Kalinago Ethnicity And Ancestral Knowledge, Kathryn A. Hudepohl Oct 2008

Kalinago Ethnicity And Ancestral Knowledge, Kathryn A. Hudepohl

Southern Anthropologist

The Kalinago of Dominica have engaged in various efforts at cultural renewal in the past three decades. In this paper I examine one particular activity, recreated traditional dancing, and analyze how performers combine current and past cultural practices from their own community together with knowledge garnered from other indigenous groups to reinvent dance performances. Such performances represent a recent manifestation of successful cultural renewal in which community members use known resources to re-imagine and recreate meaningful tradition(s). Analysis of recreated traditional dance performances provides insight regarding how some members of the Kalinago community think about and utilize the ancestral knowledge …

Patently Protectionist? An Empirical Analysis Of Patent Cases At The International Trade Commission, Colleen V. Chien Oct 2008

Patently Protectionist? An Empirical Analysis Of Patent Cases At The International Trade Commission, Colleen V. Chien

William & Mary Law Review

The International Trade Commission (ITC) provides a special forum for adjudicating patent disputes involving imports. It offers several advantages over United States district courts to patentees, including relaxed jurisdictional requirements, speed, and unique remedies. Unlike district courts, the ITC almost automatically grants injunctive relief to prevailing patentees, and does not recognize certain defenses to infringement. These features have been justified as needed to prosecute foreign infringers who would otherwise evade U.S. district courts. They have also led to charges that the ITC is protectionist and unfair to defendants and that it fosters inconsistency in U.S. patent law. Based on an …

Judicial Independence: A Call For Reform, Terence J. Lau Oct 2008

Judicial Independence: A Call For Reform, Terence J. Lau

Nevada Law Journal

According to retired Justice Sandra Day O’Connor, judicial independence is threatened now more so than any other time throughout history. Attacks on the judiciary have crossed the line from legitimate criticism to partisan harangues that threaten the ability of judges to rule fairly and without bias. This Article begins with a historical look at judicial independence as it has shaped the Supreme Court, including the impeachment of Samuel Chase, Ex Parte McCardle and the court-packing plan and concludes with a call for reform to the judicial appointment process to permit greater transparency in judicial selection.

The Fall And Rise Of Qualified Immunity: From Hope To Harris, Mark R. Brown Oct 2008

The Fall And Rise Of Qualified Immunity: From Hope To Harris, Mark R. Brown

Nevada Law Journal

In Mitchell v. Forsyth (1985) the Court ruled that interlocutory appeals can be taken by government officials from denials of motions for summary judgment based on qualified immunity. Johnson v. Jones (1995) ruled that these interlocutory appeals are limited to legal questions, not matters of fact. This limited the effect of the Court’s holding in Anderson v. Creighton (1987) that some measure of factual similarity between prior reported cases and governmental wrongdoing is necessary to overcome qualified immunity. Hope v. Pelzer (2002) further cabined Anderson by rejecting the Eleventh Circuit’s conclusion that government wrongdoing must be “materially similar” to conduct …

Aerial And Satellite Image Processing Applications, Srinivas K. Jakkula Oct 2008

Aerial And Satellite Image Processing Applications, Srinivas K. Jakkula

Electrical & Computer Engineering Theses & Dissertations

Aerial and satellite images are used extensively in many trip and mapping software packages, such as Google Earth etc. Aerial images differ significantly due to the variations in atmospheric clarity, atmospheric layer density, humidity, temperature, and season under which the aerial images are captured. Among the issues in effective utilization of aerial images, color tone discrepancy is the inconsistency in brightness, saturation, or color balance between images representing adjacent areas, causing adjacent areas appear significantly different that would otherwise be similar. Aenal images are also routinely used as ground textures to simulate Earth surface and 3D features on Earth in …

Leveraging News And Advertising To Introduce New Brands On The Web, Anca C. Micu, Esther Thorson Oct 2008

Leveraging News And Advertising To Introduce New Brands On The Web, Anca C. Micu, Esther Thorson

WCBT Faculty Publications

Previous studies using the integrated marketing communications framework have examined the increased effectiveness of combining either multiple media or different tactics when promoting a brand. This study considers integrating advertising and publicity to promote an unknown brand on the Internet. Experiment results indicate that when exposure to advertising combines with exposure to objective news about a new brand, effectiveness increases in terms of both brand attitudes and behavioral intentions. For sequencing exposures for technical brands, the news-then-advertising condition offers more effectiveness than the reverse sequence. When introducing non-technical brands on the Web though, using advertising first is more effective in …

Why The Filed Rate Doctrine Should Not Imply Blanket Judicial Deference To Regulatory Agencies, Jim Rossi Oct 2008

Why The Filed Rate Doctrine Should Not Imply Blanket Judicial Deference To Regulatory Agencies, Jim Rossi

Vanderbilt Law School Faculty Publications

The filed rate doctrine is a venerable doctrine of public utility regulation. Federal courts applying the doctrine frequently defer to the regulatory agency and refuse to consider the merits of alleged violations of antitrust, tort or contract claims where resolution would require a departure from a filed rate. For over a century, the filed rate doctrine has served many important purposes. However, with increased attention to market-based approaches to electric power, natural gas and telecommunications regulation, there is reason to question both the doctrine's continued applicability and usefulness. This short essay argues that, as regulators implement competitive markets in utility …
