Collaborative Family Law And Gender Inequalities: Balancing Risks And Opportunities, Wanda Wiegers, Michaela Keet

Osgoode Hall Law Journal

Collaborative Law (CL) is a unique settlement process increasingly used by family lawyers. In this article, the authors examine the potential of CL to alleviate the impact of gendered differences in bargaining power between family clients. Proponents suggest that the more extensive involvement of lawyers in the CL process can prove more effective in dealing with vulnerable clients than either litigation or family mediation in their current forms. Drawing on the available literature on CL, their own empirical research, and the extensive literature on gender imbalances in mediation, the authors examine the likely impact of both the background norms and …

University of Miami International and Comparative Law Review

The governments of both the United States and China maintain the death penalty as a means of punishing its most dangerous criminals, but with an astounding 68 capital offenses, China perennially remains the world leader in executions. Towards An Islamic Theology Of Nonviolence: A Critical Appraisal Of Maulana Wahiduddin Khan's View Of Jihad (Part Ii), Irfan A. Omar

Theology Faculty Research and Publications

In the second and last part of his article (see September issue, 671·80) Dr Omar explains the true meaning of Jihad in the ancient Islamic sources, which does not stand for violent warfare but for the struggle that every Muslim , indeed every person, should go through to remain obedient to God's Word and to fulfil [sic] the will of God on earth. With this we wish to commemorate the UNO declared day dedicated to non-violence, the day known in India as Gandhi Jayanti (Oct. 2).

Breaking The Silence Surrounding Hepatitis C By Promoting Self-Efficacy: A Study Of Hepatitis C Public Service Announcements, Jean M. Grow, Stephanie A. Christopher

College of Communication Faculty Research and Publications

Hepatitis C (HCV) is the most common chronic blood borne virus in the United States. Despite this fact, there is a startling lack of awareness about HCV among individuals who may have contracted the virus. This study, grounded in self-efficacy theory, analyzes public service announcements (PSAs) for HCV. Using focus groups to contextualize the responses of individuals living with HCV, the authors conclude that stigma and structural barriers pose the greatest challenges for health communicators trying to reach at-risk populations. The findings suggest that expanded use of celebrity appeals, realistic drug portrayals, more extensive use of social networking in tandem …

Towards An Equality-Enhancing Conception Of Privacy, Jane Bailey Oct 2008

Towards An Equality-Enhancing Conception Of Privacy, Jane Bailey

Dalhousie Law Journal

Canadian jurisprudence has explicitly recognized the impact of child pornography on the privacy rights of the children abused in its production. In contrast, it has generally not analyzed other forms of harmful expression, such as hate propaganda and obscenity,to be violations of the privacy rights of those targeted. In a previous article, the author suggested that this distinction in the jurisprudence reflected the relative ease with which the privacy interests of the individual children whose abuse is documented inchild pornography meshed with the prevalent Western approach toprivacy as a negative individual liberty against intrusion. Noting the historic role that the …

Something To Talk About: Is There A Charter Right To Access Government Information?, Vincent Kazmierski Oct 2008

Something To Talk About: Is There A Charter Right To Access Government Information?, Vincent Kazmierski

Dalhousie Law Journal

Can sections 2(b) and 3 of the Canadian Charter of Rights and Freedoms be interpreted to protect a constitutional right of access to government information? The author argues that the constitutional principle of democracy provides a foundation for judicial recognition of such a constitutional right of access even though the inclusion ofan explicit right to access to government information was rejected during the process of drafting the Charter Given that the Supreme Court of Canada's section 2(b) and 3 jurisprudence has been informed by the principle of democracy, the application of the principle may now guide the Court to include …

Four uses and gratifications were singled out for observation including interactivity, asynchroniety, demassification, and community. The work reports the observations of the uses and gratifications through the …

Research Collection School Of Computing and Information Systems

This paper presents an unified approach in analyzing and Structuring the content of videotaped lectures for distance learning applications. By Structuring lecture videos, we can Support topic indexing and semantic querying of multimedia documents captured in the traditional classrooms. Our goal in this paper is to automatically construct the cross references of lecture videos and textual documents so as to facilitate the synchronized browsing and presentation of multimedia information. The major issues involved in our approach are topical event detection, video text analysis and the matching of slide shots and external documents. In topical event detection, a novel transition detector …
