The purpose of the thesis, Biologically Inspired Object Categorization system, is to provide an automatic system to classify the real-world images into categories. Generally, computer algorithms classify objects with much lower efficiency than human. Furthermore, some images with complex features such as cat and dog faces are difficult to be classified by ordinary computer algorithms. Therefore, the simulation of the structure and process of a mammalian’s visual cortex is created, which functions similarly to a human’s visual cortex, by using a computer. Procedural evolution in complex litigation seems to have left the civil jury behind. Reliance on aggregating devices, such as multidistrict litigation and class actions, as well as settlement pressure created by “bellwether” cases, has resulted in cases of national scope being tried by local juries. Local juries thus have the potential to impose their values on the rest of the country. This trend motivates parties to forum-shop, and some commentators suggest eliminating jury trials in complex cases altogether. The United States Department of Justice has come under attack in recent years because of its increased attention to, and prosecution of, crimes committed during the course of its investigations — obstruction of justice, perjury, and making false statements. These crimes have been labeled “cover-up” or “process crimes,” and the charging prosecutors have been criticized as bringing such charges only against high-profile defendants as to whom there is insufficient evidence to charge the “more serious” underlying offenses that prompted the initial investigation. Some critics have gone so far as to label these prosecutions “vindictive.” Much of this criticism is misplaced. …

This paper assesses the private remedies available under Rule 10b-5 to retail investors who have been defrauded by false corporate disclosures. After comparing the treatment received by retail investors to the treatment received by institutional investors, I identify several areas in which the federal securities laws disfavor retail investors who have been defrauded by false corporate disclosures, including the creation of a two-tiered system of investor remedies for securities fraud. Institutional investors are permitted to pick and choose which law and forum offers them the most attractive chance for recovery, but retail investors typically do not have this opportunity. They …

Management-intensive grazing is a grazing management strategy that relies on careful monitoring of animals at pasture and frequent relocation of animals between various regions of the pasture, or paddocks, in order to maximize the nutrients and sustenance the animals obtain through grazing. BACKGROUND: How HIV-1 enter into the eyes remains obscure. We postulated that HIV-1 Tat protein can alter the expression of specific tight-junction proteins and disturb the blood retinal barrier, and contributes to HIV trafficking into the eyes. This study is to determine the effects of HIV-1 Tat proteins on the barrier function and tight-junction protein expression of retinal pigment epithelial cell (RPE). METHODS: A human RPE cell line (D407) cultured on microporous filter-supports was used. The trademark use doctrine plays a critical role in ensuring that trademark law serves its proper purpose of encouraging market exchange and lowering consumer search costs. As we have explained in detail elsewhere, the doctrine ensures that trademarks do not become a weapon used to suppress speech or to interfere with rather than promote the efficient operation of the marketplace.

Their discussion details each step of the hiring process, from vacancy to offer, and explores strategies for implementing the steps successfully. The processes examined include: reviewing the vacancy, assessing the library needs, forming an effective search committee, writing a winning job description, checking references, conducting an interview, and making an offer. The authors assert that a successful hire will influence every aspect of your library and, as such, a library needs to devote considerable attention and resources to librarian searches.

Malpractice Payouts And Malpractice Insurance: Evidence From Texas Closed Claims, 1990-2003, Charles Silver, Kathryn Zeiler, Bernard Black, David Hyman, William Sage

Background. This study is the first to quantify physicians' malpractice insurance limits. It also examines the connection between policy size and payments on claims, including the frequency of settlement at the policy limits and the frequency of out-of-pocket payments.

Methods. Statistical analyses using data collected by the Texas Department of Insurance (TDI) covering all insured medical malpractice claims against physicians closed between 1990 and 2003 with payment of $25,000 or more (measured in 1988 dollars).

Results. Contrary to conventional wisdom, per-occurrence limits of $500,000 or less were as common as $1 million limits. Nominal policy size was stable over time, …

In this article we examine the rapid emergence and expansion of standardized product and process frameworks and a private-sector compliance and enforcement infrastructure that we believe may increasingly be providing a substitute for public and legal regulatory infrastructure in global commerce. This infrastructure is provided by a proliferation of performance codes and standards, many of which define acceptable social and environmental behavior, and a rapidly-growing number of privately-trained and authorized inspectors and certifiers that we call the third-party assurance industry. Like Australia and the United States, Canada is usually considered a ‘traditional’ immigrant receiving country in contrast to many countries in Europe, Asia, and Africa where large-scale immigration is a relatively recent phenomenon. This chapter reviews past and current Canadian immigration policy. Section one provides a brief historical overview of Canadian immigration patterns. Section two outlines current immigration policy, including the changes introduced by Canada’s Immigration and Refugee Protection Act (2002). Section three discusses the relationship between immigration policy and the integration of immigrants in Canadian society. This essay examines the confluence of local and global dynamics, exploring how transnational migration affects and is affected by gender roles, kinship relations, intergenerational obligations, and ideologies of parenthood. Journeying to the Middle East repeated on two-year labor contracts, many of Sri Lanka’s migrant housemaids leave behind their husbands and children. Women’s long-term absences reorganize and disrupt widely accepted gendered attributions of parenting roles, with fathers and female relatives taking over household tasks. Migrants say that economic difficulties prompt migration, and assess commitment to kin in financial terms. The government also benefits from remittances. This engineering design is to provide a more accurate description of non-Darcy flow at the near wellbore region. Objectives of the research will be to characterize properties of non-Darcy flow and develop accurate descriptions of carbon dioxide (CO2) flow during injection scenarios and oil flow during production. Other objectives will be to define non-Darcy flow criteria from Forchheimer’s number and analyze the amount of energy used by enhanced flow rates through injection and production wells. Methodology used to obtain results will reflect geology, reservoir engineering, and injection and production flow rates. In June, 2007 the province of Ontario, Canada, released environmental penalties (EPs) regulations. EPs (or administrative penalties, as they are called in the US) are the environmental equivalent of speeding tickets for facilities that violate pollution laws. They are found in numerous jurisdictions and are widely understood as part of a move toward smart regulation. The Ontario regulations offer reduced EPs to facilities with an environmental management system (EMS) that meets the requirements of ISO 14001 or the chemical industry's Responsible Care initiative. This study investigates the use of Digital Storytelling as an intervention to improve the academic performance and social interactions of a sixth grade student with High-Functioning Autism. Qualitative methodology, using an inductive approach informed by grounded theory, was employed throughout this exploratory case study. Three separate data sources, consisting of document analysis, interviews, and participant observation, contributed to the findings of this study. Triangulation of inquiry methods enhanced the validity and rigor of this investigation. This study examines instructional behaviors and communication strategies used in face-to-face and online educational settings. The purpose of this research is to identify key components of community wildfire risk reduction programs and potential influences on the adoption of these program elements. Community wildfire programs have been developed to educate and encourage property owners to adopt “vegetation management” practices such as creating defensible space around structures, landscaping with fire-resistant plants, and removing potential wildfire fuels such as trees and shrubs. Although foam has been widely used in many scientific and engineering applications, the current understanding of foam rheology in pipes is still very limited because of its complex nature. This experimental study, for the first time, investigates the flow rheology of foams in pipes by placing a special emphasis on two distinct foam flow regimes.
