The Methodology Of The Behavioral Analysis Of Law, Avishalom Tor Jan 2008

The Methodology Of The Behavioral Analysis Of Law, Avishalom Tor

Journal Articles

This article examines the behavioral analysis of law, meaning the application of empirical behavioral evidence to legal analysis, which has become increasingly popular in legal scholarship in recent years. Following the introduction in Part I, this Article highlights four central propositions on the subject. The first, developed in Part II, asserts that the efficacy of the law often depends on its accounting for relevant patterns of human behavior, most notably those studied by behavioral decision scientists. This Part therefore reviews important behavioral findings, illustrating their application and relevance to a broad range of legal questions. Part III then argues that …

Faculty Publications

High profile sporting events in the United States have been identified by the Department of Homeland Security (DHS) as potential terrorist targets (Lipton, 2005). However, there has been an identified lack of training and education for key personnel responsible for sport security operations (Cunningham, 2007). Recognizing the demand and need for a specialized area in sport event security management, the University of Southern Mississippi School of Human Performance and Recreation developed an emphasis area in sports event security management as part of the Master of Science in Sport Management program. The sport security emphasis area includes three graduate level courses …

Dead Wrong, Ronald F. Wright, Marc L. Miller Jan 2008

Dead Wrong, Ronald F. Wright, Marc L. Miller

Utah Law Review

The remedies for this common mindset that produces both categories of problems in Dallas could emerge from two different directions. Internally, many district attorney offices need serious overhaul. Probationary sentences for murder reached as part of a plea deal should be the extremely rare exception. The office leadership should set up policies, procedures, and data-collection practices to guide decision making in such cases. In effect, the leadership should set price caps on the discounts that prosecutors can offer to obtain plea deals.

Defamation Claims Based On Parody And Other Fanciful Communications Not Intended To Be Understood As Fact, Joseph H. King

Utah Law Review

In sonle types of communication, the 'author contends that her words were not intended to be understood as representing that the events portrayed actually occurred. Such communications comm/only take the form of parody, cartoons, caricature, or similar types of communication. Sometimes parodies and similar types of speech will be the bases of claims for defamation. The problem is that while a parody may often exact a severe emotional toll on its victim, it mayor may not adversely affect the victim's reputation. A victim's reputation can be harmed only if falsely depicted or implied events change the recipients' perception of the …

Fight Blight: Cities Sue To Hold Lenders Responsible For The Rise In Foreclosures And Abandoned Properties, Creola Johnson Jan 2008

Fight Blight: Cities Sue To Hold Lenders Responsible For The Rise In Foreclosures And Abandoned Properties, Creola Johnson

Utah Law Review

In the aftermath of the subprime mortgage meltdown,l Americans have been forced to change the way they view homeownership. Once considered to be the average person's most valuable asset, for many, homes have transformed into a burdensome liability. Spurred by the expansive securitization of the residential mortgage industry, many subprime mortgage lenders dismissed traditional lending standards and issued what some call "liar," "naked," or "no doc" loans, which were loans approved by lenders based on falsified or little-to-no documentation about the borrower's income or assets. Some of these loans were given to borrowers with poor credit histories and in amounts …

"Freedom Comes Only From The Law": The Debate Over Law's Capacity And The Making Of Brown V. Board Ofeducation, Christopher W. Schmidt

Utah Law Review

Brown v. Board of Education emerged from a constellation of assumptions about race and law, the contours of which have yet to be fully reconstructed. We are familiar with the efforts of the National Association for the Advancement of Colored People (NAACP) and their allies to attack the belief, infamously espoused in Plessy v. Ferguson that segregation imposed no necessary badge of inferiority on African Americans. Familiar, too, is the growing recognition by the middle of the twentieth century of the importance of education to modem American society, a factor Chief Justice Earl Warren highlighted in the Brown opinion. And …

Environmental Influences On Adherence To Self-Management Behaviors And Glycemic Control In African American Patients With Type 2 Diabetes Mellitus, Brooke L. Barbera

LSU Master's Theses

Diabetes mellitus is a chronic illness effecting approximately 20.8 million individuals in the United States. Minorities are adversely affected, with age-adjusted prevalence 1.7 times higher in African Americans than Caucasians. Type 2 diabetes is significantly affected by behavioral and environmental risk factors, including the presence of co-occurring diseases (i.e., hypertension, hyperlipidemia), obesity, age, and lack of physical activity, and each of these risk factors is more prevalent among African Americans. The treatment of diabetes is largely self-managed, with patients and their families handling 95% of their own care. Adherence to the multi-component diabetic treatment regimen requires daily care, often occurring …

Estimating The Economic Impacts Of Hurricane Damage On Coastal Fishing Infrastructure, Tanza Erlambang

LSU Master's Theses

Two severe Hurricanes, Katrina and Rita, caused devastating damages in the northern Gulf of Mexico during late summer and early fall 2005. Louisiana was the most heavily impacted state, where both storms made initial landfall. The storms caused billions of dollars in damages to public and private infrastructure, with particularly strong impacts to coastal fishing businesses. Numerous assessments of coastal fisheries infrastructure damage were developed by state and federal agencies following the storms. The range of estimates varied greatly (from $275 million to $3.5 billion), because of a wide range of methods and assumptions. This study describes two alternative damage …

Examining The Effects Of Non-Intensive Therapy On Word Retrieval, Speech Intelligibility And Quality Of Life Following Intensive Therapy, Hillary Leigh Goodwin

LSU Master's Theses

The purpose of this study was to determine if involvement in intensive treatment would help a patient with aphasia, secondary to a cerebral vascular accident, accompanied by dysarthria, maintain skill levels during non-intensive treatment. A literature review uncovered numerous studies on intensive treatment. These studies discussed the improvements the subjects were able to make across various areas during the time of intensive treatment; however, very little research was available to indicate these subjects’ success when re-entering non-intensive treatment. This study proposed two specific questions: was the subject able to maintain word retrieval, speech intelligibility, and quality of life levels from …

Fabrication Of Micro Bumps For Micro Scale Thermal Management, Ajay Ashok Kardak Jan 2008

Fabrication Of Micro Bumps For Micro Scale Thermal Management, Ajay Ashok Kardak

LSU Master's Theses

Cryopreservation is storage of biological systems at ultra low temperatures for a prolonged duration; such that they can be thawed and restored to the same living state. It is important to understand the behavior of cells when they are subjected to subzero temperatures. Research in this area has shown the occurrence of two main biophysical events; cellular dehydration and intracellular ice formation. Current techniques for characterizing the dehydration in cells as part of a tissue are not adequate for studying intracellular ice formation in tissues. An integrated device consisting of an array of thermal sensors (microthermocouples) and actuators (microthermoelectric coolers) …
