To The Full Court Or 3jx? How Does The Supreme Court Of The State Of New Hampshire Sort Cases?, Susan Parshley

Master's Theses and Capstones

This research is designed to develop a model of case selection in the Supreme Court of the State of New Hampshire. Appeals in the state of New Hampshire are heard either by the full court or an expedited panel called the 3JX panel. Data from the 2005 and 2006 State of New Hampshire Supreme Court full court and 3JX panel are sorted into categories first proposed by Burton M. Atkins and Henry R. Glick in their study entitled "Environmental and Structural Variables as Determinants of Issues in State Courts of Last Resort". The sorted data is then analyzed to determine …

"The Invisible Lines Between Us": Border-Making In Anglo-America, 1750--1800, Cameron B. Strang

Master's Theses and Capstones

This thesis explores how the boundary-making practices of white officials came to be the dominant way of dividing and claiming the American landscape. It argues that, in the late colonial era, neither Indians nor officials could actualize their desired boundaries. Indians' map-based boundaries were annulled by white officials while officials' land surveys were subject to onsite termination and manipulation by Indian groups. White frontier settlers, however, developed powerful ways to establish their land claims---namely informal delineations backed by actual settlement---that could not be prevented by officials or Indians. In the final years of the colonial era and the first decades …

The Impact Of Federal Violence Against Women Grants Upon Two New Hampshire Cities: Case Disposition And Police Report Writing, Catherine Anne Seabury Jan 2008

The Impact Of Federal Violence Against Women Grants Upon Two New Hampshire Cities: Case Disposition And Police Report Writing, Catherine Anne Seabury

Master's Theses and Capstones

In 1994 the Violence Against Women Act (VAWA) was passed in the United States, and with it came a host of changes for the many cities and towns throughout the country which were granted federal funds in order to combat domestic violence.

Although these structural changes appear to have been successful, little empirical research has been conducted with the goal of accurately reporting what, if any, improvements have occurred within communities as a result of VAWA funding.

This research examines the impact of federal VAWA funds on two New Hampshire cities---Manchester, which has been receiving VAWA funding since 1995, the …

Effects Of Reputation On The Legal Profession, Fred C. Zacharias Jan 2008

Effects Of Reputation On The Legal Profession, Fred C. Zacharias

Washington and Lee Law Review

This Article considers how the reputation of lawyers and signaling between lawyers and clients affects the impact of legal ethics rules. Academics who have written about the relationships between lawyers and clients have not adequately considered the influence of reputational signaling on who clients hire and on lawyers' implementation of discretion. These empirical issues are key to a proper analysis of many professional rules and to the approach bar associations should take to matching lawyers and clients. The Article will focus primarily on lawyers' reputations as a proxy for what clients want, or need, to know about their representatives. Part …

The Temperature Dependence Of Hysteretic Processes In Co Nanowires Arrays, I Astefanoaei, I Dumitru, A Diaconu, L Spinu, A Stancu

Physics Faculty Publications

In this paper, the temperature dependence of the hysteretic processes of Co nanowires, squarelly ordered in an array prepared by electrodeposition in nanopores of alumina membranes was analyzed. Both the magnetostatic interactions induced in the nanowires arrays and the thermal stresses (radial, azimuthal and axial stresses), which appear during the cooling of the system (nanowire and alumina template) from room temperature to 3 K was evaluated. The analysis of thermal induced stresses provides useful informations concerning the magnetic anisotropy in the Co nanowires. The temperature dependence of the remanent magnetization and coercitive field as an effect of the induced thermal …

Multicultural Training In A Clinical Psychology Doctoral Program: A Template For Conducting A Cultural Audit, Angela F. Williams

Theses and Dissertations

This study explored the multicultural training practices within Pepperdine University's PsyD program in clinical psychology and provided a template for other training programs attempting to conduct a cultural audit. Utilizing a bounded case study design, the current investigation gathered data from faculty in the PsyD program, currently enrolled doctoral students, course syllabi and prospective student recruitment materials. Research questions were: How do faculty members, full-time, adjunct and visiting, self-rate their overall competence in integrating multicultural issues in the classroom?; 2.) How do faculty members rate the multicultural training offered in Pepperdine's PsyD program?; 3.) How frequently are multicultural issues addressed …

Liberty, Judicial Review, And The Rule Of Law At Guantanamo: A Battle Half Won, Douglass Cassel Jan 2008

Liberty, Judicial Review, And The Rule Of Law At Guantanamo: A Battle Half Won, Douglass Cassel

Journal Articles

In Boumediene v. Bush, 128 S. Ct. 2229 (2008), five members of the Supreme Court held that foreign prisoners at Guantanamo enjoy the constitutional privilege of habeas corpus; that their imprisonment had lasted too long for the Court to await completion of statutory review by lower courts of military tribunal findings that the prisoners were "enemy combatants"; and that the statutory judicial review was too deficient to substitute for the Great Writ.

Four Justices vigorously dissented. On the surface they differed on the history of the reach of the common law writ of habeas corpus, and on the procedural …
