.S. Protestantism by saving foreigners from the grasp of non-Christian religions and religious practices.

Improving Agricultural Profitability Through An Income Opportunities For Rural Areas Program, Amber Lockawich Hancharick, Nancy Ellen Kiernan
Journal of Extension
Significant changes in the landscape of the south central region of Pennsylvania have created new challenges and demands for Cooperative Extension and the agricultural community. Extension developed a program to help both experienced and new farmers recognize and implement new value-added and marketing opportunities. The Income Opportunities Program offered conferences, educational workshops, and one-on-one consultation by an Extension educator specifically hired for this program. Results from the formative evaluation indicated that program participants started 154 new enterprises, created 44 new part and full time jobs, increased profitability, and invested almost $1 million back into the local economy.

Using Workshops To Educate Landowners About Developing Natural Resource Enterprises To Diversify Income On The Family Farm, W Daryl Jones, Katherine M. Jacobs, Greg K. Yarrow, Rebecca Mcpeake
Journal of Extension
Enterprises based on the natural resources available on farm and other private lands, such as fee-access hunting and fishing, agritourism, and wildlife watching, can provide opportunities for supplementing and diversifying income. Workshops featuring a combination of presentations and field tours were implemented throughout the southern U.S. to educate landowners on the benefits, considerations, and management of these enterprises. Participants were surveyed regarding workshop quality and future land management activities. Most landowners reported that the information gained at these events would increase revenues collected on their properties and that they expect to modify their current land use practices as a result.

Ag Resource Tools & Media Coverage: A Study Of Newspaper Coverage Of Cotton In Texas, Ashlee Vinyard, Cindy Akers, Judy Oskam, David L. Doerfert
Journal of Extension
Many Extension professionals work with journalists in order to get their message out to various stakeholders. Some develop agricultural resource tools for the media. The study reported here examined coverage of cotton articles from 534 Texas newspapers following the dissemination of the CottonLink© media resource tool. An overall increase was found in the number of articles, newspapers, and circulation size after the dissemination of the CottonLink© media resource tool, while a decrease was found in the number of judgment sentences during the study. Additional research is recommended.

E-Learning Pedagogy In The Primary School Classroom: The Mcdonaldization Of Education, Matthew Etherington
E-Learning Pedagogy In The Primary School Classroom: The Mcdonaldization Of Education, Matthew Etherington
Australian Journal of Teacher Education
This paper begins as an initial rejoinder to the ideas expressed by Ross (2000) in The Promise and Perils of E-Learning: A critical look at the new technology. In his article, Ross supports the traditional practices of pedagogy at the primary school level—face-to-face pedagogy— and then critiques what he describes as a ‘fetishisation’ of technological pedagogy—a fetishisation seen in the increase of E-learning pedagogy at the primary school level. The ideas expressed in this article gain their structure and momentum from Ross’s (2000) arguments against E-learning and extends a more cautious approach to the widespread belief in the success of …

A Survey Of Recent Illinois Ethics Law: Professionalism In Practice, Kate T. Hlava
Southern Illinois University Law Journal
Professionalism should be a part of every Illinois lawyer’s daily practice. It is not enough to memorize the Rules of Professional Responsibility. Creating a legal practice that reflects one’s ethical duties and lives up the high degree of professionalism required by an attorney is a daily task and one that cannot be accomplished without effort. The rules can be unclear and ethical dilemmas can be ambiguous.
However, in many situations there are no excuses; the rules and case law make clear what is required. There are rules that every attorney should know and ethical duties that should always be implemented. …
The Power Of ‘When I Was Your Age’: Research On Parental Narratives And Their Influence On Cognitive Dissonance In Children, Darci C. Adams
The Power Of ‘When I Was Your Age’: Research On Parental Narratives And Their Influence On Cognitive Dissonance In Children, Darci C. Adams
Masters Theses
Parents are continually looking for correct and effective ways to discipline and instruct their children. Often, parents will tell a personal narrative beginning with “when I was your age” to demonstrate to their children the appropriate way to think and behave. This thesis asks three research questions: What are the common themes in parental narratives that young adults remember in relation to instruction or discipline? How does the narrative structure demonstrate narrative coherence and fidelity? What do young adults self-report about the impact of the parental narrative on their cognitive dissonance? Through a content analysis of eighty completed surveys by …
